This approval shall be valid for a period of five (5) years from the date of this letter, provided that the developer submits a final plat for all or a portion of the site within one (1) year after the date of this letter as provided in the Section 14-226 of the Code of the County of Albemarle, and thereafter diligently pursues approval of the final plat. The final plat will not be considered to have been officially submitted until the following items are received: 1. A final plat that satisfies all of the requirements of section 14-303 and sections 14-304 through 14-318 of the Code, and the conditions attached to this letter. 2. Applicable fee outlined in the application. Please submit 9 copies of the final plat to the Community Development Department. The assigned Lead Reviewer will then distribute the plat to all reviewing agencies (for ACSA, please submit 3 copies of construction plans directly to them). Once you receive the first set of comments on the final plat, please work with each reviewer individually to satisfy their requirements. Comments are provided below; however, additional comments or conditions may be added or eliminated based on further review.): [Each comment is preceded by the applicable reference] 1. [14-302(B)8, 4.191 Yards. Lot 25 does not meet the maximum front setback. This lot is a corner lot; as such, the shorter of the two fronts is the true front and shall meet the front min and maximums. Revise. 2. [14-401, 14-203.1(B)] Double frontage lots. Double frontage lots for single-family detached residential uses are prohibited. Currently there are three double frontage lots: Lots 12, 33, and 34. Either redesign these lots to have a minimum of twenty (20) feet of common area between the rear of the lot and the second street or an exception under 14-203.1(B) is needed prior to final plat approval. [14 -302(A)4,14 -302(A)14, ZMA2004-18, ZMA2011-1, Proffer 101 Pedestrian Paths. The trails are appropriately located; however, because the pathways are not in 10' fee simple open space areas, the 5' pathways shall be provided a 10' trail easement for installation and maintenance purposes. Revise. 4. [14-317] Instrument evidencing maintenance of certain improvements. Prior to final plat approval an instrument evidencing maintenance of the Open Space, Required plantings associated with proffer 4, and Trail maintenance docs will need to be approved by the County Attorney. Submit the draft documents to Planning staff for a cursory review and then I will forward them to the County Attorney for review/ approval. 5. [14-303] Contents of final plat. A plat meeting all the requirements for final subdivision plats per the subdivision ordinance. 6. [Comment] All SRC reviewer approvals are required prior to final subdivision plat approval. Notably, ACSA approval is required prior to final plat approval (see agencies comments below). ACSA — Richard Nelson 1. The lot layout, road layout, and ACSA utility alignments do not match approved plans (Hyland Park Final Road and Utility Plan dated 6/30/17, last revised 10/6/17, approved by ACSA 3/10/18). Advise if preliminary subdivision plan will be updated, or a revised water/sewer construction plan review will be submitted to the ACSA. VDOT — Justin Deel/Adam Moore • Slopes greater than 3:1 that are adjacent to the right-of-way require slope easements. On the final plat please provide a slope easement for the slope at the Belluno Court cul-de-sac. Fire and Rescue - Robbie Gilmer 1. Hydrant spacing on Belluno Lane and Belluno Court exceeds 250 feet. 2. A fire flow test will be required prior to final acceptance. Inspections — Michael Dellinger 1. Retaining walls 3 feet and greater require separate building permit, 4 feet and greater require stamped engineered design. E911— Elise Kiewra No objection Engineering — Mathew Wentland 1. COUNTY OF ALBEMARLE Department of Community Development 401 McIntire Road Charlottesville, Virginia 22902-4596 Phone (434) 296-5832 March 3, 2017 Scott Collins 200 Garrett Street, Suite K Charlottesville VA 22902 RE: SUB2017-34 Hyland Park - Preliminary Subdivision Plat Dear Mr. Collins: Pursuant to Albemarle County Code §14-218(C) the above referenced preliminary subdivision plat is deemed incomplete and shall not be accepted for official submittal by the agent. In order for the preliminary subdivision plat to be accepted as officially submitted, please revise the plat to address the following within 15 days of this notice: 1. [14 -302(A)4,14 -302(A)14, ZMA2004-18, ZMA2011-1 (Proffer #10)] Private easements. The location and dimensions of all existing and proposed private easements. Existing easements shall be labeled with the deed book and page number and the name of the owner of record. The application plan for ZMA2004- 18 depicts the required pedestrian trails in Phase 4C Section 2 connecting from existing trails in Fontana and to surrounding neighborhoods. Specifically from VIA FLORENCE ROAD along the left side of BELLUNO LANE, connecting to HIGHLAND RIDGE and another portion of the trail from the cul-de-sac between Lots 20 and the proposed SWM facility to ASHCROFT. Revisions to proffer #10 from ZMA2011- 1 do not negate the requirement for these trails to be provided, nor do sidewalks along Belluno Lane. In order to comply with this requirement, the trails need to be depicted on the preliminary plat. Also, assure they are each within a 1Oft wide easement. Also, on the plat provide ownership information for the proposed easements. Additionally, depict and reference the existing path easements (DB 3003 PG 425) that the required trails in this development will be connected to. Revise the plat to provide this information and provide the ownership information for these existing easements. 2. [14-305] Stormwater management information. The subdivider shall submit with each preliminary plat: A. Removal rate computations and project drainage area maps as described in the design standards manual to support conceptual stormwater management plans. In addition, the subdivider shall submit a written request and justification for any waiver of water detention requirements allowed by the water protection ordinance, if such a waiver is needed. 3. [14-302(A)(12)] Topography. Existing topography for the entire site with sufficient offsite topography to describe prominent and pertinent offsite features and physical characteristics, but in no case less than fifty (50) feet outside of the site unless otherwise approved by the agent. The plat fails to provide accurate topographic information for the entire site, specifically the noncontiguous portion of TMP 78E -A which is located on the other side of Fontana Drive adjacent to TMP 78E-118. This portion of the lot contains managed and preserved slopes. Revise the plat to depict this information. 4. [14-302(A)(9)] Building sites on proposed lots. The plat shall contain the following note: "Parcel [letter or number] and the residue of Tax Map/Parcel [numbers] each contain a building site that complies with section 4.2.1 of the Albemarle County Zoning Ordinance. " 5. [14-302(B)(7)] Reservoir watershed; agricultural forestal district. Provide notation on the plat as to whether the land is within an Albemarle County and/or City of Charlottesville water supply watershed or an agricultural -forestal district. 6. [14-302(B)(5)] Zoning Classification. The plan correctly lists ZMA2004-18 w proffers; however, ZMA2011-1 w/ proffers is also applicable to this project. Revise the zoning on sheet 1 to include this ZMA information and assure the proffer(s) related to it are provided on sheet 6. While not a reason for this plat to be deemed incomplete, below I offer preliminary guidance on proffer #2 of ZMA2004-18. Proffer #2 must be addressed prior to preliminary subdivision plat approval. This item cannot be a condition of preliminary plat approval. 1. [ZMA2004-18, (Proffer #2)] Proffer 2 states in part: "The Final Grading Plan shall be approved by the County Engineer prior to the approval of the first preliminary subdivision plat." A Final Grading Plan has not been submitted or approved for the current proposal; as such, the preliminary plat cannot be approved till such a plan is submitted and approved. Either obtain approval of a Final Grading Plan or obtain a rezoning of the property so that approval of a Final Grading Plan is not required prior to approval of the preliminary subdivision plat. Additionally, I want to make you aware of a couple other large items as it relates to the rezoning, which this plat does not currently address but shall prior to preliminary plat approval as these requirements affect the final grading plan mentioned above. 1. [ZMA2004-18, 14-409] The Cascadia/Fontana Connector shall be depicted on the preliminary plat. The road plan shall dictate the specific design of the public road. The Cascadia Connector (pedestrian and emergency access) located in Phase 4C Section 3 shall connect to Fontana Drive and be built to the property line or bonded prior to final subdivision plat approval. 2. [14-302(A)(15), ZMA2004-18 (Proffer #1/Application Plan)] Identification of all owners and certain interest holders. The names and addresses of each owner of record and holders of any easements affecting the property. The noncontiguous portion of TMP 78E -A, which is located on the other side of Fontana Drive adjacent to TMP 78E-118 shall be combined with TMP 78E-118 to create one large lot. Revise the plat to depict this and add the ownership information and signature line for TMP 78E-118 to the plat. To aid in your revisions and continued development of this proposal I am attaching the proffers from ZMA2004-18 and ZMA2011-1. Within fifteen (15) days after the date this notice of disapproval is provided to the applicant, the subdivider may resubmit the preliminary plat, as provided by Albemarle County Code § 14-218(D). If a revised plat is not received within 15 days, the plat shall be deemed to be disapproved and a new application and fee shall be required for submittal of the plat. Sincerely, Christopher P.
