As requested, I've reviewed the site plan amendment, dated November 22, 2017, for the
proposed facility, referenced above. It does not appear that any of the deviations from
the previously approved site plan (SDP2015-40) have had any effect on the approved
drainfield area or abandonment of the existing well.

Andy and I just examined the Major Site Plan Amendment
for Virginia Asphalt Services .
We made the observation that the Conditions for SP2014 -
19 are listed under the column entitled "Project
Data" . With one exception, which I will address later ,
this column appears to be a recitation of facts related
to the Site Plan Amendment rather than enforceable
notes . If that is the case ( this column is more
descriptive rather than a list of mandatory conditions
for the Amendment ) , then we don' t see a need to put a
note next to the SP Conditions . If they are
descriptive , then the verbiage on the document is
accurate . Do you want me to come pick up my plan set ? Am
I free to proceed without any notes or anything
additional ?
The one question we had deals with the "Project Data"
column and the Heading entitled "Trash" . This item
states , "Trash Containers to be Stored Inside of
Building" . Should that be in the General Notes under
Performance Standards? With our current ordinance we
have no standard criteria for where information is to be
located on the site plan, such a note could be placed
anywhere on the plan, as long as it ' s on the plan we
move on . For the fast track review process Francis and I
are helping to develop standards for submittals ,
templates that standardize location of all required
information . But until then, I don' t see this as
something we can inforce or truly care about .

Yes, I would like the County Attorney's office to draft a note for the plan, if this is a legally acceptable way to remedy the
issue.
Prior to final site plan approval, the WPO must be approved. Engineering is currently awaiting a resubmittal. Once they
revise the WPO to submit and the calcs come back(should be a quick review),then the site plan can be approved
provided we straighten out this EC and SP situation w a note of some sorts.

First, we need to have a larger discussion on the legal guidance for this issue. Agreed, but I hope it will not have to take
place prior to the approval of this plan.
Second, I am of the mindset that if the use was not required to get the SP, then any action that we have taken is
unenforceable and should be removed from any site plan referencing it. But it is unclear to me what the legality is of

these actions that were taken that should have never been taken. How about we have the applicant strike through the
condition from the SP for outdoor display and storage on the site plan. Because if it is left on there it is going to be very
confusing in the future when the plan is approved without these conditions being adhered to.
Also, I suggest the EC zoning listed on the site plan be striked through. Then place a new note written by legal, which we
will place under it as a disclaimer: "3-1-18 Based on the property is no longer in the EC thus the SP conditions
for outdoor storage and display no longer are in effect or being enforced. If and at such time that the EC is reinstated, if
the site comes in for a site plan amendment the site will need to adhere to these conditions at that time, which primarily
deal with landscaping requirements."
Possibly the County Attorney's office could draft this note, if they deem it acceptable.
Lastly, to answer Andy on the use question, I think that outdoor storage of materials for a by-right primary use would be
considered an accessory use which is permitted per 26.2 c. Agreed

Good question. As you noted, County Code§ 18-30.6.3(a)(2), on which Virginia Asphalt's SP was
apparently based, requires an SP for outdoor storage, display and/or sales in the EC overlay district. (FYI, here's
the Executive Summary from Virginia Asphalt's SP and SE.) Assuming that Virginia Asphalt's underlying zoning
does not also require an SP for outdoor storage, display and/or sales, then I agree with your highlighted

The above ref site plan is subject to SP2014-19 which is approved with conditions(attached). The SP request was for a SP
under Zoning Ordinance Section 30.6.3.a(2)for outdoor storage, display and/or sales for an equipment storage yard
associated with a contractor's office for an asphalt paving company and predicated on the EC. (No dwellings proposed.)It
also contained a special exception to 5.1.52 Outdoor Storage in Industrial Districts is also requested to allow landscape
screening in place of solid fencing around the storage area.
My question: Does the SP and its conditions for Section 30.6.3.a(2)remain in effect?
My answer: I believe it remains in effect; however,we will not be enforcing the conditions related to this portion of the
SP. However,the SE to Section 5.1.52 and it's conditions listed on sheet 2 of the action letter should remain in effect and
be enforced.
Please confirm I am correct or set me straight with the correct answer.

Thanks for getting back to me. It looks like the plan is for the SRC to
review our submission, and then the SRC can let us know what is approved and
what, if anything, we need to fix. The procedure now is to for VAS to wait to

Since traffic calming is one of the topics of discussion Frank P. has requested that VDOT be included in the meeting.
We want to avoid specifying traffic calming measures that VDOT will not agree to.
Because of this the meeting day and time (Thursday 3/1/18 @ 4PM) is still tentative. All County employees have
confirmed attendance and I have reached out to Adam to see if VDOT is available at that time.

Good question. As you noted, County Code§ 18-30.6.3(a)(2), on which Virginia Asphalt's SP was
apparently based, requires an SP for outdoor storage, display and/or sales in the EC overlay district. (FYI,here's

The above ref site plan is subject to SP2014-19 which is approved with conditions(attached).The SP request was for a SP
under Zoning Ordinance Section 30.6.3.a(2)for outdoor storage, display and/or sales for an equipment storage yard
associated with a contractor's office for an asphalt paving company and predicated on the EC. (No dwellings proposed.)It
also contained a special exception to 5.1.52 Outdoor Storage in Industrial Districts is also requested to allow landscape
screening in place of solid fencing around the storage area.
My question: Does the SP and its conditions for Section 30.6.3.a(2)remain in effect?
My answer: I believe it remains in effect; however,we will not be enforcing the conditions related to this portion of the
SP. However,the SE to Section 5.1.52 and it's conditions listed on sheet 2 of the action letter should remain in effect and
be enforced.
Please confirm I am correct or set me straight with the correct answer.

perimeter curbing and re-installation of the paving limits that more closely matches
originally approved site plan (pulled away from the critical slopes). The equipment
storage area square footage callouts have been revised on the sheets.

5. The number of employee discrepancies have been corrected on the Cover Sheet. To

Re:Virginia Asphalt Services Major Site Plan Amendment
Megan and Chris,
The recent Major Site Plan Amendment application for Virginia Asphalt Service is essentially
documentation of an "as-built" plan versus "approved" plan and/or request for approval of
the variations from the approved plans.
• Due to poor structural soils,this building and site is 2' higher than approved.
• Due to the adjusted site grading,the outlet of the parking drainage location was
altered. Is the location/treatment adequate?What corrective measures should be
installed.
• The perimeter of the parking area adjacent to the stream buffer limits was expanded
so the parking area is larger than approved. The approved limits are shown on the
plans. Are these limits acceptable or should the owner remove additional paving?
These approved limits are marked on the pavement on site.
• The VDOT entrance improvements were not constructed exactly as shown on the
approved plan but were installed with direction and approval of the VDOT Inspector,
who is no longer with VDOT.
• Asphalt curb was used instead of concrete. Is this acceptable or should it be
corrected.
• The execution of the landscape plan was not exact. Some corrective measures have
occurred, but in some cases, proper tree caliper and species were not as specified.
Now that it is installed and can be visually inspected, does the landscape accomplish
the proposed intent.
• ARB input required.
• An amended VSMP plan was submitted but there was minimal impact on the
approval.
