Raney, Esq Lenhart Pettit 530 East Main Street Charlottesville VA 22902 RE: LZC2018-00005 - Parcel ID 04500-00-00-109C3, 3317 Berkmar Drive, Owner — JAMES LARNER ROXANE TYNDALL, 1305 GARTH ROAD, CHARLOTTESVILLE VA, 22901 (the "Property") Mr. Raney: In response to your request for a Letter of Zoning Compliance for the above referenced Property, please be advised of the following: • The Property is zoned Commercial, C-1. The permitted uses of the Property are provided in Section 22 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). • The Property is subject to the following approved site development plans, SDP2003- 00030 Loupe Terrace Phase II - Major Amendment dated 10/31/2003 and SDP2008- 00032 Loupe Terrace Phase II - Minor Amendment dated 05/08/2008. The site plans were approved for office buildings that required a total of 60 parking space and the plan provided 61 parking spaces. • Any current use of the property that does not have a Zoning Clearance will need to file the Zoning Clearance application for approval. Required parking will be verified at the time of the review of the Zoning Clearance. Any office use that would occupy the building on the Property will have adequate parking for said office use. Different uses may be permitted if there is determined via a Zoning Clearance to have enough parking. • With the approval of the noted site plans and the subsequent Building Permit and Zoning Clearance the Property has been determined to meet all parking requirements, building height, setback and separation requirements. • The Property is not subject to any known proffers, special conditions, special exception or variance and none are pending. • This office has no record of an open violation for the Property. • There are no proceedings, pending or threatened, to revoke, rescind, alter, or declare invalid any laws, ordinance, codes, approvals, permits or certificates applicable to or issued in connection with the Property by the County February 15, 2018 LZC2018-00005 Page 2 Copies of any applicable records may be obtained via the noted links or from this office with a request through the department's Records Manager, Paul Bjornsen, at pbjornsen(a)-albemarle.org once they have been approved or issued.
