Albemarle SPCA) Rio Magisterial District
Dear Mr. Pennetti:
This letter is in response to your request for a parking determination for the SPCA Animal
Shelter dated April 26th, 2018. As animal shelters are not a specifically identified use per Section
4.12.6 of the Zoning Ordinance, the Zoning Administrator is permitted to determine the minimum
number of required parking spaces for these unscheduled uses.
The SPCA facility primarily operates as an animal shelter, with some accessory uses supporting
the SPCA in its mission including veterinary services and community training and support
activities. The stated goal of the proposed expansion is to "primarily [support] existing uses
(additional kennels and an intake for animals) and [provide] a new clinical area to support the
animals".
As described in your request, the SPCA utilizes 53 onsite parking spaces approved pursuant to
its prior final site plan, as well as 25 additional off -site parking spaces that are shared to support
the SPCA during peak times, for an existing total demand of 78 spaces. The proposed major
site plan amendment (SDP201800023) provides a total of 97 parking spaces, an increase of 44
spaces beyond what is currently provided on -site, and an increase of 19 spaces from the
reported existing demand.
As our furry friends cannot drive, an increase in kennel area would not seemingly cause an
increase in demand for parking unless staffing was changed to accommodate an increase in
animals. In our correspondence dated May 41h, 2018, you specified that the peak anticipated
staffing would be as many as 55 employees and 20 additional volunteers, for a total of 75.
Additionally, it was indicated that the proposed expansion is meant to support existing
operations, but continued growth of visitors could be reasonably expected as the community
and organization both grow.
Given the nature of the use and proposed expansion and the demonstrated existing
parking demands, it is my determination that the proposed 97 parking spaces are
sufficient to adequately support the development. Any further changes or expansions of
the use will require a new parking analysis and determination.

If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this
determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and
the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a
fee of $258 plus the actual cost of advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia
22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of
the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
