We have a clearance under review for 2900 Merrie Meadows Lane for a church of less than 200 people. It is a site that
has a special use permit that was approved and a site plan. I wanted to make sure VDOT had confirmed the entrance is
adequate for the church use.

Our average attendance is 75-80, largest attendance on holiday (Easter) was between 90-95. I spoke with the
woman from VDOT before Christmas, she pulled it up on the map and said the sight distance was good and it
was already paved.

Here is the information we spoke about and I wanted to summarize in an email for you.
The County recently changed the name of the use "church" to Religious Assembly Use. The use is defined below. Due to
a recent interpretation of the Zoning Ordinance and Federal regulation, the County must permit by right any Religious
Assembly Use for up to 200 persons/seats without the need for a site plan or special use permit.
The use will be subject to zoning clearance application approval. We have yet revised our checklist for review of a
zoning clearance this use but the minimum items necessary for review are below.
The site you are looking at has a Special Use Permit (SP) for up to 350 people at any one time. What this means is that if
the Religious Assembly Use stays at 200 or less, then they can use the property by right with the approval of a zoning
clearance. If the Religious Assembly Use were to go over 200 people, then they would be subject to the SP and all of the
conditions noted in the attached approval letter.
Definition
Religious assembly use: A building or space primarily used for an assembly of persons to conduct worship or other
religious ceremonies, including, but not limited to, churches, synagogues, temples, mosques or shrines. (

In the rural areas identified in the comprehensive plan, the number of proposed spaces shall be shown in a parking study
submitted by the religious assembly use; the number of required spaces shall be determined by the zoning
administrator, who shall consider the recommendations in the parking study, traffic generation figures either known to
the industry or estimated by the Institute of Transportation Engineers, peak parking demands, and other relevant
information. Nothing herein requires the parking study to be prepared by a transportation engineer.

Location of the entrance to be used - The clearance will be sent to VDOT to confirm entrance standards are met with
your proposal. If VDOT proposes entrance improvements, you will be notified of their requirements and your zoning
clearance will not be approved until VDOT has given approval. I have not had a chance to confirm if VDOT already
reviewed/approved the entrance in association with the Merrie Meadows site plan (SDP 2001-17).
If you proposed any new buildings, a building permit will be needed. If you propose new parking/buildings that exceed
10,000 square feet of disturbance, an engineering plan may be needed.

RE: SP-2001-017 Merrie Meadows, Tax Map48, Parcel 15A
Dear Mr. Rutt:
The Albemarle County Board of Supervisors, at its meeting on May 15, 2002, unanimously approved the
above -noted request. Please note that this approval is subject to the following conditions:
1. The improvements shall be constructed on the parcel in substantial conformance with the plan
included in this report as Attachment E, titled Merrie Meadows Site Plan and dated 6-13-01;
2. A commercial entrance, subject to Virginia Department of Transportation standards, shall be
constructed prior to the first camping event or regional event under this permit. Adequate sight
distance will be required by either a dedication of a twenty-five (25)-foot right-of-way along the
property line abutting Route 20 or the provision of a sight easement for the entrance, subject to the
approval of the Virginia Department of Transportation;
3. All required Health Department approvals shall be obtained prior to the issuance of a building permit;
4. All structures and parking areas not in existence as of the date of the approval of this special use
permit shall maintain Commercial Zone setback standards [fifty (50) feet for rear and sides], as set
forth in Section 21.7.2 of the Albemarle Zoning Ordinance;
5. All outdoor activities and activities within any buildings on the subject site that produce noise that can
be heard from adjoining properties shall cease between 10:00 p.m. and 8:00 a.m.;
6. SP-81-18 and all uses authorized thereby are terminated;
7. Prior to issuance of Certificate of Occupancy, evergreen trees, such aS Virginia Cedar, shall be
installed between the access road and the adjacent parcel (TM 48 Parcel 74). The landscape
materials type, size and location of installation shall provide a natural barrier to prevent direct glare
onto the aforementioned adjacent residential property from headlights of vehicles traveling along the
access road and shall be subject to approval of the Planning Director or designee. The landscape
screening shall be maintained in such a manner that the screening shall be preserved;
8. The number of non -camping assemblies permitted on site exceeding one -hundred -seventy-five (175)
people shall be limited to no more than seven (7) days per calendar year. Assemblies shall not
include overnight stays by the attendees;
9. No more than three -hundred -fifty (350) people shall be permitted on the site at any time;
10. The camping operation shall be limited to the following:
• The maximum number of camping (overnight) assemblies shall be five (5) per calendar year,
• The maximum length of time of the camping assemblies shall be limited to three (3) consecutive
days and nights,
• No more than five (5) cabins (existing), five (5) primitive campsites, and four (4) recreational
vehicle sites shall be permitted. Primitive car be defined as a building c, site without kitchen or
bathroom facilities attached, and,
