Initial comments for the following divisions of the Department of Community Development and other agencies, as applicable, are attached: Albemarle County Planning Services (Planner) Albemarle County Planning Services (Architectural Review Board) Albemarle County Engineering Services (Engineer) Virginia Department of Transportation Albemarle County Building Inspections Albemarle County Service Authority Albemarle County Information Services (E911) – no objection Albemarle County Department of Fire Rescue – no objection Comments reflect information available at the time the development proposal was reviewed, and should not be considered final. However, the Site Review Committee has attempted to identify all issues that will be required to be resolved prior to approval. [5.1.40(b)(6)] Screening and siting to minimize visibility. A concern for staff is the fact that nearly all screening trees (including the reference tree) are within the VDOT right-of-way, and the applicant’s control is limited over preventing clearing of trees within the right-of-way. Correspondence has been received from VDOT indicating that there are currently no plans to cut any trees in this area, and that an option to maintain the trees within the right-of-way could be secured via landscape permit. Staff will continue to work with the relevant parties to determine how to ensure screening is provided, potentially through conditions related to the tree conservation plan or requested special exception. 2. [5.1.40(b)(2)(a)] Number of arrays. Administrative practice has been to include OVP and RRH equipment and their relative size in counting the number of arrays on a proposed facility. Given that the antenna array and RRH/OVP array on Sheet C-3 are mounted at two different rad centers and totaling 1320.66 and 680 square inches in size respectively, they are more accurately described as two arrays. Although this does not directly impact the review of this application as the requirements are being met, it would be helpful in future determinations to add a note or label the arrays shown on Sheet C-3 as “Array #1” and “Array #2”. 3. [5.1.40(b)(2)(c), 5.1.40(a)(12)] Projection. A special exception was requested to modify Section 5.1.40(b)(2)(c) of the Zoning Ordinance, particularly the requirement that “in no case shall the closest point of the back of the antenna be more than twelve (12) inches from the facility”. Based on the limited visibility from the balloon test and the justifications provided, staff has no objection to this request, given that the proposed antennas will still be in compliance with the 18” maximum distance. However, it would be helpful to know the new distance from the monopole for the closest point of the back of the antenna for the staff report and analysis. Per the 150 day time for action, this request must be acted upon by September 20, 2018. Once this information is received, staff can begin to process this Special Exception request for action, likely during the August 1st or August 8th Board of Supervisors meetings. 4. [5.1.40(b)(2)(c)] Projection. Please fix Note 4 on Sheet C-3 from “26 inches” to “18 inches” to reflect the Zoning Ordinance and the other diagrams shown on this sheet. Albemarle County Architectural Review Board (ARB) – Margaret Maliszewski 1. This application was reviewed by the ARB on June 4th, 2018. The action memo is attached. Albemarle County Engineering Division (Engineer) – Emily Cox 1. Add silt fence on Sheet C-4 to protect the asphalt path (on southern side of asphalt path). Virginia Department of Transportation (VDOT) – Adam Moore 1. See attached email dated May 30th, 2018. Albemarle County Building Inspections – Michael Dellinger 1. Permits needed for concrete pole base, electrical service, LP tank and lines, and generator. Albemarle County Service Authority (ACSA) – Richard Nelson 1. Regular Review Items a. ARB-2018-58: Verizon Fry’s Spring Tier 2 PWSF - Personal Wireless Services Facility (TM/Parcel 076M1000000200) Proposal: To install a telecommunications facility consisting of a 103’ tall monopole and associated equipment. Location: 100 265 Merchant Walk Avenue, at the tree line behind Dick’s Sporting Goods and Wegman’s grocery store, adjacent to I-64. Regarding the Certificate of Appropriateness for the ground equipment and base station: Motion: Mr. Binsted moved for approval of the Certificate of Appropriateness as proposed, for the ground equipment and base station for ARB-2018-58: Verizon Fry’s Spring Tier 2 Personal Wireless Service Facility. Mr. Van Der Werf seconded the motion. The motion carried by a vote of 5:0. Regarding visibility of the monopole: Motion: Mr. Stoner moved to forward the following recommendations to the Agent regarding the visibility of the monopole for ARB-2018-58: Verizon Fry’s Spring Tier 2 Personal Wireless Service Facility. The facility will be sited to minimize its visibility, if the following assurances can be given: 1) that VDOT will not cut the trees in the right-of-way along the full frontage of the property, 2) that VDOT will allow the applicant to replant individual trees that die, and that the applicant will do so, and 3) that the monopole will be removed if loss of trees results in visibility of the facility that is not minimized. Mr. Hancock seconded the motion. The motion carried by a vote of 5:0. Regarding the Special Exception: Motion: Mr. Binsted moved to forward the following recommendation to the Agent regarding the special exception for ARB-2018-58: Verizon Fry’s Spring Tier 2 Personal Wireless Service Facility. Based on the anticipated visibility from the EC, the ARB has no objection to the 18” mounting distance. Mr. Hancock seconded the motion. The motion carried by a vote of 5:0. OTHER BUSINESS a. ARB-2017-115: Sapon & Swisher Dental: Landscape/utility conflicts Motion: Mr. Stoner moved for approval of the landscape plan, noting that condition #9 had been sufficiently resolved.
