The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
Conditions of Preliminary Plat Approval (from letter dated 11/16/12):
[14-302(A)4 & 5] Private and Public easements. Any necessary easements must be documented and
approved during the road plan or WPO application process.
Final: Comment not fully addressed. Address the following:
• All deeds and agreements that are required for the easements and maintenance must be submitted,
reviewed by the County Attorney's office and recorded prior to approval of this plat.
Rev. 1: Comment not addressed. Comment still valid.
Rev. 2: Comment not yet fully addressed. The documents have been reviewed by the County
Attorney's office and are ready for signatures. Submit the signed version of the deeds. These must
be recorded at the same time as the final plat.
Rev. 3: Address the following items in reference to the submitted legal documents:
o Both the Supplementary Declaration and the Deed of Easement are missing the date
that is meant to be written on the first page near the top. Ensure this is correctly
filled out prior to the next submission of the documents.
o The Supplementary Declaration has only the signature of one of the two owners.
Resubmit the document with both owners notarized signatures.
o Since the Deed of Easement must be signed by the County Executive the original will
need to be submitted for his signature.
o The name for the County Executive needs to be revised in the signature area of the
Deed of Easement. The signature area for the County Executive must state "Jeffrey
B. Richardson". The current document has omitted his middle initial.
16. [14-317] Instrument evidencing maintenance of certain improvements. An instrument for the maintenance
of privately owned improvements (street trees, common areas, etc.) must be submitted for review.
The maintenance of the street trees that will be outside of the right-of-way and inside the "10' Landscaping
and Maintenance Easement", as well as the maintenance of the proposed open spaces, are examples of
such improvements. A highlighted version of the maintenance document(s), specifying where each of the
items in the County Attorney's checklist are located in the document, must been submitted. Attached
please find the checklist. If any of the items in the checklist are not included in the document also include a
highlighted version of any other supplemental documents that cover those checklist items. This document
must be approved by the County Attorney's office before approval of this plat and must be recorded with the
plat.
