Staff has reviewed your initial submittal for SP201700031 to add pool tables to a restaurant at 340
Greenbrier Drive.

Consistency -with the Comprehensive Plan
Comments on conformity with the Comprehensive Plan will be provided to the Planning Commission
and Board of Supervisors as part of the staff report when this proposal goes to public hearing or a
worksession.
Land Use:
This project is designated for Office/R&D/Flex/Ught Industrial, which allows professional office;
research and development, design, testing of prototypes; manufacturing, assembly, and packaging;
commercial and residential are secondary uses (no maximum density) in the PL29 Master Plan. It
was determined at your preapplication meeting that this use could be considered a secondary use.

• Parking — Based on the recreation parking calculation of 1 space/125 square feet of usable rec area,
there is adequate parking for regular operation of The Rack on this site. However, given that The
Rack is expected to host touraments, I need more information on the expected number of
attendees to determine parking and recommend parking strategies for tournament days. The
applicants mentioned in the community meeting that shared parking with the abutting property
under common ownership (TMP 061W0-01-0A4WA0) would provide tournament day overflow
parking needs. Zoning will still need to have information on expected # of attendees for
tournaments at The Rack as well as review businesses and required parking on TMP 061W0-01-OA-
009A0 to determine if a shared parking agreement can be approved under Section 4.12.10 and
4.12.08 of the ordinance.
• Noise -Since the applicants do not propose music other than a jukebox, staff does not have
concerns about noise.

professional, as the proposed use appears to be a change of use of the CO to an Assembly use.

Additional Planning Comments
The NMD zoning designation anticipated a mixture of uses in this building. This proposed restaurant
with pool tables appears to be consistent and compatible with the nearby uses. Staff recommends that
you resubmit information requested by Zoning, according to the resubmittal schedule. After review,
staff will develop potential conditions for the special use permit for consideration by the Planning
Commission at their public hearing if they recommend approval to the Board of Supervisors.
Action after Receipt of Comments
After you have read this letter, please take one of the actions identified on "Action after Receipt of
Comment Letter" which is attached. Staff recommends that you provide a resubmittal prior to asking for
your Planning Commission public hearing.
Resubmittal
If you choose to resubmit, please use the attached form. There is no fee for the first resubmittal. See
resubmittal schedule is for resubmittal dates.
Notification and Advertisement Fees
When this project is ready to be scheduled for the Planning Commission's public hearing, a fee of $474
must be paid to cover costs for legal advertisements. The Board of Supervisors public hearing fee of
$259 can be paid with the Planning Commission's public hearing fee or lager. If you wish to provide a
single payment, the total is $733.

To Whom it May Concern:
This letter is to address questions pertaining to The Rack's Special Use Application #SP201700031, asking to operate 8
additional pool tables in an established business that already owns and operates with 3 allowed by right. Attached will be
diagrams of floor plans and parking schematics to show clearly our objectives.
To clarify the first topic, Ms. Ragsdale's questions about the attendance of our weekly pool tournaments. Please let me
offer some details:
The request for 8 more pool tables would allow us to hold tournaments with a maximum attendance of 40 players
The Rack will cap registrations at 40 players because it is not our goal to have tournaments that last over 5 hours
• Our tournaments will be on Saturdays and Sundays from 2 to 7 pm (photos of the empty parking lot taken Feb. 3, 2018)
• Our guests and their friends will not exceed our occupancy projections of 99, limited by our ABC application
• 340 Greenbrier Drive has 83 parking spaces onsite. Additional parking on an adjacent property is NOT necessary
• Please see the property's parking schematic and floor plan. Our space is accessed by the entry door to the right of the
roll -up overhead door at the center of the building and the floor plan shows the layout of tables and seating for players
As for the building inspector's concerns about the change of use for the address 340 Greenbrier Drive:
• A plumbing permit has been approved for the upfit and a greasetrap Is in the plan adequate for our menu
• Overhead sprinklers are in place throughout our 6200 square feet of space
• There are no other building changes needed other than to build non load bearing walls to separate our F space from the current
common area use inside the building
On February 1, Captain Aylor from ACPD visited our location and offered these suggestions:
• The Rack sets the tone early and proactively to discourage bad behavior of patrons
• The Rack obtains permission from the landlord to eject people from the property's parking lot (which we have in our lease)
• The Rack agrees to participate in the Trespass Barment Program to control unwanted people from returning to the property
• The Rack will place signs at the entrance of the business forbidding firearms
• The Rack will call 911 to report suspicious activity in the parking lot
• The Rack will hire security personnel for peak hours of operation
• The Rack will be actively monitoring the premises with adequate parking lot lighting and security cameras in over 16 locations
• The Rack will continue its partnership with the ACPD to resolve any future issues and problems
• The Rack will have an aggressive no tolerance policy for drug use, illicit behavior, off premises alcohol, gang affiliations i.e.
flying colors and disorderly conduct
The owners of The Rack hope that these comments will assure the Department of Community Development that we want to
conduct our business in harmony with our property neighbors, the police department and the community.

Security and Safety Conceras
Identifying the Isms As pool playas and partam in this business venture, we Umlerstand that most of
the public have an inaccurate view of the games of pool and modern day "pool halls". We know this is
true in Charlottesville because of the unusual restrictions placed on this business model by the
requirement of obtaining a Special Use Permit. The City and County authorities require an SUP if a
business wants to operate with more than 1 or 3 pool tables. A common misconception is if a "bar" has 2
pool tables and disagreements arise then a location that has I I pool tables will have S times the problems.
This could not be further from the truth. Brittney Sheldon, bar manager of Diamond Billiards in
Chesterfield County Virginia, has confirmed that, "When pool tables are charged by the hour and there
are many to choose from, most problems associated with groups competing for time to play are
alleviated". If an establishment has too few pool tables and too many pool shooters, that is when trouble
arises. It is ironic but the restrictions on the number ofpool tables in a business actually creates this
problem. That is another reason why Ile Rack wants to have 11. Another concern is gambling. The
Commonwealth of Virginia has determined that wagers on games of skill are not illegal and games of
pool have been determined to be a game of skill*_ The Rack will not encourage these activities but would
like the public to understand that it is not illegal. The Rack plans to host weekly tournaments rewarding
the players that participate with money collected from the entry fees. It is a well-known fact that players
play better when there is a reward for winning, our tournaments will be that vehicle..
