County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The VSMP application content requirements can be
found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. Update the Nature of Activity description. (Rev. 1) Comment addressed.
2. Include copies of the approved plans prior to the first inspection. (Rev. 1) Response noted,
comment addressed.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. The PPP exhibit will need to be included in the SWPPP prior to the first inspection. (Rev. 1)
Response noted, comment addressed.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. The Vue WPO plan and easement plat will need to be amended and approved prior to West Glen’s
approval. (Rev. 1) Response noted, however no submittal has been received.
2. The nutrient credits will need to be purchased before a grading permit is issued. Please contact
Ana Kilmer before purchasing the credits. The Lickinghole Basin will also account for 30% of the
remaining site load, not just 30% of the required reduction. (Rev. 1) Response noted.
3. Any Forest and Open Space used in the VRRM worksheet should be shown on the plans and
labelled as 'SWM Forest and Open Space'. The following note will need to be placed on both the
VSMP plan and the Easement Plat:

“The SWM Forest and Open Space Easement is subject to the guidance set forth by DEQ in the
Virginia Stormwater Management Program. The areas will remain undisturbed in a natural,
vegetated state, except for activities as approved by the local program authority, such as forest
management, control of invasive species, replanting and revegetating, passive recreation (e.g.,
trails), and limited bush hogging to maintain desired vegetative community (but no more than four
times a year).” (Rev. 1) Comment addressed.
4. The SWM Maintenance Agreement and the Forest and Open Space Plat and Deed will need to be
approved and the project will need to be bonded prior to issuing a grading permit. (Rev. 1)
Response noted.
5. The Lickinghole fee will need to be paid prior to issuing a grading permit and is usually done at
bonding. The current rate is $487.86/cfs. Credit is also given for on-site treatment. (Rev. 1)
Response noted.
6. Provide SWM sheets separate from the ESC sheets. The ESC measures and limits of disturbance
make it difficult to locate easements. (Rev. 1) Comment addressed.
7. Since it is in a water supply protection area, the stream buffer will need to be shown extending to
the limits of the floodplain where it is greater than 100’ from the stream (17-600B). This may
affect the required mitigation area. (Rev. 1) Comment addressed.
8. SCC-9 does not appear to outfall into a defined channel. Please relocate or show additional topo.

9. SCC-7 (sheet SW17) enters the existing channel at a 90 degree angle. Please adjust the angle or
provide additional measures to prevent erosion of the existing channel. (Rev. 1) Comment
addressed.
10. Outlet 33A (sheet SW16) does not outfall into a defined channel. (Rev. 1) Comment addressed.
11. The channel protection analysis will need to be shown for each point of discharge and not for the
site as a whole. For example, each natural channel receiving runoff from a pipe or SCC will need
to be shown as adequate to the limits of analysis (9VAC25-870-66B). (Rev. 1) Comment not
addressed. The drainage area where each SCC enters the stream will need to be shown to be
100 times greater than the SCC’s contributing area. Sheet 24 still shows the site as a whole
instead of each point of discharge.
12. The conveyance channels in the floodway will require a LOMR (18.30.3.10(A)3) and acceptance
by the Army Corps (Vinnie Pero) if they were not included on the previous LOMR. The FDP
application will also need to be updated. Also, provide copies of all permits from the Corps. (Rev.
1) Response noted. The FDP will still need to be approved prior to VSMP approval.
13. Provide a copy of the VRRM worksheet. (Rev. 1) Comment addressed.
14. Provide a post-construction maintenance schedule for the biofilters on the plans. (Rev. 1)
Comment addressed.
15. Buffer mitigation will need to be provided at a 2:1 ratio. The stream restoration after the existing
dam removal can count towards this, but will not completely offset the proposed crossing. The
mitigation areas should also be more clearly delineated on the plans (Mitigation Plan checklist).
(Rev. 1) Comment partially addressed. Since the mitigation cannot be done at a 2:1 ratio
within the buffer using new plantings, another approach is to identify areas in the buffer
that would benefit from the removal of dead and dying trees and invasive species.
D. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. On all slopes steeper than 3:1, specify a low-maintenance, non-grass groundcover which will not
require mowing (Design Manual). (Rev. 1) Comment addressed.

3. Any areas shown in a SWM Forest and Open Space Easement that are disturbed during
construction will need to be restored per DEQ BMP Specification No. 4, Soil Compost
Amendment. (Rev. 1) Comment addressed.
4. Include the Paved Construction Entrance detail on the plans. (Rev. 1) Comment not addressed.
The detail was not found on the ESC detail sheets. If I missed it on another sheet, please let
me know. Otherwise, the detail can be found in the Albemarle County Design Standards
Manual labelled as Paved Wash Rack.
5. Additional ESC measures may be requested by the Inspector during construction. (Rev. 1)
Comment addressed.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re-submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County’s
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County’s Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre-construction conference.
Applicants will need to complete the request for a pre-construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre-construction
conference will be scheduled with the County inspector. At the pre-construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
