Robinson Street — Third Floor Norman, OK 73072 ATTN: Cody Carter RE: LZC2017-00020 TMP 07600-00-00-054A10 - Ash University Place LP also known as Cavalier Crossing, 100 WAHOO WAY CHARLOTTESVILLE VA 22903 (the "Property") Dear, Mr. Carter: In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following: • The Property is zoned Residential, R-15. Multifamily dwellings are permitted by -right in this district. No variances, special use permits, or zoning map amendments (rezonings) are required for this use and there are no pending applications of this type for the Property. The property is also in the EC, Entrance Corridor Overlay District The Property is subject to Site Development Plans, including SDP2001-00129 that was approved on 04/29/2002. The Property appears to have been developed substantially per the approved plan. In the event of casualty, the development would have the right to rebuild to the approved site plan or amend the plan appropriately. A site inspection revealed two inconsistencies with the approved plan: (1) there are five (5) additional parking spaces on the site at the northeast corner of the site that appear to have been incorporated into an adjacent line of parking spaces, and; (2) the volleyball court appears to have been shifted to a different location within the center of the development. At this time, no complaint regarding these inconsistencies has been received by this office. Therefore, the County will not be pursuing a violation of the site plan at this time. Changes to the plan should be approved as an amendment to the plan sometime in the future. • There are no records of any pending/open zoning violations having been filed with respect to the Property, nor are there any legal nonconformities associated with this Property. • The Property was issued several building permits and associated certificates of occupancy and appears to be in compliance with applicable building regulations • Copies of any applicable records may be obtained from this office with a request through the department's Records Manager, Paul Bjornsen, at pbiornsen(d)_albemarle.org.
