County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any
VSMP permit by issuing a project approval or denial. This project is denied. The rationale is given in
comments below. The application may be resubmitted for approval if all of the items below are
satisfactorily addressed. The VSMP application content requirements can be found in County Code section
17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain
(1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. Link to County template:

1. Sec. 1, Reizistration Statement —Revise to read South Fork Rivanna River; sign /date.
2. Sec. 4 /5 (ESC /SWM Plans) — Update these sections with revised plan sheets.
3. Sec. 9, Signed Certification — sign /date.

SWM Plan
1. Revise Title to read: VSMP Plan for Hollymead Town Center Hotel (eliminate word Site).
2. Stormwater Management: Relocate note that appears after Stage 4 sequence of construction to just after
Project Description. Revise note to reflect percent impervious proposed with HTC Hotel, which appears to
approach 100% of GIS -mapped TMP #32-41D5 (image below). If BLA has adjusted acreage of TMP #32-
41D5, provide recorded copy of plat. Adjust acreage to reflect increased parcel size, as GIS real estate
records correspond with plan information that area of parcel TMP #32-41 D5 is 1.97 Ac.
3. SWM Plan booklet
a. Update Open Space Exhibit, as required, to match recorded parcel acreage and boundaries —see
also comment C_2., below. It is essential that % impervious with this project not place adjacent
parcel/s (TMP #32-41D6, for example) at a future development impervious area ceiling deficit.
b. Open Space Exhibit appears to show off-site areas as turf /open space which may be included in
calculation of project overall site impervious area. Exclude all areas beyond project LOD. Revise
% impervious calculation and update booklet, VRMM .xls, and plan sheets, as necessary.

c. Confirm property boundaries as shown are accurate, consistent with recorded plats, established
boundaries, and county real estate records. Provide evidence that boundaries are accurate.
d. Transfer .PDF image of 5/4/18 Shimp Engineering booklet cover letter to plan sheet; this
information informs SWM plan review.

Provide SWM design for portion of proposed impervious area that exceeds water quality /quantity capacity
of future Regional Stormwater Pond, if needed, as required per 9VAC25-870-65 (Part IIB /water quality);
9VAC25-870-66 (quantity).
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. See A., above. Update Sec. 6 Exhibit, as needed.
C. Erosion and Sediment Control Plan (ESCP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan
is disapproved for minor reason outlined in single comment, below. The erosion control plan content
requirements can be found in County Code section 17-402.

a. ESC Note 11: revise last sentence to read: `Any sediment buildup shall be removed.'
b. General Note 10: Revise since Owner must obtain bonds, not the Contractor.
c. Sequence of Construction: Relocate Stage 2 items 4 and 5, to Stage 3, prior to item 2.
a. North boundary parcel TMP #32-41D5: does not match GIS real estate records; furnish recorded
deed with plat that establish north boundary of parcel matching boundary shown on plans.
a. VESCH Std. & Spec. 3.09, Diversion Dike
i. "The channel behind the dike shall have a positive grade to a stabilized outlet." Provide
positive grade by shifting south end of dike west, more interior to the site. Dike shown
includes slight uphill portion, and appears zero grade over a distance of 200'. Revise
design such that sediment -laden runoff from site interior reaches the sediment trap.
ii. Provide SF behind relocated portion of DD.
iii. Where DD parallel with road exceeds 2%, provide stabilization in accordance with
VESCH Std. & Spec. 3.17 (ref. VESCH p. III -54).

Process
Immediately upon plan review approval, contact County Management Analyst to discuss nutrient credit purchase
requirements prior to purchase of nutrient credits. Ana Kilmer will provide critical guidance prior to purchase.

VSMP plan approval requires recorded permanent drainage easement between new or proposed on-site BMP (UG
detention, for example) and existing (future) Regional Stormwater Pond. VSMP Plan approval also requires Applicant
provide circuit court copy of recorded SWM Facility Maintenance Agreement. If an existing SWM Facility Maintenance
Agreement for the future Regional Stormwater Pond includes current owner/developer of parcel TMP #32-41D5, provide
copy of legal instrument ("Agreement'') which establishes shared or pro -rated SWM facility maintenance responsibilities of
the owner of TMP #32-41 D5.
Plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to
the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel
and easement information based on the approved plans. The County's Management Analyst will prepare bond
agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or
sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney
and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded (see
above). The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local VSMP
authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state.
For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify
applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit
coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the
application fee. The form identifies the contractor and responsible land disturbed, and the fee remaining to be
paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled
with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint
VSMP and grading permit will be issued by the County so that work may begin.
