Dear Property Owner:
Our firm is assisting the owners and developers of the 5th Street Station commercial development
to be located off of 5th Street and Bent Creek Road. As part of the project approval,Albemarle County
requires the owner of the development,511'Street Station Ventures,LLC,("Developer")to restore sections
of the Moore's Creek stream buffer to improve the health of Moore's Creek and downstream waters. This
improvement work would include removing invasive plant species,adding new native plantings to replace
invasive plants,and stabilizing the stream banks to prevent further erosion.The stream buffer is a 100'
wide area located along the north and south banks of the creek. Some areas of the stream buffer are
vegetated,while some are developed.
The attached exhibit shows the general improvement area along the north bank of Moore's Creek
and the properties on which the required work is proposed to occur. Proposed improvement work will
happen in naturally vegetated areas and in wooded areas. It will not extend into developed areas such as
those areas with pavement,curb and gutter and landscaped grounds. Certain portions of the creek will
also require stream bank stabilization to prevent further erosion. Sections of this stream bank
improvement area are within the boundaries of your property adjacent to the creek,
The first phase of stream bank improvement consists of invasive plant species control with the
goal to reduce invasive plant species that are harmful to native species and the stream bank ecosystem.
This work is proposed to take place within the next few months,and would involve removing invasive
plant species from the project area. This includes plants,but also trees and vines that are considered
invasive. The second phase of improving the stream buffer would include replanting the area with native
plants and applying herbicides to any remaining invasive plant species. The second phase is scheduled
for later in the summer and fall to complete the project.

work occurs on the edge of your property,I have included a form requesting permission to perform the
stream bank improvement work on the sections of your property as indicated on the attached exhibit. If
this work is agreeable to you,please sign and return the form to me at the address indicated on the form.

PROPERTY OWNER PERMISSION FORM
I hereby grant 5th Street Station Ventures, LLC, ("Developer") and their representatives
permission to perform stream bank improvement and stabilization work on my property. The
work is to be performed as described in the June 2015 letter("Letter")to my attention and
including the exhibit ("Exhibit") attached to the Letter outlining the project area,
The Developer agrees to indemnify, defend (with counsel reasonably satisfactory to the
Property Owner), protect, and hold Property Owner harmless from and against any and all
liability, loss, cost, damage, or expense (including,without limitation, reasonable attorney's fees
and costs)which Property Owner may sustain or incur by reason of or in connection with any
work performed by the Developer and their representatives or contractors relating to or in
connection with the stream bank mitigation and stabilization work as described in the Letter and
the Exhibit.
