SUB2016-185 -Briarwood Phase 4 (portion) and phase 6 (portion) - final plat, it is not ready for approval
yet. Comments on that plat went out on Dec 16, 2016. The revised 1-4-2017 date you referenced has not been
submitted nor reviewed. Whenever you are ready please resubmit the plat and a comment response letter and we
will conduct a review on it.
One of the largest item remaining is the approval and the bonding of the final site plan for the primary rec area
(SDP2016-45). Thus what we need to be focus on are the next steps in the process to approve the final site plan.
I emailed you a time line back in Jan(email attached and excerpt provided below, red texts are recent status
updates and guidance for what Scott Collins needs to do/update the site plan). See below:
The primary recreational area can be bonded once the final site plan is signed/approved by the County. Not yet
approved nor bonded.
Currently there are numerous large items still outstanding prior to final site plan approval. They are:
(1) The easement plat into the site across Ray Beard's property is not yet approved/recorded yet this is
approva otherwise they don't have access to the recreational area over Ray's
propert Col, Meted/approved/recorded. Recordation information of this action needs to be put on the
final site .n for the primary rec area. pit'',to.-a �
(2) The road plan for phase 4 which includes the portion of St/. Ives fronting the rec area is not
approved/bonded yet - is road plan needs to
be finish up Pt bc it is needed to provide access to the recreational area. This road plan needs to be
bonded. Ana mer will not return from vacation till tomorrow. Not sure where this project is at in her
que to fin ' e/post the bowls P,l�eas w rk with her on this item when she comes back.

(3) The subdivision plat for the recreational area(subdividing it off of the rest of the parcel) is not yet
approved this matters bc this plat also
records required SWM easements required for the final site plan. This plat also dedicated the land to
the HOA and divides it so it's it's own
parcel. Completed/approved/recorded 6-1-17. Recordation information of this action needs to be
put on the final site plan for the primary rec area. Also, assure Scott updates the parcel boundary lines as
the version of the final site plan I have incorrectly depicts the stub that Wendell wanted to subdivide into
a lot,which was later determined to be previously dedicated R/W and not part of Briarwood.
(4) WP02016-50 is t yet approved and requires the two plats mentioned above and bonding prior to
it being approved. This W plan for the rec area needs to be bonded. Ana Kilmer will not return from

vacation till tomorrow. Not sure where this project is at in her que to finalize/post the bonds. Please work
with her when she comes back.

Attached are the proffers for Briarwood, see proffer#4, excerpt provided below, which provides the bonding option for
the improvements associated with the Primary Recreational Area Site Plan.
IZMA2005-09 Proffer#4J The primary recreational area shall be built or bonded for its construction prior to final
plat approval of phase 4. This recreational area shall be built prior to completion of Phase 4...
The primary recreational area can be bonded once the final site plan is signed/approved by the County. Attached is the
latest comment letter on the final site plan. Currently there are numerous large items still outstanding prior to final site

I also want to make sure you understand that the primary recreational area must be built before the 26nd certificate of
occupancy(which is 50%of the units in phase 4 subdivision plat) [requirement based on Sec. 4.16].

The County of Albemarle Planning Division will recommend approval of the plan referenced above once the
following comments have been satisfactorily addressed(The following comments are those that have been identified
at this time.Additional comments or conditions may be added or eliminated based on further review.): [Each
comment is preceded by the plicable reference,which is to the Subdivision/Zoning Ordinances unless otherwise
specified.]
1. [32.7. ,32.5.1(c),32.5.2(i),32.5.2(m)] Vehicular access to the site. The access road,access easement,and
gr ng outside of the access easement are proposed on TMP 32E-2,which is owned by Ray Beard. Prior to final
to plan approval the easements required to construct the road shall be obtained from Mr. Beard and platted.
Easement plats shall be reviewed by the County and then recorded in the Clerk's Office. The DB page
information of this action shall be provided on the final site plan. Rev 1: Comment not completely addressed,
as the easement plat has not been approved/recorded yet.Comments on the easement plat were sent to the
applicant on Dec 12,2016,pending a resubmittal.
2. [32.7 .1,4.6.1,ZMA95-20,ZMA79-32]Prior to final site plan approval the road plan(SUB2016-8) for the new
s tion of St. Ives Road shall be approved and built/or bonded.Rev 1: Comment not completely addressed,the
road plan appears to be nearing an end as most approvals have been received; however,it is suggested that
the approval of the road plan be held off till the easement plat across Ray Beard's property be approved
(as this is the document which locks down the entrance location as proposed).Comments on the easement
plat were sent to the applicant on Dec 12,2016,pending a resubmittal.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Collins Engineering, most
recently revised 6 October 2016, and find it to be generally acceptable.
This office will sign the plans upon review of the appropriate signed and sealed approval copies.
Please allow for this office to obtain two signature copies.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process. If further information is

Nena has been asking around about bonding for the recreational area and I've been meaning to speak to Zoning
about it. Attached are the proffers for Briarwood, see proffer#4, excerpt provided below, which provides the
bonding option for the improvements associated with the Primary Recreational Area Site Plan. Is bonding of an
entire site plan truly feasible? I hope so bc that the option provided for in the proffer and the route Nena wants
to go.

While the recreational area final site plan may appear to be nearing an end, it has a bunch of loose ends which
must be completed b4 approval. I'll list a few of the big ticket items: (1) The road plan for phase 4 which
includes the portion of St/. Ives fronting the rec area is not approved/bonded yet -this road plan needs to be
finished up 1St bc it is needed to provide access to the recreational area. (2) The easement plat into the site
across Ray Beard's property is not yet approved/recorded yet—this is needed prior to final site plan approval
otherwise they don't have access to the recreational area over Ray's property (3) The subdivision plat for the
