Tax Map 65 Parcel 84 currently has (5) Development rights
New Parcel 'A' is assigned (1) Development right and may
be further divided and when further divided this right shall not
comprise more than 6.2 acres.
The Residue of Tax Map 65 Parcel 84 is retaining (4)development
rights and may be further divided and when further divided these
rights shall not consist of more than 24.8 acres.
If all 5 development rights were utilized the total aggregate acreage
using deveopment rights cannot exceed 31 acres.
Tax Map 65 Parcel 84 is covered by a Conservation Easement recorded
at Deed Book 3101 pages 462-475, which states under the Grantor
Covenants, Section 3, DIVISION, that the property shall not be divided
or subdivided into, or separartely conveyed as more than three(3)parcels.
Boundary line adjustments with adjoining parcels are permitted and
shall not be considered a prohibited division of the property, Provided
that the Grantee is made party to the applicable deed of any such
boundary line adjustment and one of the following conditions is met:
(i) The entire adjacent parcel is subject to an existing, recorded
open -space easement conveyed to the Grantee, or (ii) The boundary
line adjustment is reviewed and approved in advance by the Board of
Trustees of the Grantee.
