Owner/Applicant Must Read and Sign
Each owner-initiated application for a zoning map amendment shall be
signed by the owner of each parcel that is the subject of the proposed
zoning map amendment, provided that:
a.An owner whose parcel is subject to proffers may apply to amend the proffers
applicable solely to the owner's parcel, provided that written notice of the
application is provided to the owners of other parcels subject to the same proffers
under Virginia Code §§ 15.2-2204(H) and 15.2-2302. However, the signatures of the
owners of the other parcels subject to the same proffers shall not be required.
b.An owner within an existing planned development may apply for a zoning map
amendment, and the signatures of any other owners within the planned development
is required only if the amendment could result in or require:
(i) a change in use, density or intensity on that parcel;
(ii) a change to any regulation in a code of development that would apply to
that parcel;
(iii) a change to an owner's express obligation under a regulation in a code of
development; or
(iv) a change to the application plan that would apply to that parcel.
The applicant must submit documentation establishing ownership of any parcel and the authority
of the signatory to sign the application on behalf of the owner.

RE:Application for a Special Exception for Old Trail Village—ZMA 2004-024
On behalf of the owners of Old Trail Village, I am requesting a Special Exception to the Zoning Map for
ZMA 2004-024 concerning the location and type of Stormwater Management Facilities proposed for the
Block 11, 12, 14 and 15 drainage area.
On the approved ZMA plan,stormwater in this drainage area is proposed to be treated by both an
existing pond on the western edge of the property and by release across a stream buffer along the south
side of the drainage area into Slabtown Branch.
On currently approved WPO plans for this drainage area, stormwater is to be treated by conveyance
through a constructed bio-filter located at the southwest corner of the drainage area.
The purpose of this Special Exception request is to allow stormwater from this drainage area to drain to,
and be treated by, an extended detention water quality pond to be located at the southwest corner of
the drainage area.
The reason for this request is to better accommodate natural drainage patterns on the property and to
eliminate the need to build an oversized and high maintenance cost bio-filter to treat stormwater. The
proposed extended detention water quality pond will provide equivalent stormwater treatment in a
more aesthetically pleasing design that better fits with the existing landscape of Old Trail Village.

For the Site Plan for Block 12, Phases 1-3, we are requesting a waiver to allow for the lot size for
single family attached units to be below the minimum lot size specified in the Old Trail Village Code of
Development. The minimum lot size for Single Family units in Block 12 is 4,000 square feet.
What is the reason for each of the requested variations?:
The reason that we are requesting this variation is so that Block 12 will be able to achieve a higher
density by creating smaller single family lots. Note that the increased density in this Block will not
increase the overall density allowed for the Old Trail Subdivision.

For the Site Plan for Block 12, Phases 1-3, we are requesting a waiver to allow for the building height of
the single family attached units to be greater than the maximum building height specified for single family
units in Table 6 on page 30 of the Old Trail Village Code of Development. The maximum building height
for single family units in Block 12 is 2.5 stories.
What is the reason for each of the requested variations?:
The reason that we are requesting this variation is so that Block 12 will be able to have a total of 12
single family attached units that will act as townhouse units. With a larger building height, these
townhouse units will be able to provide families with a larger living space which will ultimately be more
comparable to the amount of living space found in single family detached units. Buildings taller than
2.5 stories will also produce a more aesthetically pleasing building architecture for this block.

For the Site Plan for Block 12, Phases 1-3, we are requesting a waiver to allow for variations in the
front, rear, and side setbacks for the Single Family Lots. We would like to have a reduced setback,
resulting in a 5' front, rear, and side setback for all of the detached Single Family Lots in Block 12. We
would like to have a reduced setback, resulting in a 5' front and rear setback, and a 0' side setback for
all of the attached Single Family Lots in Block 12.
What is the reason for each of the requested variations?:
The reason that we are requesting this variation is so that Block 12 will be able to have a traditional
neighborhood design with minimal setbacks. Old Trail was designed so as to create a sense of
community among the residents and to produce neighborhoods with aesthetically pleasing building
architecture. The reduced setbacks will allow for more variations in the design of the units, with larger
private yards. Ultimately, this will produce a close-knit neighborhood with a strong sense of community.

The reason that we are requesting this variation is so that the lots in Block 12 will be able to have
a larger buildable area, which in turn, will allow for more variations in the design of the units in this
Block. Ultimately, this will create a more aesthetically pleasing streetscape design.
