Subject: SUB201800088 Briarwood - Phase 6 Final Subdivision Plat
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-203(I), 14-218] The public notification fee of $362 was not paid prior to the SRC meeting. Preliminary
approval shall be held till the notification fee is paid. Please pay the fee prior to any further action on the plat.
2. [ZMA2005-9, Application plan] Label the open space areas in phase 6 as “Passive Recreational Area
consisting of walking/jogging trails”. Final: Comment addressed.
3. [14-302(A)4&5] Easements. Provide the deed book and page references for all existing easements, including
the existing trail/access easement. Also, provide the dimension of the trail/access easement. Final: Comment
addressed.
4. [Proffer 1] The maximum dwelling units permitted in Briarwood is 661. Proffer 9 provides a table for the
proposed lot mix. A table providing the existing and proposed dwelling units by section must be provided on
the final plat and updated with each submittal. Final: Comment addressed.
5. [14-303F] Identification of sections, blocks, and lots. Revise sheet 1 to correctly label Lots 57-60, as these
lots are truly Lots 34, 35, 36, and 36A in phase 6 which were approved under SUB2016-94 on 8-15-16. Also,
omit the inaccurate note over Lot 59 which states: “Lots 57-60 proposed w/ the phase 4 road plans
(SUB2016-08).” Final: Comment addressed.
6. [14-302(B)8] Yards. In addition to the setbacks provided on sheet 1 provide the following notes: “12’
building separation” and “No minimum lot area is specified”. Final: Comment addressed.
7. [14-302(A)12, 30.7] Steep Slopes Overlay District. Modify the managed and preserved slope note on sheet 1,
as it currently does not meet ordinance requirements for the overlay district in relation to the last portion of
the note: “…Any preserved steep slope areas that are modified during the field survey verification process
shall be updated developed as managed steep slopes per the design standards manual on the final plans.”
County Engineer sign-off on such topographic information is required prior to approval. Regardless of
whether the County Engineer is satisfied with the new topographic information or not, the labeling of the
slopes does not change. Final: Comment to be rectified on the WPO plan.
8. [14-302(B)10] Stream buffers. Label and depict the WPO buffer. Also add the following note: “The stream
buffers shown hereon shall be managed in accordance with the Albemarle County Water Protection
Ordinance.” Final: Comment addressed.
9. [14-311] Infrastructure improvement plans. Prior to final plat approval road plans and WPO plans serving
these lots shall be review, approved, and built or bonded. Final: Comment not addressed.

10. [14-317] Instrument evidencing maintenance of certain improvements. With the final plat submit an
instrument assuring the perpetual maintenance of the stormwater management facilities, sidewalk easement,
open space areas, and any other improvements that are to be maintained by the HOA in perpetuity. County
Attorney approval is required prior to final plat approval. Final: Comment not addressed.
11. [14-303] Contents of final plat. A plat meeting all the requirements for final subdivision plats per the
subdivision ordinance. Final: Comment addressed.
New Comments on the Final Plat
12. [Comment] Why is the sidewalk easement necessary? Staff prefers this land be dedicated to the County for
public use, so the sidewalks will all be maintained by VDOT. Please work with VDOT. Revise.
Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept
up to date by the County Attorney’s office. The Code may found on the County Attorney’s website which may be
found under “Departments and Services” at Albemarle.org.
In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a
revised final plat to address all of the requirements within six (6) months after the date of this letter the application
shall be deemed to have been voluntarily withdrawn by the developer.
