Andre,
1. It should be okay without a silt trap. I saw the other day that VDOT is currently installing that underground
system and it doesn't look like there would be room for the trap anyways. Inlet Protection is good for up to one
acre and you have two you can direct the runoff to.The Inspector will also work with the contractor to fix any
problems that come up in the field.
2. TRH can be the signing party since they will have a lease agreement.
3. The SWM report can be a separate doc.
4. Nothing additional is required. You just need to list the impaired water in the SWPPP and include the info in
9VAC25-880-70, Part II(A)(5):
(1) Permanent or temporary soil stabilization shall be applied to denuded areas within
seven days after final grade is reached on any portion of the site;
(2) Nutrients shall be applied in accordance with manufacturer's recommendations or an
approved nutrient management plan and shall not be applied during rainfall events; and
(3) A modified inspection schedule shall be implemented in accordance with Part I B 4
or Part IB 5.

I wanted to clarify a few points with you on our erosion control plan and SWPPP.
1.The way I am reading the std spec 3.05 for Silt fence we may not have the need to do a sediment trap. We have 290'
of silt fence and 0.6 disturbed acres tributary to it,that less that the 0.25 acres/100'silt fence recommended for the
practice. We also have 2 existing protected inlets that would further reduce the load on the Silt fence w/o having to be
fully constructed traps. I am bringing this up because my designer is out was re-evaluating the current sediment trap
design to address your comments.
2.This issue is related to the SWPPP. Texas Roadhouse (TRH) will be leasing the land from the land owner. A lease
agreement will be in place prior to construction. Can TRH be the signing party for the registration statement, and certify
the SWPPP,or would this have to be done by the current land owner?
The last 2 project I did for this client in VA,TRH was purchasing and developing the land;TRH signed the registration and
certification and delegates authority to GC,who will have day to day control over the construction site.
3. Our VA SWPPP includes erosion control and PPP in same document. SWM report is a separate doc.Would this be OK
in Albemarle County?

Finally, our research indicates that the south fork of Rivanna River is impaired and under VA 303(d) list for not meeting
general standards for Benthics(Benthic-Macroinvertebrate Bio assessments/4A).The impairment sources are listed as
unknown, non-point source, municipal (urbanized high density area) stormwater. Not specific TMDL were found. As
project meeting all current VA WQ,channel protection and flood protection, are we required to anything in regards to
discharging to an impaired waterway.

Those forms look good.The certification in the SWPPP will also need to be signed. When the plan is resubmitted, make
sure that whoever accepts the plan knows this is a resubmittal with the correct form and no additional fee is required.
