[Comment] Several of the column totals in the cumulative overall development table are incorrect. Please revise this table and confirm the accuracy of the numbers being provided. Other columns may also need revision and will likely impact the percentage calculations. The development table has been updated to reflect the current plans. In doing this,we've tried to set the limit on what is expected and what we can approve. Please do not take this as a negotiation offer, it is not. Instead,we've realistically looked at what is needed to comply with the VSMP and without first amending the current property zoning. From that, I am offering the following as a set of guidelines to follow in development of a stormwater master plan that avoids the need to amend the zoning. To assist in understanding, I have attached Glenn's illustration at the end of this message. The following are what I believe are the important points: • Those areas that show onsite stormwater management( red on the illustration) must have facilities to capture at least 75%of this drainage area. That said,they do not need to be biofilters as indicated on Timmons plan, but could be another approved type of stormwater management facility. • Those areas that were shown as draining to the ponds within the approved zoning plan (blue on that illustration), but were not constructed to drain to them or have other reasons the ponds cannot be used, issues, must either have the storm sewer constructed so they correctly drain to the ponds as shown or may have other facilities within Old Trail to treat that runoff before it enters the stream.The same as the areas in red,we expect no less than 75%of the drainage area to be captured onsite for treatment.Obviously, if this requires you to propose changes to the approved layout plan,this will likely require either a variation to the plan 1 or a zoning amendment. In that case,we should talk with the planners about what changes staff will be comfortable in supporting. • Those areas that were shown as not having facilities to address the runoff(white on this plan)are allowed to have flow directly into the stream, but the water quality impacts must still be addressed. For all the areas not being routed through BMPs(this area plus uncaptured areas with the red and blue areas),a 30%reduction credit can be provided by Lickinghole. • With the above, our initial analysis indicates it should be possible to meet the phosphorus reduction required with the VSMP that apply to this property(2C). If it turns out the onsite facilities and the Lickinghole credit cannot meet the entire pollutant reduction,we will consider using the offsite ponds to address the incremental difference. That would need to be verified as genuinely providing a reduction above and beyond what was previously approved. • Finally, if there is an interest in using any of the County owned property for a stormwater facility, please recognize this will need to involve a number of people outside of Community Development. This will require additional time and effort to coordinate with Parks and Recreation,the County Attorney's Office,the County Executive's office and ultimately the Board of Supervisors to assure the County's interest in the property is being protected. Past experience suggests it will likely take 4-6 months to finalize an easement agreement with the County once everyone has agreed upon the recommendation.
