(TNT) is pleased to present this Threatened&Endangered Species Review for the above-referenced project in general accordance with TNT Proposal Number 888 dated May 23,2016.The potential for threatened and endangered species on and in the vicinity of the project site was evaluated using available information and project reviews through the Virginia Department of Conservation and Recreation (DCR), the Virginia Department of Game and Inland Fisheries (DGIF), and the US. Fish and Wildlife Service(USFWS)Information, Planning,and Conservation System (IPaC). As requested,TNT contacted the Virginia Department of Conservation&Recreation(DCR)to evaluate the project site's potential for protected species and Natural Heritage areas. Based on DCR's review the green floater (Lasmigona subviridis), a State-listed threatened freshwater mussel, has been historically documented in the South Rivanna River, located approximately one mile south of the project site. According to DCR, the green floaters' preferred habitat includes pools and eddies with gravel and sand bottoms of smaller rivers and creeks, or small to medium sized streams. The DCR recommends the implementation of and strict adherence to applicable state and local erosion and sediment control/stormwater management laws and regulations, to minimize adverse impacts to the aquatic ecosystems as a result of the proposed activities.Additionally,due to the legal status of the green floater, DCR recommends coordination with Virginia's regulatory authority for the management and protection of this species,the VDGIF,to ensure compliance with the Virginia Endangered Species Act. Based on the DCR review, no State Natural Area Preserves under DCR's jurisdiction were located in the project vicinity. A search of DGIF's Fish and Wildlife Information Service online database was also conducted to identify the potential for threatened and endangered species within a standard two-mile radius of the project site. The results of these findings indicate that one(1)Federally-listed and State-listed endangered species,the James spinymussel (Pleurobema collina), is noted as being observed within Ivy Creek, located two miles southwest from the project area, as well as having potential habitat within the South Fork Rivanna River located approximately X mile south from the project area if suitable habitat is present;however there are no documented occurrences or "Collections" records of this species within the limits of the proposed 13996 Parkeast Circle,Suite 101,Chantilly,Virginia 20151 103--466-5123%TNTenvironmentalinc.com Not to Scale 4, A ,„, =I NN **(% 411116 =1 y, ,. Additionally, one (1) State-listed threatened species, the green floater, is noted as having potential habitat within the South Fork Rivanna River located approximately one mile south from the project area if suitable habitat is present;however there are no documented occurrences or"Collections" records of this species within the limits of the proposed project. Due to the fact that the James spinymussels' preferred habitat includes perennial, free-flowing streams, and that it has been observed within Ivy Creek, as well as the fact that there may be potential habitat for the green floater within the South Fork Rivanna River, it is in TNT's opinion that a species-specific survey for both mussels may be warranted. TNT recommends a habitat study, which can be done any time of year,be conducted in order to evaluate the portions of onsite streams to be impacted for potential habitat for each of the aforementioned species. A USFWS project review was conducted and submitted to the USFWS for their concurrence on TNT's findings. The USFWS project review indicates no critical habitat is located within the proposed project area. In addition to these findings, one (1) Federally-listed threatened species, the northern long-eared bat(Myotis septentrionalis)is listed as potentially being present within the geographic area of the project. Based on the final 4(d)rule((81 Federal Register 1900-1922),effective February 16,2016)for the northern long-eared bat, as well as a review of DGIF's northern long-eared bat Winter Habitat and Roost Trees GIS Application, incidental (unintentional) takes of the northern long-eared bat are not prohibited for the proposed land development associated with this project.Voluntary conservation measures are listed for conservation of the NLEB on the USFWS'website; however,they are not mandatory. Natural heritage resources are defined as the habitat of rare,threatened, or endangered plant and animal species,unique or exemplary natural communities,and significant geologic formations. According to the information currently in our files,the Green floater(Lasmigona subviridis,G3/S2/NL/LT)has been historically documented in the South Rivanna River. The Green floater,a rare freshwater mussel,ranges from New York to North Carolina in the Atlantic Slope drainages,as well as the New and Kanawha River systems in Virginia and West Virginia(NatureServe,2009). In Virginia,there are records from the New, Roanoke,Chowan,James,York,Rappahannock,and Potomac River drainages.Throughout its range,the Green floater appears to prefer the pools and eddies with gravel and sand bottoms of smaller rivers and creeks, smaller channels of large rivers(Ortman, 1919)or small to medium-sized streams(Riddick, 1973).Please note that this species has been listed as state threatened by the Virginia Department of Game and Inland Fisheries(VDGIF). Considered good indicators of the health of aquatic ecosystems,freshwater mussels are dependent on good water quality,good physical habitat conditions,and an environment that will support populations of host fish species (Williams et al., 1993).Because mussels are sedentary organisms,they are sensitive to water quality degradation related to increased sedimentation and pollution.They are also sensitive to habitat destruction through dam construction,channelization,and dredging,and the invasion of exotic mollusk species. To minimize adverse impacts to the aquatic ecosystem as a result of the proposed activities,DCR recommends the implementation of and strict adherence to applicable state and local erosion and sediment control/storm water management laws and regulations.Due to the legal status of the Green floater,DCR recommends coordination with Virginia's regulatory authority for the management and protection of this species,the VDGIF,to ensure compliance with the Virginia Endangered Species Act(VA ST §§ 29.1-563—570). Under a Memorandum of Agreement established between the Virginia Department of Agriculture and Consumer Services(VDACS)and the DCR,DCR represents VDACS in comments regarding potential impacts on state- listed threatened and endangered plant and insect species.The current activity will not affect any documented state-listed plants or insects.
