Planning Staff will be able to support your request based on the description of the proposal provided with the application entitled "Project Proposal for Floating Dock on TMP45-10A," including the attached location map and dock design/plan. Our analysis is based on the understanding from the project proposal that there will be no clearing, grading, or construction of structures (steps, etc.) associated with the access to the dock within the 200 foot stream buffer. Please be aware that there are standard conditions that are typically recommended and approved for docks on the reservoir. These conditions appear to the be consistent with your proposal and would not preclude the construction of the dock as proposed. These standard conditons are listed below: 1. There shall be no lighting within 25 horizontal feet of the Reservoir, measured from the elevation of normal pool. 2. There shall be no removal of vegetation or earth disturbance within the 200- foot stream buffer associated with the installation of the boat dock. The stream buffer is measured from the edge of the floodplain. 3. Structures and improvements located in the two hundred (200)-foot stream buffer shall be limited to those shown on the Woodard Dock Plan. There shall be no other structures, such as decking or stairs, constructed in the 200-foot stream buffer. Zoning Page 1 of 3 Revised 4-25-11 eke Zoning Division staff provided the following comments "[p]lease address proposed lighting [if any is proposed] (type and location). Lighting has been a significant issue in the past in terms of impacts from this type of use. Please refer to § 4. 17 for the lighting regulations in the Albemarle County Zoning Ordinance. This will need to be addressed as a condition of approval." As noted above, we typically prohibit the lighting of docks and the reservoir shoreline with a condition of approval. Since dock lighting was not identified in your project description, it is assumed you are not proposing to install lighting. If you do plan to install lighting, information regarding the lighting proposal would need to be provided for review by staff. Building Inspections The Building Official has noted the dock construction "work is outside the scope of the building code, therefore an engineered set of drawings is required for building permit." This is not an issue as regards the review of the Special Use Permit, but may require you to provide further information for the review of you apply for a building permit. ASCA/RWSA The RWSA has issued a Boat Dock Permit for this site/proposal (June 27, 2017). No ACSA review is needed for this request. Fire Rescue No objection Engineering and Water Resources No objection Entrance Corridor No objection VDOT N/A Action after Receipt of Comments Unless you have changes to your proposal, staff believes this proposal is ready for review by the Planning Commission and will move forward with tentatively scheduling that meeting for an available March date. Please note the outstanding notification fees (provided below) that are due to our office in order to officially schedule (and hold) the required Planning Commission and Board of Supervisors meetings. Please confirm with me that wish to move forward with a Planning Commission public hearing. Resubmittal If you choose to revise and resubmit your proposal, please use the attached form. There is no fee for the first resubmittal. The resubmittal date schedule is provided for your convenience. Notification and Advertisement Fees The zoning ordinance to require that applicants pay for the notification costs for public hearings. Prior to scheduling a public hearing with the Planning Commission, payment of the following fees is needed: Revised 4-25-11 eke Page 2 of 3 217 Cost for newspaper advertisement 215 Cost for notification of adjoining owners (minimum $200 + actual postage/$1 per owner after 50 adjoining owners) 432 Total amount due prior to Planning Commission public hearing Prior to the Board of Supervisor's public hearing, payment of the newspaper advertisement for the Board hearing needed. 217 Additional amount due prior to Board of Supervisors public hearing 649 Total amount for all notifications Fees maybe paid in advance. Payment for both the Planning Commission and Board of Supervisors public hearings may be paid at the same time. Additional notification fees will not be required unless a deferral takes place and adjoining owners need to be notified of a new date.
