Comment Response Letter
Dear Mr. Padalino:
We have reviewed all of your comments from May 21, 2018 and made the necessary revisions.
Please find our responses to the comments below in bold lettering.
Planning Services (Tim Padalino):
1. [Z.O. Sections 32.6.2(a) and 32.5.2(a)]: Provide all information about all applicable
conditions of approval and proffers, including the application numbers of approved SP
and ZMA applications which may be in effect (as may be applicable), pending action by
BOS on SP201700022, ZMA201700008, and the associated Special Exception request.
This information has been added to the cover sheet.
2. [Z.O. Sections 32.6.2(a) and 32.5.2(a)]: Add a note stating that the subject properties are
located in the Rio Magisterial District.
This information has been added to the cover sheet.
3. [Z.O. Sections 32.6.2(a), 32.5.2(a), 21.7, and 4.20(a)]: Two of the proposed additions are
not permissible as shown on Sheet C2.0 without an approved Special Exception, due to
the applicable setback requirements established in Z.O. 21.7 and contained in Z.O.
4.20(a). However, Staff acknowledge the applicants' pending Special Exception request
which, if approved by the BOS as recommended by Staff, would allow for the proposed
additions to be sited as shown [partially located within fifty (50) feet of the rear property
boundary and adjoining R6 Residential district, which would otherwise be prohibited].

4. [Z.O. Sections 32.6.2(a), 32.5.2(b), and 4.12.6]: The site plan appears to show 97
proposed off-street parking spaces, five (5) of which appear to be designated to meet
ADA accessibility standards. In order to determine if this amount is compliant with
applicable off-street parking requirements, provide a written schedule or other

tabulation which identifies the minimum parking requirements as calculated based on the
proposed use(s).
A Parking Determination has been submitted and approved by zoning for the number
of spaces provided on site.
S. [Z.O. Sections 32.6.2(a), 32.5.2(n), and 32.6.2(k)]: Staff acknowledge that the Legend on
Sheet C 1.0 includes a "Site Light," Sheet C2.1 designates existing light fixtures for
removal, and Sheets 3.0 and 3.1 include existing light fixtures to be retained — but the
plans do not appear to include any icons for "Proposed Site Light(s)," and no product cut
sheets or other outdoor lighting information is provided in the details sheets. Provide
information about proposed outdoor lighting, including a photometric plan and location,
description, and photograph or diagram of each type of outdoor luminaire that may be
proposed (as may be applicable).
We are working to coordinate this information with the owner & design team.
Photometric information will be submitted as soon as available.
6. [Z.O. Sections 32.6.2(j) and 32.7.9]: Sheet L1.0 includes two notes that are partially
contradictory. A note states "Frontage landscaping to be improved with additional
plantings. See note this sheet." And the corresponding "Landscape Note" states that
"At the perimeter of the site, existing vegetation is intended to remain and satisfy buffer
requirements. If needed, supplemental landscaping will be provided." Staff are
concerned that the language in these two notes is unclear, and will potentially create
difficulty during the inspections process. One note is an affirmative commitment, and the
other is a conditional statement with no
However, the intention to comply with applicable landscaping requirements seems to be
clear. Therefore, to clarify the language and to enable this issue to be more easily
addressed and resolved during the inspections process after permitted construction takes
place, revise the "Landscape Note" on Sheet L 1.0 as follows:
"At the perimeter of the site, existing vegetation is intended to remain and satisfy buffer
requirements. Supplemental landscaping will be provided if it is determined to be
necessary by the Zoning Administrator or her designees. Supplemental landscaping will
include evergreen trees, such as Eastern Red Cedar and American Holly."
This note has been revised. See Sheet L I.O.
7. [Z.O. Sections 32.6.2(a), 32.5.2(0), and 32.7.1 ]: (Note: Advisory Comment — no action
necessary at this time.) Staff acknowledge the proposed reservation of land along
Berkmar Drive for future dedication to Albemarle County for public use (towards
establishing a 44' wide ROW along this section of Berkmar Drive). To formally dedicate
land that has been reserved, a plat and corresponding deed of dedication will need to be
submitted for approval and recordation at such time that the County demands.

8. [Z.O. Sections 32.3.3(b) and 32.4.3]: (Note: Staff Recommendation — for informational
purposes and for applicant's consideration.) The Code of Virginia and County Code
establish a 60-day review period for this type of application. Because your associated
legislative applications (SP201700022, ZMA201700008, and Special Exception request)
are not scheduled for public hearings by the BOS until June 13 which occurs after this 60-
day period, and because Staff cannot approve this major site plan amendment unless and
until the BOS approves the corresponding legislative applications, Staff strongly
recommend that your request that your application for SDP201800023 be deferred
pursuant to Z.O. Section 32.4.3.5(a). A Deferral would avoid the impending situation
where the only possible administrative action would be Denial.

CDD Planning(lohnathan Newberry):
1. There will be proffers applicable to this site plan. Elaine and I are reviewing the
CASPCA's SP/ZMA requests, which the Planning Commission heard on April 24`h and the
Board is tentatively scheduled to hear on June 13`h.

Engineering Review (M Wentland):
1. Page 5 - Show existing MH.
Existing manhole has been shown see Sheet C3.1.
2. Page 10 - Show safety slab for drops > 12'.
Safety slabs had been called out for all applicable manholes.
3. Page 10 — Provide compaction and fill specifications for pipe installed in fill.
A note has been added to the plans stating that controlled fill is required for all pipes in
fill. See Sheet C4.2.
4. Page 5 — Dimension loading space.
Dimensions have been shown on sheet C3.0.
S. Page 5 — Label sidewalk width; also, provide bumper blocks, else 6' walk width.
Bumper blocks have been provided. See Sheet C3.0.
6. Page 5 — Show dimensions, dumpster pad.
Dumpster pad has been dimensioned. See Sheet C3.0
7. Page 4 — Provide note if Ex. UG detention will remain. VSMP review may result in
additional SP comments.

8. Page 9 — Provide dumpster pad section detail with Site Details.

9. Page I — VSMP Plan approval is required prior to MIA approval.

12. Page 6 — Provide a guardrail to ensure adequate parking lot safety.

13. Page 10 — VSMP plan should consider proposed effect on Ex. UG detention system.

14. Page 12 — Provide additional detail; i.e. Stormceptor Mfr. Installation guidelines/details.

CDD Inspections (Michael Dellinger
1. State building code requires building permits when the wall retains three or more feet of
unbalanced fill. An engineered stamped design when that wall is 4 or more feet in
addition to a building permit.
Acknowledged. Design drawings for the walls shall be provided under a separate cover.
ACSA (Richard Nelson):
1. Submit 3 copies to ACSA for water review.
3 Copies have been provided.
2. Confirm private lift station has capacity for proposed additions.
This information has been passed on to the mechanical engineer. It shall be provided
under a separate cover.
3. Provide fixture counts for ACSA to confirm current meter size is acceptable.

4. This area is in a low water pressure area.

VDOT (Adam Moore)
1. Please demonstrate that the drainage to the existing storm system crossing SR 1403 is
less than the predeveloped condition or the system remains adequate.
This information is shown in the WPO plans.
2. Future right of way must be dedicated to County for public use.
