would like to submit to you/Greg for review. I wanted you to take an initial look at it to make sure you were on the

...Mike,take the draft document to the county planner. Tell them we are using it to get rid of that old and erroneous
private street agreement, and restoring control to the HOA. Point out that paragraph "NOW,THEREFORE".
This should take care of all roads built on common area, possible including the extension to reach Lot 22. The notes on
the current plat, it is my belief, are only there because of that document we are getting rid of.
Maybe we can (1) revise the plat notes, or(2) revise the document to provide that the noted areas are covered by the
HOA. The second suggestion is actually not the best alternative, since the area in front of Lot 22 does not really need to
be referenced as private at all...

TERMINATION OF DECLARATION
THIS TERMINATION OF DECLARATION(the"Termination") is made this day of
February,2016 by AVEMORE PHASE IV AT CHARLOTTESVILLE, LLC (the"Declarant").
WHEREAS,the Declarant is the owner of a parcel of land known as Albemarle County Tax
Map 78B, Section 3, Parcel 1C (the "Land")pursuant to the plat in Deed Book 3553,Page 214 in the
Albemarle County land records(the "Land Records"); and
WHEREAS, a Private Street Maintenance Agreement/Declaration was recorded in the Land
Records at Book 4494 Page 3496(the "Declaration");
WHEREAS,the Declaration contained provisions for private street maintenance that conflict
with the Avery Square at Pantops Declaration of Covenants, Condition, Restrictions and Easements
recorded in the Land Records at Book 4409 Page 8, as amended at Book 4446 Page 705 (the"Avery
Square Declaration"); and
WHEREAS, the Declarant now wishes to terminate the Declaration as further set forth
herein.
NOW, THEREFORE, Declarant does hereby terminate the Private Street Maintenance
Agreement/Declaration recorded in the Land Records at Book 4494 Page 3496 such that it will no
longer have any force or effect. Further, Declarant restates and acknowledges that the Land shall
continue to be subject to the Avery Square Declaration recorded in the Land Records at Book 4409
Page 8, including but not limited to the provisions for street maintenance.
IN WITNESS WHEREOF,the has caused this Termination to be executed on its behalf by its
duly authorize agent.

1. Section 14-302(A)(4)— Please show the name of the owner of record for all of the various existing private
easements.
2. Section 14-302(A)(16)—Please show the limits of the federal Dam Break Inundation Zone and remove Note 6.
3. Section 14-303(G)—Please show the ownership of the common areas.
