Thank you for the checklist with sections added.
Before I send this on to the County Attorney's office the following thing need to be done, in order for them to have
what they need to review the documents.
1. Provide us either with the recorded version of the Declaration of Covenants, Conditions and Restrictions or
provide us with the deed book and page number for the recorded document.
2. Ensure that the recorded copy of the Declaration of Covenants, Conditions and Restrictions includes in the
description of the property, in exhibit A, the deed book and page number of the plat they are referring to.
3. Updated the Supplemental Declaration that the correct exhibit is attached. Currently the Subdivision plat is
attached instead of the easement plat. Ensure that all descriptions in the document correspond to the
Easement plat. If for some reason you think the subdivision plat is still the appropriate exhibit for this
supplemental agreement please call to discuss it. However, please keep in mind that the easement plat has to
be approved and recorded prior to the site plan and subdivision plat being approved.
4. Checklist item #5 — Article XIV Section 9 does not appear to provide a description of the condition of the
improvements when it was approved or the condition it must be in before the surety is released. Please find the
correct section and specify it.
5. Checklist item #6 — Article VI Section 2(e) does not appear to describe the timing or condition warranting
maintenance. Please find the correct section and specify it.
6. Checklist item #8 —Article VII Section 3 is quite extensive. Specify the specific sections that cover how the
maintenance cost will be prorated and how that is impacted if in the future any of the lots are further
divided. Please find the correct section and specify it.
7. Checklist item #9 — Article XIV Section 12 does not appear to exist. Please find the correct section and specify
it. Also, please note that Article V Section 3 appears to include the wording. However, there is additional
wording in that section that the County Attorney's office may or may not have an issue with.
Once you forward the required information to me then I will forward it to the County Attorney's office for
review. Sending it to them prior to these revisions would just ensure an extra round of review which I would like to
avoid if possible.
So address the items above and send me the following:
• The recorded version of the Declaration of Covenants, Conditions and Restrictions or the deed book and page
number for the recorded document. Ensure it includes the deed book and page for the exhibit specified or
provide the deed book and page separately.
• The updated Supplemental Declaration with the correct exhibit included and referenced.
• An updated checklist, revising the section information to address all of the issues above.
Attached for both of our reference is what you have sent me over the last week in different emails. These are the
documents I'm referring to.
