Dear Ladies and Gentlemen: In response to your request for a Letter of Zoning Compliance for certain land use information for the above referenced Property, please be advised of the following: • The Property is currently zoned Residential (R-6) (See Chapter 18, Section 16 of the Albemarle County Code and the approval of ZMA2016-00005 (the "Rezoning")).The Property is subject to the Entrance Corridor ("EC") Overlay District, and the Steep Slopes Overlay as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). • The By Right Property is currently zoned Residential, R-6, and is not subject to any proffers. As described in Section 16.3, Area and Bulk Regulations, of the Zoning Ordinance, R-6 is approved for a density of six (6) residential dwelling units per acre. The density allowance for the By Right Property of 21.92 acres is a maximum of 131 dwelling units. • The Rezoned Property is zoned Residential, R-6, per the Rezoning, approved February 8, 2017, and is subject to proffers dated February 6, 2017. The approved proffers include an application plan permitting a maximum of 180 dwelling units on the 37.91 acre Rezoned Property. • The Property's maximum of 311 dwelling units must be reviewed for compliance with Subdivision, Zoning, and Water Protection. • The Owners intend to develop the Property per approved plans and permitted uses within the Property's Residential R-6 zoning. The development of a maximum 311 dwelling units is limited only by applicable use regulations, site plan regulations, and the aforementioned proffers and water protection ordinance regulations. No special use permit is needed to develop the 311 dwelling units.
