In this specific circumstance,we do not need or request your signature, as we just took an action on it with your tentative
email approval.This is not the norm and typically never happens; however,this was an extenuating circumstance with a
compressed time frame. Typically,once we receive tentative approvals we allow all signers 10 days time to come into the
office and sign the plans. Regardless,thanks for moving so fast on this so we could take an action within the compressed
time frame.

I just got off the phone with Richard (ACSA); they do not have any changes required to the final site plan prior
to approval. They are currently working on internal signatures for their internal action but they have no changes
required to the final site plan. We now have all tentative approvals from all agencies.
Thus,under the circumstances I believe we should pull the trigger and take an action of approval on this final
site plan. Based on the time constraints I presume you will take action on the site plan in place of all SRC
reviewers' signatures. Downstairs in the cubbyhole are 3 copies of the plans. Typically, we require 4 copies for
action;however,this is all the clean copies that remain from the last review. But 3 is enough: (1) for the file, (1)
for the applicant, and(1) for inspections who typically get 2 copies.

I just completed my review of the above ref project. I have no outstanding review comments.
Tentative Approvals Received
*E911 just approved the revisions.
*The Building Official previously approved it.
*Fire and Rescue's Shawn Maddox previously approved it.
*Planning—I have no outstanding comments.
Prior to site plan approval we need 3 remaining SRC reviewers to provide reviews/tentative approvals: VDOT,
ACSA, and Engineering.
✓1 ;DOT—Willis is reviewing it as this email goes out. Pending a review/tentative approval.
2 ACSA's initial comments I never received; rather,they ACSA sent them directly to the applicant. I spoke to
ichard Nelson(the new"Alex" for ACSA)and he understands the time line and hopes to get something to us
by Friday at the latest.
engineering,Matthew Wentland just approved the VSMP, so I doubt the final site plan has anything
remaining but I am awaiting him comments as well.
I will not be in the office on Friday(2-9-18), to assure that this plan has the possibility of being approved by
you I am placing 2 hard copies of the plan downstairs in the cubbyhole for you to make the final call.
Feb 12th(Monday) is the day this project turns into a pumpkin and it needs to be signed/approved otherwise it
loses funding and dies.IF and once you sign/approve the plan, you need to let Ron White (County's Chief of
Housing), William Park(owner/developer), Brasil Hamrick(Engineer)know of its approval.
I am also CCing the various reviewers to this email so they know to CC or send you the comments/tentative
approvals for you to take appropriate action. I requested all reviewers provide comments/tentative approvals to
you by Friday 2-9-18.

The applicant had submitted PDF copies of the site plan on 2-1-18, today the full sized hard copies were
submitted, two copies of this plan are in your mailbox here at the County along with the transmittal sheet.
This priority project needs County approval no later than Feb 13th or they lose large amounts of funding. As
such I am requesting all comments no later than 2-10-18 from all remaining SRC reviewers.
Please review to assure VDOT's minor comments have been addressed and provide an approval or your review
comments via email.

Gentlemen:
I respectfully request permission to construct a fence that will encroach within the
existing ACSA easement. The proposed fence will be 6 foot wooden fence between the
parking lot and the existing Villas at Southern Ridge. The fence would cross the ACSA
easement in two places. The fence location is shown on the site plan submitted to the
County of Albemarle planning department [SDP201700069].
This work is planned Brookdale, Tax Map 07600-00-00-046C1. In exchange for
this permission, I relieve the Albemarle County Service Authority from any responsibility
for repairing or replacing this fence should it be damaged by the Authority's forces
during maintenance of the public utility.

Attached is a landscape plan showing the proposed fence. I believe this is what Chris needs.The fence shown in red
crosses the ACSA sanitary sewer easement in two places. Once near existing manhole number CNTRYGRN-1-5 and once
near CNTRYGRN-1-3. In both locations a double swing gate, with 6-foot leafs, providing a 12-foot pass thru space has
been shown. In all other locations the proposed fence does not encroach into the easement shown in yellow. The field
located sanitary sewer is green. Please advise.

Tried to reach you by phone maybe this will help clarify our inquiry. Please see the attached landscape plan excerpt from
the Brookdale plan set.To satisfy County screening ordinance we have to provide a 6' high wooden fence between the
parking lot and the existing Villas @ Southern Ridge development.The fence would cross the ACSA sewer easement in 2
different places.We would place gates at those locations and would understand if the fence had to be removed for
future upgrades, repairs or maintenance it would be done so at the owners expense. Please advise if that is acceptable.

Attached is a landscape plan showing the proposed fence. I believe this is what Chris needs.The fence shown in red
crosses the ACSA sanitary sewer easement in two places. Once near existing manhole number CNTRYGRN-1-5 and once
near CNTRYGRN-1-3. In both locations a double swing gate, with 6-foot leafs, providing a 12-foot pass thru space has
been shown. In all other locations the proposed fence does not encroach into the easement shown in yellow. The field
located sanitary sewer is green. Please advise.

Tried to reach you by phone maybe this will help clarify our inquiry. Please see the attached landscape plan excerpt from
the Brookdale plan set.To satisfy County screening ordinance we have to provide a 6' high wooden fence between the
parking lot and the existing Villas @ Southern Ridge development.The fence would cross the ACSA sewer easement in 2
different places. We would place gates at those locations and would understand if the fence had to be removed for
future upgrades, repairs or maintenance it would be done so at the owners expense. Please advise if that is acceptable.

In addressing your recreation comments please look at the attachment.The note portion now appears on the front
cover with all the other project information.The passive recreation area behind the buildings, if acceptable,will be
hatched on the landscape plan.There is a very flat area 15-foot wide behind buildings 100, 200, and 300 that could be
used to flip a frisbee or outdoor yoga or meditation or whatever floats your boat. Does this work? If so I will revise the
recreation substitution letter and place it on the plans.
Not sure what I was thinking with the 3-acres listed in the letter.That is the total green space of the property after
development.

RE: Recreational Amenity Substitutions for Brookdale
Dear Mr. Perez:
The purpose of this letter is to request substitutions for the required recreational
facilities for the development entitled Brookdale. The reason for the request is safety
concerns with swing sets and springer animals. In addition the basketball court does not
match up with the majority of the targeted demographic of this development and can
become a nosie nuisance for those not using the facility.
Specifically, the developer would like to provide substitute facilities for the
requirement of two (2) tot lots and a half court basketball court. One tot lot and the half
court basketball court would be substituted by the fitness center, yoga/stretch area,
community room, and setting porch within the clubhouse along with the passive
recreational opportunities within the 3-acre green space of the development. The
equipment within the second tot lot would be substituted with the attached modular play
facility.

The height limit of the wall cannot be changed except by the issuance of a variance by the Board of Zoning
Appeals.
If the wall is part of the building it can exceed the 6 foot height limit. As soon as that wall leaves the building it
is no longer part of the building and is subject to the height limit. Attachment to the building does not make
the wall part of the building.

In regards to your site plan comment number 6 please look at the attached plan.The retaining walls are shown in green
and the managed steep slopes are shown in red.
The retaining wall around the parking lot at building 300 is just barely within the edge of the steep slope area. Of the
total length of the wall only 63-feet touches the steep slope area. I assume this County ordinance provision was born out
of the aesthetic concern of having a tall wall visible from a street. This wall will not be visible from a public street. Given
that only a portion is just within the steep slope area I propose planting a double staggered row of evergreen trees in
front of the 63-foot length. Please advise if you can make this work with your ordinance. Please advise.
In regards to the retaining wall in front of building 400 I hope we can classify this wall as an integral part of the building. I
know the wall does not touch the building but it was designed because of building and is as integral to the buildings
function as the water and sewer connection.The County really pushed for the addition of this building and the wall
cannot be seen from the street. For all practical purposes the only people that will see the wall are the residence of the
front units of the building.The wall at the northwest corner of the building is about 15-feet tall.This would require a
three wall system and would result in relocating the building. Please advise.

I double-checked with Bill Fritz, and the walls will have to follow the managed slope requirements.The visibility of the
wall isn't what determined the ordinance wall height, it was the stability of the slope. For the integral to the building
part, the wall would have to be part of the building (like it's exterior wall). It looks like the only way to change the wall
height would be to request a variance from the Board of Zoning Appeals (which I've been told would probably not be
granted and is not a quick process).
