And thanks for sending a draft PDF plat. I've done a little more research, and I've looked at the draft PDF plat you shared; here is the guidance I can share: - The note that we discussed earlier needs to be revised, as follows: - Delete the part that reads "Albemarle County Code 14-46 Supp. #31, 7-14" - Fill in the information in [brackets] with information that is particular to this plat. For example: o "Parcel 28 has two (2) development rights per the plat recorded (date) in (deed book and page reference), and with this plat is assigned those two (2)development rights and may be further divided." (note: complete the "date" and "deed book and page reference" info in parentheses, above) o "Parcel 28A has five (5)development rights per the plat recorded (date) in (deed book and page reference) and per County Code Chapter 18, Section 18.10.3.1, and with this plat is assigned those five (5)development rights and may be further divided, and when further divided it shall not consist of more than thirty-one (31) acres." (note: complete the "date" and "deed book and page reference" info in parentheses, above) That informational guidance is based on the following County Code section (below, in blue). Thanks very much --- Tim 18.10.3 APPLICATION OF REGULATIONS FOR DEVELOPMENT BY RIGHT The following provisions shall apply to any parcel of record at 5:15 p.m.,the tenth day of December, 1980 (reference 6.5). (Amended 11-8-89) 18.10.3.1 CONVENTIONAL DEVELOPMENT(Amended 11-8-89; 6-14-00) Regulations in section 10.5 governing development by right shall apply to the division of a parcel into five (5) or fewer lots of less than twenty-one (21) acres in area and to the location of five (5)or fewer dwelling units on any parcel in existence at the time of adoption of this ordinance (reference section 1.3).The aggregate acreage devoted to such lots or development shall not exceed thirty- one (31) acres, except in such case where this aggregate acreage limitation is precluded by other provisions of this ordinance. The second sentence of this provision shall not be applicable to land divided between the effective date of this ordinance (reference section 1.3) and November 8, 1989. (Amended 11-8-89; 9-9-92; 6-14-00) 14.302.(A).10 RIGHT OF FURTHER DIVISION OF PROPOSED LOTS The number of lots, as assigned by the subdivider, into which each proposed lot may be further divided by right pursuant to section 18-10.3.1, if applicable.The plat shall also contain the following note: "Parcel [letter or number] is assigned [number] development rights and may/may not be further divided and when further divided these rights shall not comprise more than [number] acres.The residue of Tax Map/Parcel [numbers] is retaining ALBEMARLE COUNTY 1 4114010 CODE 14-46 Supp.#31, 7-14 [number] development rights and when further divided it shall not consist of more than [number] acres."
