For the HOA declaration, it references the most recent plat submittal for Free State Run, however,
per Stanley Martin's attorney,they did not update the name of the neighborhood.
The Maintenance Agreement should now reflect all items in the attached checklist, compiled by
Greg.

I would also suspect that the HOA docs need to specifically reference the name on the subdivision plat and site plan
under which the County reviewed and approved your proposal, but I could be wrong. I retrieved what was reviewed in
the County Attorney's office and it was not approved for several reasons; some of those reasons appear to be general in
nature and others appear to be due to the fact they were reviewed against the wrong project.
Please let me know when the revised HOA docs have been submitted to Community Development. I will confirm they
have been received.

I did not think the HOA declaration that Stanley Martin submitted to Greg included the necessary
maintenance language. My attorney is drafting a supplemental agreement to cover remaining
improvements now, it's just taking him longer than expected. I hope to have something tomorrow. Is
that not how you wanted to proceed?

In the future, all declarations/maintenance agreements should be submitted to the County planner reviewing the
project. We also are now requiring either that either the applicant or the planner identify where all of the

Just FYI, my experience has been that approval from the County Attorney's office will be the limiting factor at this point.

On other projects, I've provide the Private Road Maintenance Agreement, as well as a Landscaping
and Open Space Maintenance Agreement. Will these two suffice for Free State?

Here are Planning comments for this plat:
I. [Comment]—On Sheet 1, please add a note to indicate that all easements are to be considered new unless they
are labeled as existing.
Section 14-302(A)(5)—On Sheet 2,the new sight distance easement along Free State Road should be labeled
/ "dedicated to public use."
A. Section 14-302(A)(9)—On Sheet 1, please add a note to indicate that "Each lot contains a building site that
complies with Section 4.2.1 of the Albemarle County Zoning Ordinance."
C4. Section 14-317—Please submit an instrument for approval by the County Attorney's office assuring the
perpetual maintenance of the required improvements associated with the site plan for Free State Run.
CJS. Section 14-302(A)(14), 14-426—On Sheet 2, please use hatching (or some other demarcation method)to
highlight the area at the front of the subdivision being dedicated to public use. It is currently difficult to discern
where the Free State Road dedication ends and Free State Drive begins. Similarly, it is difficult to determine
/ where the public storm sewer easement ends and the stormwater management easement begins.
4 Section 14-400—It appears that Lot 19B has less than 9 feet of street frontage. How could a vehicle access this
lot?Should a shared driveway easement be provided to allow vehicular access should these lots be developed in
the future?

issue is not exactly covered in the regulations so its not the easiest thing to resolve. Here is where we stand
though:
1) We have continued to research the issue over time as requested in an effort to get the strip into ROW as
desired by VDOT.
2)We can say for certain that strip is not ours. That more or less takes this issue out of our control.
3) I understand that Bob Hauser has agreed it should have been part of his property. I also understand that the
County is aware of this and will work with Hauser to get this resolved.
From a Free State Run perspective, the only thing we are trying to do is pave a 24' wide road in a 30' VDOT
easement. We have taken out any improvements that VDOT might have to maintain that are outside of the long
platted easement. Unless it is the opinion of VDOT that we can't even repave/widen a road within a
prescriptive easement then I cannot see any reason that the plan should be held up any longer on this matter.
I know you've been short staffed and this wasn't on your list of problems to deal with previously, but we really
need to decide what to do and move along and we would appreciate anything you can do on your end to help
with that.
