Page 1 of 5 OK 1499PG0364 020na PRIVATE ROAD MAINTENANCE AGREEMENT THIS DECLARATION, made this 28th day of August, 1995, by and between NEVONIA JONES, DOROTHY RAGLAND and BETTY JANE RAGLAND, hereinafter referred to as the Declarants; W I T N E S S E T H: WHEREAS, Nevonia Jones and Dorothy Ragland are the owners of Lot 1-A, containing 13.086 acres, as shown on a plat made by Kirk Hughes and Associates, dated June 22, 1995, and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, immediately prior hereto. WHEREAS, Betty Jane Ragland is the owner of the tract of land, containing 6.543 acres, that adjoins the said Lot 1-A on the aforementioned plat. Betty Jane Ragland obtained said tract of land from Nevonia Jones and Dorothy Ragland through and by the deed recorded in the aforesaid Clerk's Office immediately prior hereto. WHEREAS, said deed creates an access easement over the 6.543 acres owned by Betty Jane Ragland, the location of which is shown on said Hughes plat. It is anticipated that at som6 time in the future a road will be built over and upon said access easement. WHEREAS, the Declarants desire to bind themselves and their successors and assigns for all liability for the repair and maintenance of said road, said tracts to be held, transferred, sold, conveyed and occupied subject to charges for repair and maintenance as more particularly set forth herein, and in all valid amendments thereto, said charges being covenants running with said tracts and as such are binding upon any and all parties Book: 1499 Page: 364 FileNumber:1995-00010323 Seq: 1 �.` _ _daum Page 2 of 5 rA_ L_ BK1499PG0365 who have, or acquire title to all or any part of said tracts. Upon the sale of each lot, or any part thereof, each seller is not responsible for future obligations under this agreement. NOW., THEREFORE, the Declarants declare and covenant as follows: 1. Each subsequent owner of any of the subject tracts, or any portion thereof, by acceptance of a deed therefor, whether or not it shall be so expressed in any deed or conveyance, shall be and is hereby deemed to covenant to pay the pro rata share of repair and maintenance of the subject road from such times as r said road is put to use until such times as said road is accepted into the State system, if ever, whenever at least two of the owners of said tracts deem such maintenance or repairs are necessary. A majority of the owners of said tracts shall determine the standards to which the aforesaid road is to be maintained. Each of the owners of said tracts shall be liable for an equal share of the cost of repairs and maintenance of said road and shall pay to the person or corporation performing such repairs or maintenance one-half of the cost thereof within thirty (30) days after a bill for such charges is submitted by the person or corporation performing such repairs or maintenance. If not paid Within said time period, the amount due by such lot owner shall bear interest at the maximum rate provided by law and the other tract owners liable for such charges may (1) bring an action at law against any owner who has not paid the appropriate pro rata charges; or (2) foreclose the lien hereinafter provided for against any owner who has not paid the appropriate pro rata Book: 1499 Page: 364 FileNumber:1995-00010323 Seq:2 Page 3 of 5 eK1499PGO366 charges. Any costs and reasonable attorney's fees incurred in any such legal action shall be added to the amount of such charges for Which the non-paying owner is responsible. 2. There shall be a continuing lien upon each of said tracts to secure the payment of the charges herein provided for road repairs and maintenance, but such liens shall at all times be subject to any mortgage or deed of trust placed upon any tract. If any owner does not pay a road maintenance assessment within 30 days after the same becomes due and payable, then a notice of such non-payment as to such tract may be recorded by the other tract owner or owners, or by the person or corporation performing such maintenance or repairs, in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, and from the time of such recordation, the amount stated in said notice plus interest, costs and reasonable attorney's fees shall become a lien prior to any mortgage or deed of trust recorded subsequent to the recordation of such notice. 3. The existing road is not a public road and will not be maintained by Albemarle County, the State of Virginia, or other public agency, unless and until the State accepts said road into the State system, it ever. 4. If either of the present two tracts of land are subdivided, then the owner of each new tract shall be responsible for road maintenance charges in an amount equal to any other owner of any portion of said tracts. In other words, if there are S owners of any portion of said two tracts, then each owner shall pay one-fifth of the road maintenance charges.
