Dear Ms. Schmidt:
County and State staff have reviewed your initial submittal for the request to allow private school uses on
Tax Map Parcel (TMP) 06000-00-00-057FO and TMP 06000-00-00-057E0, in accordance with Section 18-
13.2.2.5 of the Albemarle County Zoning Ordinance. The subject parcels are located at 790 Faulconer Drive.
Comments from all reviewers are provided below. The major questions/issues that need to be addressed
before moving forward to the Planning Commission are:
• Do the internal changes to the existing residential structures on TMP 06000-00-00-057FO qualify
as a change of occupancy under the Virginia State Building Code? Staff from Albemarle County Fire
& Rescue and the Inspections Division have indicated that one structure may change from a single
family residential occupancy to a different occupancy classification. Under the Building Code, a
sprinkler system and other life safety features may need to be installed.
• Albemarle County Fire & Rescue has indicated that the existing gravel driveway may need to be
upgraded in order to provide adequate emergency vehicle access to TMP 06000-00-00-057F0. This
cannot be determined until the applicant submits an evaluation of the existing buildings to the
County for review.
• The Virginia Department of Health requires a Capacity Assessment Report prepared by a licensed
professional engineer prior to recommending approval of the special use permit. The existing
sewage disposal system may not be have the capacity to handle sewage from the number of
residents that will live in the structures on TMP 06000-00-00-057F0.
Planning
Initial comments on how your proposal generally relates to the Comprehensive Plan are provided below.
Comments on conformity with the Comprehensive Plan are provided to the Planning Commission and
Board of Supervisors as part of the staff report.
Comprehensive Plan
TMP 06000-00-00-057FO measures 3.59 acres and TMP 06000-00-00-057EO measures 2.58 acres.
Both properties are located within the R-1 Residential Zoning District. The primary land use
designation for both properties is Institutional in the Southern and Western Urban Neighborhoods
Master Plan, which calls for uses such as schools, libraries, utilities, hospitals, universities, colleges

and other developed and undeveloped publicly owned property. Portions of both properties have a
secondary land use designation of Rural Areas because they lie outside of the development area.
Rural area land uses include preserve and protect agricultural, forestal, open space, and natural,
historic and scenic resources; residential (0.5 unit/ acre in development lots).
Neighborhood Model
Projects located within the Development Areas are typically reviewed for consistency with each of the
Neighborhood Model Principles found in the Comprehensive Plan (see Objective 2 in the
Development Areas chapter).
Pedestrian Orientation
This principle is met because the Vicinity Plan shows an unpaved pedestrian walkway being provided
across TMP 06000-00-00-057EO that will connect to existing sidewalks located on the St. Anne's
Belfield Learning Village campus to the south.
Mixture of Uses
The private school use will provide a mixture of uses in this area because adjacent properties are
primarily occupied by low density single family residential uses.
Neighborhood Centers
Not applicable to the request. The Master Plan does not call for any neighborhood centers in the
vicinity of the subject properties.
Mixture of Housing Types and Affordability
Not applicable to the request due to the Institutional designation called for by the Master Plan.
Interconnected Streets and Transportation Networks
The Vicinity Plan identifies an existing 12.5' wide roadway that runs along the western property
boundaries of both subject parcels. Based on comments from the Fire & Rescue Department below,
upgrades may be needed in order for emergency vehicles to service the structures once they are
converted. The existing gravel driveway does not appear to meet the standards required by Fire &
Rescue if the buildings on TMP 06000-00-00-057FO will change occupancy classifications under the
State Building Code.
Multimodal Transportation Opportunities
This principle is met by providing the proposed pedestrian walkway.
Parks, Recreational Amenities, and Open Space
This principle is currently met because the majority of both subject properties will remain undisturbed
as outdoor classroom and open space for the school.
Buildings and Spaces of Human Scale
This principle is met because no enlargement of the building footprints or increases to the height of
existing structures are proposed on either property. All changes to the buildings will be made on the
interior. See additional comments from Heather McMahon below.
Relegated Parking
This principle is met with because no new parking is proposed. The existing parking on TMP 06000-
00-00-057FO is located behind the buildings and is not visible from the Route 29 Entrance Corridor
Overlay District. Please see additional comments from Heather McMahon below.
Redevelopment
This principle is met because the existing structures on TMP 06000-00-00-057FO are currently
unoccupied and the proposed residential facilities will serve as accessory uses for the adjacent
educational campus of St. Anne's Belfield.
Respecting Terrain and Careful Grading and Re -Grading of Terrain
The project narrative and Vicinity Plan indicate that no grading or removal of existing natural features
is proposed on either subject parcel. However, there are areas of Managed Steep Slopes on both
parcels. If additional grading is needed in order to install an upgraded driveway that meets emergency
access standards required by Albemarle County Fire & Rescue, these features may be disturbed.
The Virginia Health Department requires additional information to complete their evaluation of the
septic systems on TMP 06000-00-00-057F0. The applicant should work with VDH, as well as the
Inspections Division and Albemarle County Fire & Rescue staff to evaluate whether the existing wells
and septic systems can handle the increase in usage.
Both subject parcels are in the Albemarle County Service Authority's service area for public water and
sewer utilities. If the well and septic system cannot be upgraded according to VDH standards, public
water and sewer lines will need to extended from Faulconer Drive to the subject parcels.
In closing, areas of Managed Steep Slopes may be impacted by the extension of utilities and/or
driveway upgrades. This must be further evaluated by staff once the applicant completes the
assessments of the septic system and structures requested by the other reviewers. As stated in the
attached Zoning Division comments, a conservation plan is recommended if land disturbance is
required in areas of managed Steep Slopes.
Clear Boundaries with the Rural Area
The current proposal meets this principle. However, if land disturbance will occur within the Rural
Area portions of either subject property, this may conflict with this principle.
Community Meeting
The meeting held on January 22, 2018 at Greer Elementary School during the Places29-Hydraulic
Community Advisory Committee satisfied the requirements for a community meeting as described in
Section 33.4 of the Zoning Ordinance.
The Planning Division also comments on the conceptual plan and other requirements of County Code.
These comments are provided below.
General Comments
• As indicated by Albemarle County Fire & Rescue, the applicant should provide an assessment of
the existing structures prepared by a certified design professional in order to determine if the
building changes qualify as a change of occupancy under the State Building Code.
• As indicated by VDH, a Capacity Assessment Report for the septic system should be completed
and submitted prior to requesting a public hearing with the Planning Commission.
• Prior to requesting a public hearing with the Planning Commission, the applicant needs to address
the comments from Albemarle County Fire & Rescue and the Inspections Division. Staff needs to

ascertain what level of land disturbance will be needed in order for the structures to be converted
and used for the proposed residential facilities associated with the private school use. As indicated
elsewhere in this letter, additional grading may be required in order to upgrade the existing well
and/or septic system, or to install public water and sewer lines to the subject parcels. If the area
of land disturbance exceeds 10,000 sq. ft. for either option, a Water Protection Ordinance (WPO)
application will need to be approved by the County prior to the issuance of a Certificate of
Occupancy for the structures. Review and approval of WPO applications is handled by the
Engineering Division. Please contact Frank Pohl, County Engineer, for questions related to this
requirement.
• Portions of TMP 06000-00-00-057FO and TMP 06000-00-00-057EO are located inside of the
Comprehensive Plan development area boundary. The existing septic system and well appear to
be within the development area boundary on the parcels. Section 18-4.1 of the County Zoning
Ordinance requires lots in the development areas to connect to public water and sewer utilities if
they are within the ACSA service areas. In order to utilize the existing septic system and/or well
instead of public water/sewer, the applicant must complete the attached Public Water and Sewer
Connection Evaluation form prior to receiving a certificate of occupancy for the structures. This
form can be completed during review of the Special Use Permit, or during review of the building
permits.
Please be advised that following approval of the Special Use Permit by the Board of Supervisors,
a boundary line adjustment application will need to be submitted, reviewed, approved, and
recorded to combine TMP 06000-00-00-057FO and TMP 06000-00-00-057EO with parcel 06000-
00-00-05700. In order for the existing structures to be used as accessory uses associated with St.
Anne's Belfield Learning Village (primary use) they must be on the same parcel. See Zoning
Division comments below for additional information.
The existing special use permit for St. Anne's Belfield (SP200700053) has ten (10) conditions that
may need to be modified. The existing conditions of SP200700053 will apply to the subject parcels
once they are combined with TMP 06000-00-00-05700. Planning and Zoning staff will further
review which conditions may need to be modified when this application is re -submitted. The
Zoning Division has proposed three (3) new conditions that will apply to the approval of
SP201700029, please see the attached letter.
Planning - Architectectural Review Board (ARB) and Historic Preservation — Heather McMahon, 434-296-
5832, ext. 3278, hmcmahon@albemarle.org — No Objection:
No objection for ARB. The proposed renovations are largely interior and will not be visible from
the EC.
No objection for historic preservation. A site visit was conducted on 10-30-17; the structure in
question has little to no historic integrity after decades of additions and renovations.
Fire/Rescue — Shawn Maddox, smaddox@albemarle.org - Requested Changes:
1. Fire Rescue has questions about the site that cannot be answered until a design professional has
provided a classification of the buildings, as previously discussed with St. Anne's staff members.
While it appears that one building will remain a single family dwelling it would appear the use of
the second structure is no longer consistent with that type of occupancy. Should the use of the
building change and require fire sprinklers, fire alarm, etc. then the review of this project changes
as it no longer an existing condition. Should those life safety systems be required then fire rescue
does not feel there is adequate emergency vehicle access or water supply for the site to be served
appropriately.
Zoning — Leah Brumfield, 434-296-5832, ext. 3023, Ibrumfield@albemarle.org - Requested Changes, see

Inspections — Michael Dellinger, 434-972-4179, ext. 3228, mdellinger@albemarle.org - Requested
Changes:
1. Based on Fire & Rescue comments, a change of occupancy for either of the existing structures
may require installation of a sprinkler system to meet Building Code requirements. A Certificate
of Occupancy (CO) cannot be issued if the building requires a sprinkler system and adequate water
supply for the sprinklers are unavailable.

1. Engineering has no objection to the Special Use Permit as currently proposed. However, if the
scope of the project changes due to the need for upgraded access drives or utility extensions,
approval of a WPO plan may be required following approval of the SP. This question cannot be
answered until the applicant provides Albemarle County Fire & Rescue, Inspections, and VDH with
additional information on the existing septic system, as well as the occupancy type of the buildings.
Virginia Department of Health — Joshua Kirtley, joshua.kirtley@vdh.virginia.gov — Requested Changes:
I have reviewed the subject Special Use Permit and I am unable to comment as to the suitability
of the existing sewage disposal system. In the project narrative, the applicant states that a written
report regarding the existing septic systems would be forthcoming from a licensed Professional
Engineer. To date, I have not seen or reviewed the report mentioned. Please note that I
requested a Capacity Assessment Report during a meeting with the applicant at the Health
Department on 29 November 2017.Once a copy of the report is submitted, I will provide
additional comments.

The following comments are provided as input from the Zoning Division regarding the above
noted application(s).
1. A reasonable consideration of the Board in considering the Special Use Permit
will include, as described in Section 33.6(b):
(i) the existing use and character of property,- (ii) the comprehensive plan; (iii) the
suitability of property for various uses;
a. The existing residential use of the property is closely related to a small residential
institutional use.
b. Additionally, the property is surrounded by institutional and residential uses, and
the proposed school use would appropriately fit with the existing character of the
surrounding properties.
c. All properties in question are currently zoned R-1, for low density residential use.
The parcel currently subject to the Special Use Permit has a comprehensive plan
designation of Neighborhood Density Residential, indicating a density at or below
3-6 units per acre. This designation also indicates uses that support the
neighborhood, including institutional uses. The properties requested to be added
to the Special Use Permit, TMP 60-57F and TMP 60-57E, have a comprehensive
plan designation for Institutional uses like schools, likely due to the properties'
proximity to UVA-owned parcels.
2. Site disturbance as proposed in the application will be under 10,000 sf, so no site plan
approval will be necessary.
Zoning Review Comments for SP201700029
3. Approval of the Special Use Permit will be contingent on Virginia Department of Health's
approval of the septic systems on the property for the proposed use, and on the
Albemarle County Fire & Rescue's approval.
4. A conservation plan highlighting the paths and describing the erosion controls for paths
and outdoor recreation areas is recommended.
5. Conditions (SPs)
a. The three parcels must be combined as a condition of Special Use Permit
approval.
b. Residential occupancy will be limited to 8 students and the dorm faculty and their
families.
c. The residential site shall be developed in substantial accord with the concept
plan entitled Proposed Parcel Details, dated December 14, 2017, except that
changes may be made provided the Zoning Administrator finds that all other
special use conditions are met.

Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set

(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page. Be
sure to include the resubmittal form on the too of vour materials.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request an
indefinite deferral. Please provide a written request and state your justification for requesting the
deferral. (Indefinite deferral means that you intend to resubmit/request a public hearing be set
with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time, you may schedule a public hearing with the Planning Commission. However, we do
not advise that you go directly to public hearing if staff has identified issues in need of resolution
that can be addressed with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with the
Planning Commission's published schedule and as mutually agreed by you and the County. The
staff report and recommendation will be based on the latest information provided by you with
your initial submittal or resubmittal. Please remember that all resubmittals must be made on or
before a resubmittal date.
By no later than twenty-one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached
Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an
additional newspaper advertisement is also required twenty-two (22) days prior to the Board of
Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for
Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The only
exception to this rule will be extraordinary circumstances, such as a major change in the project
proposal by the applicant or more issues identified by staff that have not previously been brought
to the applicant's attention. As always, an applicant may request deferral at the Planning
Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule your
application for a public hearing based on the information provided with your original submittal or
the latest submittal staff received on a resubmittal date.
