RE: SRC Action Letter – Conditional Approval of SDP-2018-00008
(Vistas at South Pantops – Initial Site Plan)
Dear Ms. Van-Niekerk and Mr. Steigman:
The Agent for the Board of Supervisors hereby grants administrative approval, with conditions, to the
above-referenced Initial Site Plan (dated 3/5/2018).
This approval shall be valid for a period of five (5) years from the date of this letter, provided that the
developer submits a Final Site Plan for all or a portion of the site within one (1) year after the date of this
letter as provided in section 32.4.3.1 of Chapter 18 of the Code of the County of Albemarle, and
thereafter diligently pursues approval of the Final Site Plan.
In accordance with Chapter 18 of the Code of the County of Albemarle, Section 32.4.2.8, Early or Mass
Grading may be permitted after the following approvals are received:
1. Engineering approval of a VSMP plan meeting the requirements of Chapter 17 of the Code of the
County of Albemarle.
2. Approval of all easements for facilities for stormwater management and drainage control.
3. Submittal of a tree conservation checklist with areas for tree preservation identified.
Please be advised that the Final Site Plan will not be considered to have been officially submitted until
the following items are received:
1. A Final Site Plan that satisfies all of the requirements of Section 32.6 of Chapter 18 of the Code.
2. A fee of $1,613.00 per Section 35.1.d(3) of Chapter 18 of the Code.
Please also be advised that, per the meeting conducted on Thursday, April 19 after the SRC meeting, and
per Mr. John Anderson’s updated review comments (see comment #21, dated 4/25/2018), the site plan
will not approvable using the proposed layout plan and proposed grading plan unless a refined
topographic survey demonstrates, to the satisfaction of the County Engineer, that the development will

not include the disturbance or development of Preserved Steep Slopes (and will not otherwise include the
disturbance or development of areas with a slope of 25% or greater). Engineering Division staff have
encouraged and strongly recommended that additional coordination on these matters occur prior to
submittal of a Final Site Plan. (UPDATE 5/24): Mr. John Anderson has indicated that the requested
refined topographic survey has been submitted, reviewed, and accepted by the County Engineer.
Additionally, please be advised that modifications to the layout plan might potentially require a re-review
of this proposal as an Initial Site Plan, depending on the extent and nature of any layout plan
modifications (or other modifications), as determined by the Planning Director or his designee.
Please submit a minimum of eight (8) copies of the Final Site Plan to the Community Development
Department (CDD). The assigned Review Coordinator will then distribute the plans to all reviewing
agencies. (Note: for ACSA, please coordinate directly with Mr. Alex Morrison or Mr. Richard Nelson to
determine how many copies ACSA requires in conjunction with their ongoing Water and Sewer
Construction Plan review.) CDD staff will then provide you with the first comment letter containing each
agency’s review comments for the Final Site Plan; after receiving that letter, please work directly with
each plan reviewer to address and resolve their respective agency’s requirements.
CDD shall not accept submittal of the Final Site Plan for final approval signatures until each of the
following agencies/reviewers indicate in writing that the Final Site Plans satisfy the attached conditions*
and all other applicable requirements, and have been given (tentative) approval:

other members of the Site Review Committee (SRC) have reviewed the development proposal referenced above.

1. [Z.O. Section 32.5.2(a)]: On Sheet ISP2, the Site Tabulations chart is partially illegible (not visible). Please
ensure the chart is properly displayed and fits entirely on the sheet, without any content being omitted.
2. [Z.O. Section 32.5.2(r)]: On Sheet ISP2, the right half of the Legend does not contain any labels for the various
symbols. Please revise to ensure all symbols in the Legend are properly labeled.
3. [Z.O. Section 32.5.2(a)]: On Sheet ISP2, please revise the Zoning Information on the Site Tabulations chart as
follows: add the word “Steep” so that it states “Managed and Preserved Steep Slopes Overlay District” and add
“Flood Hazard Overlay District.”
4. [Z.O. Section 32.5.2(a)]: On Sheet ISP3, the north arrow appears to be shown incorrectly. Please check and
revise as necessary. The north arrow appears to be shown correctly on the other sheets.
5. [Z.O. Section 32.5.2(b)]: On Sheet ISP2, the Site Tabulations chart identifies the Tax Map/Parcel as being
13.31 acres, but the Land Cover Schedule states that the total area is 13.76 acres. Please address and resolve this
discrepancy, and please recalculate affected calculations (as may be necessary).
6. [Z.O. Section 32.5.2(d)]: The Grading Plan on Sheet ISP5 shows a “proposed construction easement +/- 3,200
sf” on the adjoining property to the south (Overlook Condominiums). Please provide additional explanation,
documentation, or other information about these proposed off-site construction activities, such as an easement
or a letter of intent to grant the proposed easement.
7. [Z.O. Section 32.5.2(n)]: Please show the proposed location(s) of outdoor trash containers.
8. [Z.O. Section 32.5.2(n)]: Please show the proposed location(s) of outdoor lighting.
9. [Z.O. Section 32.5.2(n)]: Please provide the proposed paving materials or other surface materials for all walks,
parking lots, and driveways.
10. [Z.O. Section 32.5.2(n)]: On Sheet ISP2, the Parking Requirements information on the Site Tabulations chart
states that there are 12 ADA spaces (9 van accessible), but Sheets ISP4 and ISP5 appear to show only 10 ADA
spaces (with only 8 van accessible). Please revise the Site Tabulations chart as necessary.
11. [Z.O. Section 32.5.2(n)]: Please add graphic depictions and/or notes to Sheet ISP4 that clearly identify the
location and size of the proposed clubhouse and proposed pool deck/swimming pool.
12. [Z.O. Section 32.5.2(b)]: On Sheet ISP2, the Recreation Regulation information on the Site Tabulations chart
identifies the Provided Area as including “473,497 SQFT of onsite nature trails and wooded areas.” Please
identify the location/extent of the area that was used to calculate this approximately 11-acre proposed recreation
amenity.
13. [Z.O. Section 32.5.2(i)]: Please revise Sheets ISP2, ISP4, and ISP6 (as may be necessary) to provide
information about any access easements which may potentially be granted in conjunction with the proposed “5’
nature trails” that are proposed as publicly-accessible recreational connections from South Pantops Drive
through the subject property to the Old Mills Trail in the Albemarle County Greenway Corridor along the
Rivanna River.
14. [Z.O. Sections 32.5.2(n) and 4.16]: The proposed substitution of “provided recreation facilities” (“trails in
wooded area and connection to county trails system-greenway”) for minimum required facilities is partially
acceptable, and partially unacceptable. Please revise as follows:
A. It is acceptable to utilize the proposed “trails in wooded area and connection to county trails system-
greenway” as a substitution for some of the minimum facilities required by 4.16.2; however, it is not
acceptable to completely substitute those minimum facilities. Specifically, one (1) tot lot that
complies with 4.16.2.1 and 4.16.1 must be provided.
B. Please modify the trail locations and alignments in collaboration with Mr. Dan Mahon in the
Albemarle County Parks and Recreation Department (ACPR).
C. Please consider opportunities to partially relocate/realign the southern trail into areas which will
already be subject to land disturbance, so as to minimize disturbance within steep slopes, where
possible.
D. Add a note to the Initial Site Plan that states the following: “Per County Code 18-4.16.3.2,
recreational equipment and facilities shall be maintained in a safe condition and replaced as
necessary. Maintenance shall be the responsibility of the property owner if rental units or a
homeowners' association if sale units.”
E. Add a note to the Initial Site Plan that states the following: “Per County Code 18-4.16.3.3,
recreational facilities shall be completed when fifty (50) percent of the units have received
certificates of occupancy.”
15. [Z.O. Section 32.5.2(o)]: The “proposed right-of-way dedication area” along South Pantops Drive must include
the statement “dedicated to public use.” Please revise accordingly and please clarify the purpose or intent of the
proposed dedication. Please note that this proposed dedication of land requires the preparation and submission
of a separate subdivision plat satisfying the requirements of chapter 14, and will likely need to be accompanied
by a deed of dedication in a form and having the substance approved by the county attorney.
16. [Z.O. Section 32.5.2(q)]: The traffic generation figures provided in the ADT section of the Site Tabulations
chart on ISP2 specify a Total ADT based on 144 units. This proposal contains 148 units. Please revise these
calculations accordingly.
UPDATE (5/24): Comment not applicable.
17. [Z.O. Section 32.5.2(s)]: As noted above, this proposed development (as shown on the Initial Site Plan) will
require the preparation and submission of an off-site construction easement plat, as well as a subdivision plat
with corresponding deed of dedication. The proposed “5’ nature trails” which are intended to provide a public
recreational connection to the Old Mills Trail in the Albemarle County Greenway Corridor along the Rivanna
River, may also require an easement plat (TBD, based on additional coordination with ACPR).
18. (UPDATE 5/24): [Z.O. Sections 32.5.2(b), 32.5.2(n), 18.8, and 4.19]: All structures are subject to
stepback requirements contained in Z.O. 4.19, as follows:
“For each story that begins above 40 feet in height or for each story above the third story,
whichever is less, the minimum stepback shall be 15 feet. The minimum 15 foot stepback applies
to all buildings on the property and may be reduced by special exception.”
Sheets ISP1, ISP4, and ISP5 appear to show structures four stories above grade (not including
underground parking); as such, the stepbacks should apply to these structures. Although the “Stepback”
note in the “Site Tabulations” table on Sheet ISP2 of Initial Site Plan SDP201800008 correctly lists the
stepback requirements, the conceptual architectural rendering on Sheet ISP1 appears to show a four-story
structure with no stepbacks.
Please ensure the final site plan addresses and resolves this apparent discrepancy, and please ensure all
applicable stepback requirements are applied to all structures.

1. Coordination may be required with state agency concerning Federal Dam Break Inundation Zone.
2. Preserved Slopes remain ineligible for development unless more accurate or more technical data
demonstrate to the satisfaction of the County Engineer that the slopes are less than twenty-five (25) percent.
Avoid favorable averaging across contours that indicates slopes less than 25%, when, for example, using
horizontal distance between adjacent 2-ft interval contours in Area C, ISP10, slopes as steep as 33% appear
to exist in area ISP proposes for development. Recommend Engineering plan review meeting to discuss.
3. Consider practicality of constructing 26-ft high wall within 1 ft. of preserved steep slopes (ISP4).
ISP4:
4. Confirm all parking lot parking space and island curb radii ≥ 3’.
5. Provide fire-truck design vehicle to show graphically that internal site design allows adequate turnaround.
Fire response vehicle/s that enter the site must be able to exit without backing into South Pantops Drive.
ISP5:
6. Revise 16’ retaining wall design per Albemarle County Code, 18-30.7.5 (since built upon steep slopes).
7. Provide complete drainage computations; plan and profile of proposed storm system elements (inlets
/pipes). Use VDOT storm conveyance tabular reporting format.
8. Ensure exit velocity at storm system structure 1 (outfall for entire development) is a non-erosive velocity.
9. Ensure adequate riprap apron outfall protection at storm system structure 1.
10. Provide riprap apron design for outfall protection at storm system structure 1.
11. Include off-site pass-through storm runoff volumes that transit the site in all routings. (ISP7)
12. Provide velocity and volume storm runoff computations. Provide routings to support stormwater narrative,
especially to support statements concerning pass-through peak flows, and site-generated peak flows (ISP7).
13. Provide storm routings that pass through Ex. 54” pipe beneath South Pantops Drive.
14. 2:1 slopes are generally an exception. Provide 3:1 or flatter slopes wherever possible.
15. ISP6: Proposed sanitary MH Str. 2A height appears to require safety slab. Show safety slab.

19. ISP9: VDOT approval of turn lane warrant analysis is required.
20. Please be advised that Final Site Plan approval of design that includes retaining walls of varying height,
including walls integral to parking and a 4-story residential apartment building, will require (retaining wall)
structural plans sealed by a licensed professional engineer with structural or geotechnical expertise.

13.31 acres, but the Land Cover Schedule states that the total area is 13.76 acres. Please address and resolve this
discrepancy, and please recalculate affected calculations (as may be necessary).
6. [Z.O. Section 32.5.2(d)]: The Grading Plan on Sheet ISP5 shows a "proposed construction easement +/- 3,200
sf'on the adjoining property to the south (Overlook Condominiums). Please provide additional explanation,
documentation, or other information about these proposed off -site construction activities, such as an easement
or a letter of intent to grant the proposed easement.
7. [Z.O. Section 32.5.2(n)]: Please show the proposed location(s) of outdoor trash containers.
8. [Z.O. Section 32.5.2(n)]: Please show the proposed location(s) of outdoor lighting.
9. [Z.O. Section 32.5.2(n)]: Please provide the proposed paving materials or other surface materials for all walks,

states that there are 12 ADA spaces (9 van accessible), but Sheets ISP4 and ISP5 appear to show only 10 ADA

11. [Z.O. Section 32.5.2(n)]: Please add graphic depictions and/or notes to Sheet ISP4 that clearly identify the
location and size of the proposed clubhouse and proposed pool deck/swimming pool.
12. [Z.O. Section 32.5.2(b)]: On Sheet ISP2, the Recreation Regulation information on the Site Tabulations chart
identifies the Provided Area as including "473,497 SQFT of onsite nature trails and wooded areas." Please
identify the location/extent of the area that was used to calculate this approximately 11-acre proposed recreation
amenity.
13. [Z.O. Section 32.5.2(i)]: Please revise Sheets ISP2, ISP4, and ISP6 (as may be necessary) to provide
information about any access easements which may potentially be granted in conjunction with the proposed "5'
nature trails" that are proposed as publicly -accessible recreational connections from South Pantops Drive
through the subject property to the Old Mills Trail in the Albemarle County Greenway Corridor along the
Rivanna River.
14. [Z.O. Sections 32.5.2(n) and 4.161: The proposed substitution of "provided recreation facilities" ("trails in
wooded area and connection to county trails system-greenway") for minimum required facilities is partially
acceptable, and partially unacceptable. Please revise as follows:
A. It is acceptable to utilize the proposed "trails in wooded area and connection to county trails system-
greenway" as a substitution for some of the minimum facilities required by 4.16.2; however, it is not
acceptable to completely substitute those minimum facilities. Specifically, one (1) tot lot that
complies with 4.16.2.1 and 4.16.1 must be provided.
B. Please modify the trail locations and alignments in collaboration with Mr. Dan Mahon in the
Albemarle County Parks and Recreation Department (ACPR).
C. Please consider opportunities to partially relocate/realign the southern trail into areas which will
already be subject to land disturbance, so as to minimize disturbance within steep slopes, where
possible.
D. Add a note to the Initial Site Plan that states the following: "Per County Code 18-4.16.3.2,
recreational equipment and facilities shall be maintained in a safe condition and replaced as
necessary. Maintenance shall be the responsibility of the property owner if rental units or a
homeowners' association if sale units."
E. Add a note to the Initial Site Plan that states the following: "Per County Code 18-4.16.3.3,
recreational facilities shall be completed when fifty (50) percent of the units have received
certificates of occupancy."
15. [Z.O. Section 32.5.2(o)]: The "proposed right-of-way dedication area" along South Pantops Drive must include
the statement "dedicated to public use." Please revise accordingly and please clarify the purpose or intent of the
proposed dedication. Please note that this proposed dedication of land requires the preparation and submission
of a separate subdivision plat satisfying the requirements of chapter 14, and will likely need to be accompanied
by a deed of dedication in a form and having the substance approved by the county attorney.
16. [Z.O. Section 32.5.2(q)]: The traffic generation figures provided in the ADT section of the Site Tabulations
chart on ISP2 specify a Total ADT based on 144 units. This proposal contains 148 units. Please revise these
calculations accordingly.
17. [Z.O. Section 32.5.2(s)]: As noted above, this proposed development (as shown on the Initial Site Plan) will
require the preparation and submission of an off -site construction easement plat, as well as a subdivision plat
with corresponding deed of dedication. The proposed "5' nature trails" which are intended to provide a public
recreational connection to the Old Mills Trail in the Albemarle County Greenway Corridor along the Rivanna
River, may also require an easement plat (TBD, based on additional coordination with ACPR).
