RESOLUTION TO APPROVE SPECIAL EXCEPTION
FOR ZMA 2004-024,OLD TRAIL VILLAGE
WHEREAS,March Mountain Properties,LLC(the"Owner")is the owner of Tax Map and Parcel
Number 055E0-01-00-000A1; and
WHEREAS,the Owner filed a request for a special exception to vary the Code of Development
approved in conjunction with ZMA 2004-024,Old Trail Village to reduce the minimum side setbacks in
Block 31.
NOW,THEREFORE,BE IT RESOLVED that,upon consideration of the foregoing,the executive
summary prepared in conjunction with the special exception request, staff's supporting analysis included in
the executive summary and the attachments thereto, and all of the factors relevant to the special exception in
Albemarle County Code §§ 18-8.5.5.3(c)and 18-33.9,the Albemarle County Board of Supervisors hereby
approves the special exception to vary the Code of Development approved in conjunction with ZMA 2004-
024,Old Trail Village,to reduce the minimum side setbacks in Block 31 subject to the condition attached
hereto.

Staff Report for Variation #32 from ZMA200400024 Old Trail Village
VARIATIONS FROM APPROVED PLANS, CODES, AND STANDARDS OF DEVELOPMENT
Each variation request has been reviewed for zoning and planning aspects of the regulations. Variations
are considered by the Board of Supervisors as a Special Exception under Chapter 18 Sections 33.5 and
33.9. Staff analysis of the variation request under County Code§ 18-8.5.5.3(c) is provided below.
VARIATION #32—To reduce the side setbacks within Block 31 from 10 feet to 7.5 feet:
Table 7 of the existing Code of Development for Old Trail Village requires a 10 foot side setback within
Block 31. The County approved a subdivision plat for Lots 1-7 in Block 31 with 10 foot side setbacks on
December 29, 2015(Attachment B). However, the applicant has requested approval of a reduced side
setback of 7.5 feet to be in keeping with existing and planned future development in Old Trail. Separately,
the applicant has submitted an amendment to the Code of Development(ZMA201500001)that proposes
7.5 foot side setbacks within Block 31, as well as Blocks 30, 33, 34 and 35(see Attachment C). Staff and
the Planning Commission recommended approval of this amendment with conditions at the Commission
meeting on December 15, 2015.
By making a separate application apart from the rezoning amendment, the applicant aims to avoid any
possible delay in the consideration of this specific request. Planning staff supports this special exception
request to have side setbacks consistent with other surrounding blocks and confirmed with the Building
Official, Fire Rescue Division and the Zoning Division that public health, safety and welfare would not be
impacted. Further staff analysis is provided below:
1) The variation is consistent with the goals and objectives of the comprehensive plan.
The variation is consistent with the comprehensive plan.
2) The variation does not increase the approved development density or intensity of
development.
Density is not increased.
3) The variation does not adversely affect the timing and phasing of development of any
other development in the zoning district.
The timing and phasing of the development is unaffected.
4) The variation does not require a special use permit.
A special use permit is not required.
5) The variation is in general accord with the purpose and intent of the approved rezoning
application.

VARIATION #32 RECOMMENDATION:
Staff recommends that the Board adopt the attached Resolution (Attachment D)approving the special
exception to vary the Code of Development to reduce the setbacks in Block 31, subject to the following
conditions:

Owner/Applicant Must Read and Sign
Each owner-initiated application for a zoning map amendment shall be
signed by the owner of each parcel that is the subject of the proposed
zoning map amendment, provided that:
a.An owner whose parcel is subject to proffers may apply to amend the proffers
applicable solely to the owner's parcel, provided that written notice of the
application is provided to the owners of other parcels subject to the same proffers
under Virginia Code §§ 15.2-2204(H) and 15.2-2302. However, the signatures of the
owners of the other parcels subject to the same proffers shall not be required.
b.An owner within an existing planned development may apply for a zoning map
amendment, and the signatures of any other owners within the planned development
is required only if the amendment could result in or require:
(i) a change in use, density or intensity on that parcel;
(ii) a change to any regulation in a code of development that would apply to
that parcel;
(iii) a change to an owner's express obligation under a regulation in a code of
development; or
(iv) a change to the application plan that would apply to that parcel.
The applicant must submit documentation establishing ownership of any parcel and the authority
of the signatory to sign the application on behalf of the owner.

Re: Old Trail Village Block 31 side setback variation request
Mr.Newberry,
The applicant would like to request a side setback variation to reduce the side setbacks for Old
Trail Village Block 31 from 10 feet to 7.5 feet. Attached are three copies of Table 7: Old Trail
Village Minimum Setbacks, which has been revised to reflect the setback variation request(see
highlighted cell).
With ZMA 2015-00001, which goes before the Planning Commission on December 15, 2015,
the applicant has reduced the setbacks in Blocks 30, 31, 33, 34, and 35 to 7.5 feet. This
reduction has been supported by staff and is in keeping with existing development at Old Trail.
Furthermore, this variation meets each of the parameters established in Section 8.5.5.3.c. as it(1)
is consistent with the goals and objectives of the comprehensive plan; (2) does not increase the
approved development density or intensity of development(3) does not adversely affect the
timing and phasing of development; (4) does not require a special use permit; and(5) is in
general accord with the purpose and intent of the approved application.

Staff Report for Variation#32 from ZMA200400024 Old Trail Village
VARIATIONS FROM APPROVED PLANS, CODES,AND STANDARDS OF DEVELOPMENT
Each variation request has been reviewed for zoning and planning aspects of the regulations. Variations are
considered by the Board of Supervisors as a Special Exception under Chapter 18 Sections 33.5 and 33.9.
Staff analysis of the variation request under County Code§ 18-8.5.5.3(c) is provided below.
VARIATION#32—To reduce the side setbacks within Block 31 from 10 feet to 7.5 feet:
Table 7 of the existing Code of Development for Old Trail Village requires a 10 foot side setback within Block
31. The County approved a subdivision plat for Lots 1-7 in Block 31 with 10 foot side setbacks on December
29, 2015(Attachment B). However, the applicant has requested approval of a reduced side setback of 7.5
feet to be in keeping with existing and planned future development in Old Trail. Separately, the applicant has
submitted an amendment to the Code of Development(ZMA201500001)that proposes 7.5 foot side
setbacks within Block 31, as well as Blocks 30, 33, 34 and 35(see Attachment C, Table 7). Staff and the
Planning Commission recommended approval of this amendment with conditions at the Commission meeting
on December 15, 2015.
By making a separate application apart from the rezoning amendment, the applicant aims to avoid any
possible delay in the consideration of this specific request. Planning staff supports this special exception
request to have side setbacks consistent with other surrounding blocks and confirmed with the Building
Official, Fire Rescue Division and the Zoning Division that public health, safety and welfare would not be
impacted. Further staff analysis is provided below:
1) The variation is consistent with the goals and objectives of the comprehensive plan.
The variation is consistent with the comprehensive plan.

2) The variation does not increase the approved development density or intensity of
development.
Density is not increased.
3) The variation does not adversely affect the timing and phasing of development of any other
development in the zoning district.
The timing and phasing of the development is unaffected.
4) The variation does not require a special use permit.
A special use permit is not required.
5) The variation is in general accord with the purpose and intent of the approved rezoning
application.

VARIATION #32 RECOMMENDATION:
Staff recommends that the Board adopt the attached Resolution (Attachment D)approving the special
exception to vary the Code of Development to reduce the setbacks in Block 31, subject to the following
conditions:
1. Lots 1-7 shall have 7.5 foot side setbacks.
