When resubmitting the plans, the private street fee will need to be paid. (Rev. 1) Comment addressed. 2. Include a copy of the easement or agreement for the offsite work on Pebble Drive. (Rev. 1) Comment not addressed. 3. Show a minimum 10’ easement on all yard drain systems. (Rev. 1) Comment addressed. Planning – Tim Padalino 1. [Application Plan (ZMA201300016)]: The road plans appear to be in general accord with the major elements of the ZMA application plan. 2. [Z.O. Sections 32.6.2(a) and 32.5.2(a)]: Add application number (SUB201800018) to the title on Sheet 1. 3. [Variations for ZMA-2013-16 and Z.O. Sections 32.6.2(a) and 32.5.2(a)]: Revise the “Zoning” information on Sheet 1 to include a reference to the Special Exceptions (Variations) approved by the Board of Supervisors (BOS) on 3/7/2018. 4. [Variations for ZMA-2013-16 and Z.O. Sections 19.9 and 4.19]: The “Setbacks” information on Sheet 1 must be revised to correctly reference the one (1) foot maximum encroachment within the modified front yard setback area, per Condition #2 of the approved Special Exception (Variation). 5. [Variations for ZMA-2013-16]: Revise the “Landscaping” information on Sheet 1 to state that “all [street] trees shall located outside of the ROW within a 6’ wide landscaping and maintenance easement…” The note currently specifies a 5’ wide easement, which is not permissible per Condition Engineering Review Comments Page 2 of 2 #3 established by the BOS during their approval of the requested Special Exceptions (Variations) on 3/7/2018. 6. [Application Plan (ZMA201300016) and Z.O. Sections 32.6.2(j) and 32.7.9.5(d)]: Revise Note 5 on Sheet 1 to remove the incorrect reference to street tree spacing requirements (“50’ O.C.”), and insert the correct reference (40’) to street tree spacing requirements for the proposed “medium” street trees (as proposed on the Landscaping Plan sheets for corresponding Final Site Plan SDP201800035). 7. Advisory: [Application Plan (ZMA201300016) and Z.O. Sections 32.6.2(a) and 32.5.2(i)]: An access easement must be provided for the emergency access roadway between the property and Scottsville Road. Alternately, if this access easement (“Emergency Access – 20’ Access Easement” – Sheet 3) currently exists, please add a note or label to reference the instrument number and/or deed book and page numbers. 8. Advisory: [Application Plan (ZMA201300016) and Z.O. Sections 32.6.2(a) and 32.5.2(i)]: An access easement must be provided to grant public access on the proposed private streets and to grant access within and through Avinity I all the way to Avon Street. Establishing such an access easement(s) to a public right of way (Avon Street) must occur prior to final site plan approval (SDP201800035). 9. Advisory: [Application Plan (ZMA201300016) and Variation for ZMA-2013-16]: Easements for the proposed five (5) foot “landscaping and maintenance easement” along the project boundaries and for the proposed six (6) foot “planting strip” adjacent to the private streets right-of-way must be established in conjunction with the final plat. ACSA – Richard Nelson 1. ACSA is waiting for dedication of water and sewer utilities in Avinity 1, Phase 2 and Avinity 1, Phase 4 prior to SUB2018-00018 - Avinity Estates - Road Plans approval. Fire Rescue – Shawn Maddow 1. The cul-de-sac still does not appear to be 96'. All other conditions have been met. VDOT and E911 have no objection to the current plans.
