Attached is the action letter for the above ref plan.The previously submitted variations are under review and shall be processed prior
to final site plan approval. As discussed over the phone you plan to submit a 51h variation to the code(for guest parking spaces for SFD
lots)...based on the reviewers needed to review this aspect of the plan(planning and zoning),please submit the variation by August
18th and we will review/consider it during the same review as the others.

Thank you for fielding my SRC item yesterday. Petey is doing better(the fever has left him)but as discussed now my
throat is hurting !!!
Anyways to follow-up on our conversation from this morning, I offer the attached explanation in defense of keeping
comment#8; however, if you and David determine it is not required based on the ordinance or long standing County
practice I will move on,but know that I always comment on this every time we have guest parking regardless of where the
spaces are located based on the ordinance. It just makes good since that we require on-street parking spaces to be striped
or signed, otherwise the residents and their guests don't know the spaces exist unless they pull the site plan.Notably,
guest spaces are required spaces for the use.Anyways see the attached(pay special attention to the comments in the word
doc to the right). Let me know whenever. I have to take an action on this plan by August 4"'

I offer the following explanation in defense of keeping comment#8;however,if you and David

8. 14.12.61 Parking Requirements.Dimension the guest spaces.Additionally,depict and label signage or
striping that identifies and preserves these spaces.The minimum dimensions for parallel parking
spaces is 9'x20'.
I offer the following explanation using the ordinance:
]Sec 4.12.61 Multi family units,including duplexes,single family attached,and townhouses,but excluding
student suites:2 spaces/unit.In addition,if parking is provided on individual lots,such as for duplexes
and single family attached townhouses,rather than in lots or bays that are shared by all units in the
development,then one(1)guest space per four(4)units shall be provided.
14.12.16(d)1 Minimum Design Requirements and Improvements for Parking Spaces within iParking Areas[ ---- Commented[CP1]:If your stance is that on street parking
or Parking Bays.Delineation of parking spaces.Parking spaces shall be delineated in a manner that is technically not within a"Parking Area",begrudgingly I'll

14.12.91 Street and Alley Parking.Street and alley parking may be provided as follows: Commented[CP3]:More succinctly these on street
a.Street parking consists of parking spaces located in a public or private right-of way.Each parking space spaces could be characterized as"Stand Alone Parking";
however,under 4.12.8 under alternatives permitted it

7. 14.12.8,4.12.8(e)1 Instrument Assuring Continuation of Oft-site Parking.Off-site shared parking is
provided(in the form of guest spaces along the street).Prior to final site plan approval the applicant
shall submit an instrument that restricts the use of that part of the land on which parking is provided
to that use,and assures that a minimum number of parking spaces as required by this section shall be
established and maintained for the life of the use.The instrument shall be in a form that is suitable for
recording,shall be subject to review and approval as to form and substance by the county attorney,
and shall be recorded in the office of the clerk of the circuit court of the counts before the site plan is
approved. OR Pursuant to 7.3 of the Code of Development a shared parking plan may be
submitted by the owners at the time of submission of a site plan and shall be reviewed by the Zoning
Administrator in accordance with Section 4.12 of the Zoning Ordinance(a"shared parking plan").
]4.12.8]Alternatives Available to Provide Minimum Number of Parking Spaces.The alternatives
described herein are intended to promote more creative design,allow higher density in those zoning
districts in the development areas,and reduce impervious area by allowing the parking requirements of
this section to be satisfied,in whole or in part,by street parking,shared parking,and off-site stand alone
parking.In addition to all other applicable requirements of this section,the following requirements shall
apply to the parking alternatives provided in sections 4.12.9,4.12.10 and 4.12.11:
e.Instrument assuring continuation of off-site parking.If stand-alone parking or off-site shared parking is
to be provided,the applicant shall submit with the application for a site plan,site plan waiver or,if a site
plan is not required,with an application for a zoning compliance clearance,an instrument that restricts the
use of that part of the land on which parking is provided to that use,and assures that a minimum number
of parking spaces as required by this section shall be established and maintained for the life of the use.
The instrument shall be in a form that is suitable for recording,shall be subject to review and approval as
to form and substance by the county attorney,and shall be recorded in the office of the clerk of the circuit
court of the county before the site plan or site plan waiver is approved.As the parking requirements for
the use or structure change,subsequent instruments may be submitted,reviewed,approved and recorded
that rescind or modify the prior instrument.
