For County records,we need to keep one copy of the signed deed (signed by both BSP Farms, LLC and the County Executive) and one copy of the signed plat(signed by both BSP Farms, LLC and the Subdivision Agent). Please submit one additional signed and notarized copy beyond the number of copies you would like to keep of both the deed and plat. I will coordinate the Subdivision Agent's signature on the plat.We will keep our copy and make the rest available for pick-up at our front desk. The access easement needs to provide a contiguous path from the public right-of-way to access the stormwater management facilities. In its current form, County employees would be trespassing on private property in order to reach the easement areas being dedicated. Sorry to request this scale of revisions at this point, but unfortunately I was unaware that we were not reviewing the correct format for this easement from a legal perspective. The County does not draft deeds, but I can understand how it appears that way in this case.To assist applicants, the County Attorney's office provides a variety of templates that can be modified to suit a particular project. For example, here's a conservation easement template that contains the same "This document was prepared by" language at the top: https://www.albemarle.org/albemarle/upload/images/forms center/departments/community development/forms/Ru ral Area/ACE Deed of Easement Template.pdf As I understand it,the only requested revision on the deed is to the legal description on page 1. He requested the description be more specific to the easement area. That certain real property shown and designated as "that certain tract or parcel of land, situated in Albemarle County,Virginia,lying near Keswick,Virginia,containing 471.62 acres,more or less"to be dedicated to public use,shown on the plat of BSP Farms, LLC,dated October 19,2015,entitled Plat Showing Easement Dedication on the Property of of BSP Farms,LLC,a copy of which is attached hereto to be recorded with this deed (hereinafter,the"easement"and the"Plat"). Reference is made to the Plat for more particular description of the easement conveyed herein. So, I have the revised plat, but I need a revised deed to provide back to the County Attorney's office.
