Subject: Old Trail Village NMD-Stormwater Management Master Plan
Glenn:
The changes to the stormwater portion of the application plan that we received on 4/15/15 will require
and is eligible for a variation under Section 8.5.5.3 (below). If any parcels will be affected by these
changes that are not owned by March Mountain Properties, LLC,the owner's of those parcels would
need to be a part of the variation application.
While Sheet 3 is primarily the focus of a potential variation,the following sheets of the Application
plan and sections of the Code of Development should also be updated and included as addendums with
any variation submitted.
• Note on Sheets 2 and 5:Existing forested area in the stream buffers to be preserved and
maintained. Street trees to be planted along Old Trail Drive.
• Sheet 2: Plan identifies Greenspace areas and 100' stream buffer areas
• Sheet 3: Stormwater Management and Stream Conservation-Conservation areas allow
stormwater management facilities.Preservation areas,which do not allow those facilities,were
not identified on the Old Trail Application Plan.
Conservation area: An area identified on a plan submitted for approval which contains
cultural assets or natural features such as non-tidal wetlands, floodplain, slopes
identified in the open space element of the comprehensive plan, or streams and stream
buffers,within which only limited disturbance or development is allowed. Uses allowed
in conservation areas include,but are not limited to, utilities, greenways,pedestrian
paths, streets, and stormwater management facilities,where, in the opinion of the
director of engineering, no other location is reasonably available and when these
improvements have the least impact possible on the environmental features of the area.

• Sheet 7 Conceptual Grading Plan-Shows existing impacted stream buffer areas and additional
impacts to streams
• Page 40, Code of Development note: Existing wooded areas along the south end of Old Trail
Drive shall be preserved and maintained.
• Page 40, The 150' buffer adjacent to Route 250 is considered a major element of Application
Plan and facilities should not be located within the buffer.
Section 8:
Review for compliance and conformance.A site plan or subdivision plat shall be reviewed to
determine whether it complies with the applicable regulations and other requirements of law,
and whether it conforms to the application plan,as follows:
1.Zoning administrator.The zoning administrator shall determine whether a site plan or subdivision
plat complies with the applicable regulations. In addition,the zoning administrator, after consultation
with the director of planning, shall determine whether the proposed permitted uses comply with the
applicable regulations and, in doing so, may permit as a use by right a use that is not expressly
classified in this chapter if the zoning administrator further determines that the use is similar in general
character to the uses permitted by right in the district or by the code of development and is similar in
terms of locational requirements, operational characteristics, visual impacts, and traffic,noise and odor
generation.
2.Director of planning. The director of planning shall determine whether a site plan or subdivision
plat conforms to the application plan. In determining conformity,the director shall determine whether
the central features or major elements within the development are in the same location as shown on the
application plan and if the buildings,parking, streets,blocks,paths and other design elements are of the
same general character, scope and scale as shown on the application plan.
3. County engineer.The county engineer shall determine whether an erosion and sediment control
plan, grading plan, stormwater management plan,road or street plan, and mitigation plan conform with
the concept grading, stormwater management, streets, and mitigation shown on the application plan.
The director of planning is authorized to grant a variation from the following provisions of an
approved plan, code or standard:
1.Minor changes to yard requirements, build-to lines or ranges, maximum structure heights and
minimum lot sizes;
2. Changes to the arrangement of buildings and uses shown on the plan, provided that the major
elements shown on the plan and their relationships remain the same;
3. Changes to phasing plans;
4. Minor changes to landscape or architectural standards;
5. Minor changes to street design and street location, subject to a recommendation for approval by the
county engineer; and
6.Minor changes to the design and location of stormwater management facilities,minor land
disturbance including disturbance within conservation areas,and mitigation,all subject to a
recommendation for approval by the county engineer.
