The County of Albemarle Planning Division will recommend approval of the plan referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):

otherwise specified.]
Initial Site Plan Comments (from conditional approval letter dated 10/6/17):
1. Pay the required notices fee of $215.
UPDATE: Comment Addressed.
2. A site plan meeting all the requirements of section 32.6 of Chapter 18 of the Code.
FINAL: Comment not fully addressed. See comments below.
3. A site plan meeting all the requirements of ZMA 2001-20, its Application Plan, its Code of Development
(C.O.D), and SP2003-30.

4. [ZMA2001-20] It is suggested that the review of the initial site plan is deferred until the submitted ZMA
Amendment, addressing the square footage of non-residential uses in Area C, is either approved or denied.
If the applicant does not wish to defer then submit prior to, or concurrently with, the Final Site Plan an exhibit
demonstrating "general accord" with the Application Plan. Based on meetings with the County Attorney's
office and the Zoning Division, please submit an exhibit to demonstrate that the remaining portion of Block I
can be developed in "general accord" with the Application Plan as required under Proffer #1. The final site
plan will not be approved until it is shown that once this site plan is approved the remaining portion of Block I
will still be able to be developed in general accord with the previously approved ZMA Application Plan or the
ZMA Amendment that has been submitted addressing remaining available square footage in Block I has
been approved.
FINAL: Comment addressed. The exhibit you provided shows that the hotel and parking design
leaves sufficient room in the remainder of Block 1 for future general accord with the application plan
and code of development. Please be advised that this exhibit is not approved as an initial site plan
or as specifically approvable according to the Code of Development, application plan or proffers.
Instead it demonstrates that there is sufficient area and square footage available for Lot 3 to be
develop in accord with its zoning.

6. [32.5.2(a)] Address the following:

_version for ZMA2001-20. Provide the final signed/approved version of the proffer within the site
Ian.
• Show the project numbers for the approved ZMA and SP under "Zoning" on the cover sheet.

o Revise the coversheet to show also show the SP number (SP2003-30).
o If SDP201700046 is to remain on the coversheet then specify that it is the Initial Site
Plan project number. However, this would not normally be shown in the "Zoning"
area of the coversheet.

Provide the departing lot line parallel to Target heading northwest from the subject parcel.

[32.5.2(b)] Address the following:
Revise the "New Road/Sidewalk" text under "Impervious Area Schedule" to specify "New & Existing
Roads/Sidewalks". If it is only "New Road/Sidewalk" then the "Existing Impervious" would need to
be added to the "Total=" which would then be over 80,000 SF instead of the specified "58,140 SF"

• Revise the parking calculation to include any additional uses/spaces within the hotel, such as
assembly rooms or restaurants. Those uses require additional parking spaces.
FINAL: Comment addressed.
• Revise the "Building Height" to specify the proposed building height and not just the maximum
height. Provide a stepback if the third story begins above 40'.
FINAL: Comment addressed.
Insufficient parking spaces have been provided for the use, and some of the parking spaces shown
on the site plan are beyond the boundaries of the subject parcel. Although Article II of the
Declaration recorded in Deed Book 3085 Page 361-406 specified easements "for the purpose of
passage and parking of vehicles over and across the parking and driveway areas of each Parcel" it
also states in Article VI Construction, Section 6.06 that "The Parking Area on each separate Parcel
and/or legally subdivided parcel of land (regardless of ownership) comprising the Property shall
contain sufficient parking spaces on said Parcel, which may not rely on parking spaces that may be
available on another portion of the Development, in order to comply with the greater of (i)
Governmental Requirements or (ii) the following minimum requirements..." Therefore, it appears
that the parking for this use must be met within the subject parcel unless the existing agreements
are amended. Update the site plan to show how all parking requirements are being met and do one
of the following:
o Revise the agreement and submit all documents and plats required for shared parking for
review. Shared parking must be approved by the Zoning Administrator.

o Revise the agreement and provide all documents and plats required for off -site parking and
update the site plan to show required signage.
o Ensure all "provided" parking on the site plan is within the bounds of the subject parcel.
FINAL: Comment not fully addressed. See Zoninq comment #1.
o Standalone parking, as currently shown in the adioininq parcel, requires an SP.
Either remove all parking in the adjoining parcel or submit an application for an SP to
have stand along parking.
o If the required amount of parking is not to be provided submit the appropriate
request and justification for the parking reduction.
o If parking is to remain on adjoining parcel address issue specified above about the
wording of Article VI of the declaration previously recorded.
o If a Boundary Line Adjustment (BLA) will be done in order to address this offsite
parking and declaration issues show this in the site plan. If this is to be done a BLA
Plat will be required under a separate submission and with appropriate fees.
[32.5.2(b), 32.5.2(e), 32.5.2(p), 32.6.20) & 32.7.9] Provide a full landscape plan that provides all required
landscaping, calculations and meets the buffer & landscaping requirements for 32.7.9 and the ZMA Code of
Development. Also, address the following:
Provide the maximum amount of paved parking and other vehicular circulation area for use in the
landscaping calculations.

® Provide the calculation and the "landscaping required" to meet the minimums for the 5% of the
paved parking and vehicular area, the number of plantings based on number of parking spaces,
and the parking lot landscaping specifically outlined in the C.O.D. and zoning ordinance.

• On the landscape plan identify the existing trees that will be utilized to meet any requirements of
this site plan. Provide a landscape table for existing trees so that they can be reviewed for
meeting requirements of the Code, ZMA and/or C.O.D.

o It appears that the existing trees are included in the calculation for provided canopy
count. If they are utilized in the landscaping calculation then a landscape table for
existing trees must be provided.
o Provide leaders between the existina trees and their labels. This should be applied

Provide a conservation checklist, conservation details, and tree protection fencing to ensure that
the existing trees that are to remain are preserved.

Accurately show all required landscaping in the Landscape Plan and Landscape Schedule(s),
revise any errors in planting counts and remove any items in the landscape schedule that no
longer are being proposed.

instead of a Cercis Canadensis.
Revise the required and provided landscaping calculations to accurately represent all requirements
of the zoning ordinance, the ZMA and the C.O.D.

o There should be a tree spacing is to be 30-35' according to the "Streetscape"
specification on page 15 of the C.O.D. Revise the landscaping to address this along
the access road to the west side of the parking lot where there is sufficient room
without conflicts.
o There should be perimeter evergreen shrubs and mid -sized trees surrounding
parking lots according to the "Parking" specification on page 20 of the C.O.D.
Revise the landscaping to address these items on the west side and in the northern
parking islands.
o In parking lots trees should be inter -spaced with mid -sized and ornamental trees
according to the "Parking" specification on page 20 of the C.O.D. Revise the
landscaping to address these items on the west side.
o The number parking area trees is specified twice in the calculations and the number
is different in the two locations. Revise the calculation to only include it once and
ensure the count is correct.
o Move the medium shade tree that is located in the north east corner of the hotel,
and near the crosswalk, closer to the sidewalk so that it can be considered a street
tree.
o Remove from the landscape plan the note under the calculations about the overlap
in landscaping between the parking area and roads.
9. [32.5.2(d)] If any managed or preserved slopes exist on the site shown them in the site plan. It appears
that there are some "managed slopes" on the site, as specified on the cover sheet. However, it does not
appear that any are shown in the site plan.
FINAL: Comment not fully addressed. Address the following:
• From the County's GIS it appears that there are two areas of managed slopes within the
subject parcel that are not shown on the site plan. Ensure that all areas of steep slopes are
shown in the site plan. Also, ensure all proposed improvements that impact steep slopes
meet the requirements for impacting steep slopes.
• Provide a different hatch for steep slopes then for other items. It appears that the same
hatch as for riprap is being utilized for the managed steep slopes.
10. 132.5.2(i), (n), 32.6.2(f), & (k)] Address the following:
• Dimension the centerline radii and corner radii of the proposed roads and drive aisles.
FINAL: Comment not fully addressed. Address the following:
o Dimension the centerline radii for the curved access ways near the entrance to the hotel
and all of the corner radii of the landscaping islands.
o Revise the corner of the island in the southwest parking area that does not have a radii
to have sufficient radii for access to the parking space. Removing the parking space
may be necessary.
• Provide all road route number and specify if the roads are private or public.
FINAL: Comment not fully addressed. Include in the label for Timberwood Blvd. whether it is
private or public.
• Provide trash containers dimension including the required distance beyond the dumpster. Ensure that
the dumpster pad meets or exceeds the minimum requirements.
FINAL: Comment not fully addressed. Because the dumpster is angled the dumpster pad does
not extend 8' beyond the enclosure as specified in 4.12.19 (b). Revise the layout such that the
dumpster pad meets this minimum requirement.

• Show the location of any outdoor lighting on all plan sheets and provide information on lighting under
the entrance canopy.

edit to be appropriate for this site plan or remove the note.
o Show the outdoor lighting fixtures on the Utility Plan sheet. Ensure that the location of
lighting fixtures within existing and proposed easements will be allowed.
• Show the location of any service and loading areas.

of the reduction in pavement width around the entry canopy.

There is a "30' Access Easement" and variable width "Cross -Access Easement" shown on the plats.

and DB2916 PG 22, on the site plan or provide documentation specifying that they have been
removed. There is a 1130' Access Easement" and variable width "Cross -Access Easement"
shown on the plats. Also, the 70' Cross -Access Easement could conflict with the building
location and must be addressed.
11. [32.5.2(k)] Provide the direction of flow on all pipes with arrows.
FINAL: Comment not fully addressed. The stormwater pipe on the west side of the building appears
to be draining away, instead of towards, the stormwater pond.
12. [32.5.2(1)] Provide the location of any existing or proposed utilities and utility easements including
telephone, cable, electric and gas. Ensure that all easements, including gas, are shown on all of the plan
sheets including the landscaping plan. The gas easement location in the Bojangle's parking lot could be
beneficial in the relocation of the other utility easements.

Ian including telephone, cable, electric and gas.
13. [32.5.2(n)] Address the following
• Provide the required handicapped parking signage.
FINAL: Comment not fully addressed. Address the following:
o Add a label for the handicapped parking signs on the west side of the building.
o Increase the visibility/size of the handicapped parking sign symbol. They are hard to
see.
• Provide a clear, and safe, delineation for the pedestrian connection that crosses the parking lot and
connects the west parking lot to the walkways along the edge of the pond. Extend the sidewalk on
the northwest corner of the building to the road and provide a second crosswalk that connects to the
sidewalk around the pond.

tree wells or walls, and trenching or tunneling proposed beyond the limits of clearing.

Virginia Erosion and Sediment Control Handbook, pages III-393 through III-413, and as hereafter
amended.

17. [Comment] Revise the cover sheet to include the project number SDP201700070.
18. [Comment] It appears that a note that was on the coversheet for the initial site plan has been removed in
reference to the public water and sewer facilities being dedicated to ACSA. Provide information on why this
note was removed or replace it.
19. [Comment] Revise the layout to show sidewalk extending all of the way to the entrance of the building.
There appears to be a gap.
20. [Comment] Revise the linework and hatching within the site plan such that the hatching for the parking lot
does not obscure the labels and linework of existing items including, but not limited to, utilities and
easements.
21. [Comment] Revise the label and leader for "New FHA" in the southeast corner of the site such that it is
pointing at the object called out in the label.
22. [Comment] If the improvements, for parking, drive aisle, landscaping, dumpster, and utility improvements
continue to be split across two parcels ensure that Tax Map Parcel number and Owners name of the 2"d
parcel is appropriately included in the site plan.

25. [Comment] The trees specified in note #7 on the Landscape Plan sheet (C7) are extremely hard to count
and interpret in the Landscape Plan. Ensure that there is a symbol accurately placed for all trees and that
the label for each of the trees has a leader arrow pointing at the correct symbol.
26. [Comment] It appears that one of the door to the building on the west side may be located partially on a
handicapped ramp. Revise the layout such that there is no conflict between the door exit and the ramp.
27. [Comment] Ensure that the permanent drainage easement (DB 2789 PG 125) will allow the entrance
canopy. If not submit all required proposed easements and/or deeds for review. Provide documentation
that support the entrance canopy over the easement if the easement will not be modified.
28. [Comment] Revise site plan to contain bumper blocks where parking is adjacent to sidewalks of less than
6' in width.
Staff has provided references to provisions of Chapter 18 of the Code of the County of Albemarle. The Code is
kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which
may be found under "Departments" at Albemarle.org.
In accord with the provisions of Section 32.4.3.5 of Chapter 18 of the Code if the developer fails to submit a
revised final site plan to address all of the requirements within six (6) months after the date of this letter the
application shall be deemet to have been voluntarily withdrawn by the developer.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Shimp Engineering, dated 17
January 2017, and offers the following comments:
1. Provide geometry for the entrance on to Timberwood Blvd.
2. Provide a one-way sign in the median on Timberwood Blvd. entrance.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process. If further information is
