Other than as set forth in the proffers approved as part of ZMA 2015-00007, the Property is not subject to any proffered conditions imposed by the County in connection with the zoning or rezoning of the Property The Property is subject to the Entrance Corridor ("EC") Overlay District, and the Steep Slopes Overlay as described in Section 30 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance") An Ice Skating Rink is determined to be a commercial recreation establishment, thus is permitted as a by -right use as further noted here. Pursuant to Table 4 of the Code of Development (page 13), a commercial recreation establishment is permitted as a by -right use within Blocks 1-4, and Blocks 5-18 (see footnote #1 in Table 4 that excludes commercial recreation establishment from Blocks 13, 15, and 18), without the necessity of any rezoning, special use permit, or variance. As shown in Figure 1 and further described in the tables in Sections 2.2.1 and 2.2.2 of the Code of Development (pages 7, 9 & 10 respectively), Block 1 is categorized as URBAN MIXED USE and Neighborhood Service Center area, and Blocks 2-4 are categorized as URBAN DENSITY and Urban Density Residential area. As described in the noted tables, one of the listed characteristics of those areas is "Ancillary Uses." The ancillary uses noted in the tables "will complement the residential, mixed use, retail, and office uses within..." Blocks 1-4, As determined above an Ice Skating Rink is recreation thus may be characterized as an ancillary use. As described in the tables in Sections 2.3.2.1 and 2.3.2.2 of the Code of Development (pages 16-17), the maximum "Non -Residential" building footprints are 20,000sgft and 15,000sgft respectively. The table also notes that the "Maximum [square footage] does not apply to ...recreational and civic spaces..." Thus if the Ice Skating Rink is established as an ancillary use, it would be exempt from the maximum building footprint requirements for Block 1 and Blocks 2-4. November 2, 2017 LOD-201700025 Page 2 As described in Table 5: Density Regulations, of the Code of Development (page 15), footnote #2 states, "Maximum non-residential square footage in each of these blocks and the total non-residential square footage do not include the square footage of ancillary uses as listed in Section 2.2 of the Code of Development". As such, the square footage of an Ice Skating Rink as an Ancillary Use will not count towards the maximum non- residential square footage outlined in Table 5. Furthermore, once the development of Blocks 1-4 has reached the maximum allowed non-residential square footage per Table 5, then any square footage established for any ancillary use may not be converted to a use that would not be considered ancillary until an amendment to the zoning is approved to allow for additional non-residential square footage. If anyone is aggrieved by this determination, he or she shall have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If they do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a fee of $240 plus the actual cost of advertising the appeal for public hearing Applications for Appeal of the Zoning Administrator's Determination are available at the Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at www.albemarle.org/cdapps.
