Attached please find the revised drawings. I'll bring four (4) hard copies this afternoon.
• We've revised the turnaround space to 20'x 20' to comply with the Fire Rescue Comment from Mr. Maddox.
(See Sheet(s): C-2, C-4, C-5, and C-6)
• We've included the preserved slopes on the plans to comply with Engineering Comment from Mr. Pohl. (See
Sheet(s): C-1, C-2, C-3, and C-5) It should be noted that the preserved slopes will not be impacted by this
proposed project.
It should also be noted that we've decided to leave the utility easement as it was previously shown.

We're going to revise the drawings now. The proposed utility easement will now go around the church on the opposite
side instead of following the access easement. No additional trees will be impacted by this change.

I believe we are around Day 40 of the review (SRC was on day 43, today would be Day 50, the project was
tolled for 10 days after the incompleteness letter). So by my estimate, there are around 20 days of review time
left before the County has to act under the ordinance (60 days).
I'll need to check about when the utility easement should be revised.

Good Morning Andrew and Margaret,
It's taking the engineer longer than expected to make the revisions based on Mr. Pohl's (Engineering) comment
and Mr. Maddox's (Fire and Rescue) comment. I am hopeful to have the revisions today. When do you need
the revised drawings returned to you for final approval?
Margaret,
I know it was discussed at the ARB meeting to look into alternative tree species for screening around the
compound, does this need to be revised on the drawings at this time? We're showing landscaping (Leyland
Cypress) currently.
Lastly,
I've been asked by the client yesterday to see if it's possible to shift the utility easement (Attached please see in
red the new possible route, See Sheets C-4 and C-9). *It should be noted that they marked up an old set of
drawings so don't be alarmed by the tower height on the plans, it's incorrect* Currently the utility easement is
within the access easement. If it's possible to shift the easement will these changes need to be included on the
Tier II drawings or is this something we can handle with the Construction Plans.

Hi Ryan,
I just had the chance to check in with Margaret. Here's what we figured out for next steps:
Revised drawings only — PDF and ten (10) hard copies (ARB needs 6, plus the others for reviewers &
signatures)
o Margaret is putting together her staff report for the ARB using the specs for the current proposal
so she can get it sent out, but will include a note stating the new height and will have the new
copies for the meeting.
The balloon test at 113' is satisfactory for the new height.
Assuming that we'll have a PDF copy of the drawings when they're finished, we don't have an immediate need
for the hard copies: feel free to bring them to SRC on Thursday morning.
Frank Pohl (Engineering) had the following comments: I would advise that your revised drawings include the
bolded information so we can hopefully make this the last revision.
o - Show preserved slopes on the Proposed Site Plan to ensure the slopes are not being
impacted.
o - Applicant shows a total land disturbance of 3,068 sf, therefore VSMP permit is not required.

I've spoken with the RF engineer and we will reduce the tower height to 100' and continue to proceed with this
application as scheduled.
Can you let know if you would like me to revise the complete submittal package or if we can just revise the
drawings?
Lastly, regarding the balloon test can you confirm that the balloon test that was completed on 2/6 at 113' will
satisfy the new tower height of 100'?
I will have the changes made and turned around as soon as possible, probably no later than Wednesday as I
know the SRC meeting is Thursday morning.

Hi Ryan,
Just following up from our call earlier. Here are the applicable sections of the Zoning Ordinance:
4.10.3 HEIGHT LIMITATION --EXCEPTIONS
The following exceptions to height limitations for certain buildings and structures shall be permitted provided
that no building or structure shall be exempt from the requirements of section 4.10.2.2.
4.10.3.1 EXCEPTIONS --EXCLUDED FROM APPLICATION The structures identified below shall be
subject to height limitations as follows:
a. The height limitations of this chapter shall not apply to barns, silos, farm buildings, agricultural museums
designed to appear as traditional farm buildings, residential chimneys, spires, flag poles, monuments,
transmission towers and cables, smokestacks, water tanks, or radio or television antennas or towers.
b. Any structure identified in subsection (a), other than one now or hereafter located on an existing public utility
easement, shall not:
(1) be located closer in distance to any lot line than the height of the structure; and
(2) within a residential district, exceed one hundred (100) feet in height, except for
telecommunications facilities owned or operated in whole or in part by the county, which shall not exceed one
hundred fifteen (115) feet in height.
Comment: The proposed personal wireless service facility is located in the R-2 Residential zoning
district, is over 100 feet in height, and is privately owned/operated, so it cannot be approved administratively.
c. The commission may modify or waive either requirement of subsection (b) in an individual case if it
determines that the public health, safety or welfare would be equally or better served by the modification or
waiver. In granting such modification or waiver, the commission may impose such conditions as it deems
necessary to protect the public health, safety or welfare.
Comment: This would require a Special Exception request that would be subject to approval by the
Board of Supervisors under Section 33 of the Zoning Ordinance. Although the language mentions the
commission, it predates a court decision that removed this ability from their authority.
d. The board of supervisors shall consider a modification or waiver of this subsection only as follows:
1. The denial of a modification or waiver, or the approval of a modification or waiver with conditions
objectionable to the developer may be appealed to the board of supervisors as an appeal of a denial of the plat,
as provided in section 14-226 of the Code, or the site plan, as provided in sections 32.4.2.7 or 32.4.3.9, to which
the modification or waiver pertains. A modification or waiver considered by the commission in conjunction
with an application for a special use permit shall be subject to review by the board of supervisors.
2. In considering a modification or waiver, the board may grant or deny the modification or waiver
based upon the finding set forth in subsection (c), amend any condition imposed by the commission, and impose
any conditions it deems necessary for the reasons set forth in subsection (c).

application from here (reduce height to 100', Special Exception, etc) and feel free to give me a call if you have

I represent Shenandoah Mobile, LLC ("Shentel"), and we submitted a Tier II Personal Wireless Service Facilities
(PWSF) application to Albemarle County for a proposed 113 foot wireless communications tower ("cell tower")
located on the above referenced parcel. Pursuant to Section 5.1.40(a)(6) of the Albemarle County Zoning
Ordinance, we are required to perform a balloon test (raising a balloon to the height of the proposed tower) to
demonstrate the visibility of the tower.
Please be advised of the day and time for the balloon test (and rain date) should you wish to attend:
