Meridian Avenue, Suite 400 Oklahoma City, OK 73108 RE: LZC2017-036 — Fore Mallside Forest, L.P. — Mallside Forest Apartments 816 Mallside Forest Court, Charlottesville, Virginia 22901, Tax Map/Parcel 06100-00-00-124E5, Albemarle County Virginia (the "Property") Dear Kelly: In response to the your application for a Letter of Zoning Compliance filed with this office on November 2, 2017, please be advised as follows: -The Property is zoned R-15, Residential under the Zoning Ordinance of the County of Albemarle, Virginia, which currently permits the use of the Property for a multi -family residential complex, with appurtenant parking, at a density of up to 15 dwelling units per acre (see Section 18 in the County Code, linked below). The existing 160 dwelling units on the 11.583 acres is at a density of 13.8 dwelling units per acre. -The Property lies within the boundaries of the County of Albemarle, Virginia and is subject to the Albemarle County Zoning Ordinance. -As Chief of Zoning/Deputy Zoning Administrator, I am authorized and empowered to execute this letter on behalf of Albemarle County. -The Property meets all access and parking requirements required by the Albemarle County zoning ordinance and is in compliance with the current zoning ordinance of Albemarle County, including all provisions regulating setback, density and height. To the best of my knowledge, the Property is not in violation of any conditions or limitations imposed by the County of Albemarle. -The current development was originally built under a site plan which was later amended by SDP-1998-021, approved on February 23, 1998 and by SDP-1998-086, approved on July 10, 1998. -All necessary governmental permits and approvals for the construction, use operation and occupancy of the Property have been issued and are in full force and effect. -The property is legally subdivided and is in full compliance with all applicable subdivision codes, rules and regulations of Albemarle County and constitutes a separate tax parcel. -This office has no record of any open violation for the Property. Copies of any applicable records may be obtained from this office with a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(a-)_albemarle.ora once they have been approved or issued.
