Hello SRC members and fellow plan reviewers,
I am writing to notify you that the Initial Site Plan for Avinity Estates (SDP-2017-66) has been administratively
approved, with conditions.
As you know, the applicant recently submitted revised Initial Site Plans (resubmittal dated 1/22/2018), which were then
transmitted to you at the beginning of February. However, please note that this administrative approval was made for
the original submittal (Initial Site Plan dated 11/6/17).
Instead of resubmitting another Initial Site Plan inclusive of revisions, the applicant will now continue to make revisions
(based on comments received during the SRC process) and will submit them as a Final Site Plan in the near future.
We will then transmit the Final Site Plans for Avinity Estates to you whenever we receive them.
Thanks very much to those of you who have already reviewed the revised Initial Site Plans. For those of you who have
not yet reviewed the revised Initial Site Plans (transmitted 2/1/2018), please do not do so, it is no longer necessary.
If anyone has any questions or would like to discuss this, please just let me know. I can also provide a copy of the
letter of approval if you need or want those details, as well.

Hi Scott,
Thank you for the follow-up message, and thanks for conveying this request for a deferral. Noted.
You probably know this — but as a reminder, this request for a deferral gives you 6 months of "deferred" status from
today's date, before it would automatically become "withdrawn" if there's no other steps taken. However, I understand
your intent is to go through the ARB meeting next Monday (1/8), and then proceed with addressing the review
comments from ARB and from SRC — so the 6 -month limit doesn't seem to be a factor with this project. (I just wanted
to share that as a reminder / FYI.)

Hello Scott and Graham,
I'm writing to follow up with you re: Avinity Estates initial site plan after the SRCmeeting this morning.
I apologize in advance for the length of this message-but since I was unable to reach you by phone, and since I will
be out of the office for the holidays, I wanted to provide this information as quickly as possible.
As you may know, in many cases, initial site plans are granted conditional approval within one day of the SRC meeting.
In other cases, initial site plans are denied within one day, and in those situations the applicant then has 15 days to
resubmit revised initial site plans (or the application is considered "withdrawn").
I'm pointing that out because the SRC review of the Avinity Estates initial site plan has led to notable issues being
identified, and I am not able to address and resolve these within -1 day. I was hoping to discuss these issues and
variables with you and get some feedback from you, prior to taking any action to approve with conditions or to deny.
The primary issue is the Bergen Street ROW-the need to extend that ROW to the property boundary for interparcel
connectivity to the south (to achieve general accord with ZMA application plan). During the SRC meeting today, it
appears as though there are some issues with the width of that ROW(including questions about what width is required
by the County per Code and per general accord with the approved application plan for ZMA 2013-16; and also
questions or concerns about what improvements can be implemented by the applicants/developers within the available
dimensions of the current site layout).
These questions related to "ROW width" and "general accord"with the ZMA application plan will require coordination
with both Engineering and Zoning before I can specify the required width and features, or to identify what possible
alternative steps might be available (such as requesting a variation, etc or waiver or special exception, etc.).
Additional issues include:
- several proposed features or details that would require variations to be approved by the BOS, and the
uncertainty that is associated with relying on BOS approval of variations in order for the site plan to be
approved;
- ARB staff concerns involving areas within the entrance corridor; and ;�-
- deferral of ARB meeting until 1/8/18 (after the SRC meeting, instead of prior to SRC which is typical)
These site plan issues are compounded by the fact that almost all pertinent CDD staff are unavailable today and/or out
of the office for the holidays. And I will be out of the office for the holidays starting momentarily. These present realities
limit my ability to properly complete this review and take appropriate action within one day.
With all-of-that 41 i ;11mfeas#inq out to gauge your thoughts on the possibility of a deferral.
This approach (deferral) would allow you to go to ARB on 1/8/18 prior to Planning staff having to take action on the
initial site plan (without the benefit of ARB action, which is unusual); and this approach would also allow Community
Development staff sufficient time to review the details of the ROW width and general accord questions (and address
other questions raised during the SRC meeting this morning).
Additionally, a deferral would also eliminate two possibilities that may not be considered ideal:
- The possibility of taking action to conditionally approve the initial site plan, but with conditions so
major/extensive that they might not be able to be resolved without modifying the site layout; and
- The possibility that the initial site plan is denied, which would mean that a revised initial site plan would have to
be submitted in 15 days (or no later than January 5th) to avoid the application being deemed "withdrawn" (and
to avoid having to re-apply, with new fees, and with new submittal dates and review periods, etc.).

All things considered, I do believe aerral of a set, definite length (of your choosing) is probably the most
constructive next step at this time.
As noted in my initial remarks, I believe this situation is best addressed through a phone call or an in-person meeting;
but given the context, I wanted to update you immediately and share all of this info while it's fresh. So once again,
apologies for the length of this message, and I regret not being able to discuss this interactively.
I will return to the office next Wednesday 12/27 and will continue the coordination and research on issues identified
above with other CDD staff. And I will be available to reconnect on these issues then, or anytime thereafter. If nothing
else, I will need to take action on the initial site plan no later than January 5th.

to RWSA during the review.
