We are trying to develop consistency for all SWM easements so that the titles are the same, even if the type of SWM facility is different, and "forest and open space" is considered a type of non-structural SWM BMP in this case. Here is a summary of what that means for this project: 1. The easement area is no longer called a "conservation area" but rather a "SWM Forest and Open Space . Easement." As a result, we need a few minor revisions to the plat. a. On Sheet 1, please replace "conservation area" with "SWM Forest and Open Space Easement" in the title and in the statement of consent to division. b. On Sheet 1, please add the following note: "The SWM Forest and Open Space Easement is subject to the guidance set forth by DEQ in the Virginia Stormwater Management Program. The areas will remain undisturbed in a natural, vegetated state, except for activities as approved by the local program authority, such as forest management, control of invasive species, replanting and revegetating, passive recreation (e.g., trails), and limited bush hogging to maintain desired vegetative community (but no more than.four times a year). '' c. On Sheet 2, please revised the label of the easement area to be a "New 60' Wide SWM Forest and Open Space Easement." 2. A deed must be approved to form by the County Attorney's office and then signed by the County Executive. The County Attorney's office met with him and other staff this morning about how these types of plats are reviewed and approved. I don't have additional information at this point, but Frank requested that we wait until the County Attorney returns to the office on Tuesday next week before we sign this plat. I think it's related to long- term maintenance of conservation areas, but I'm not sure. I'll be sure to contact you as soon as his issue is resolved and the plats have been signed. Thanks, J.T. It sounds like for these types of plats that: 1. A deed will be required 2. Engineering will be the lead reviewer As a result, we'll delay issuing comments until we get further direction from Megan. Here's what I've got on this one... 1. Section 14-302(A)—Please re-label the proposed conservation easement on Sheet 2. Is the easement public or private? Let's get further direction from Megan. 2. Section 14-302(B)(16)—According to Albemarle County GIS,there are no dam break inundation zones on the property. Please verify where the information shown on the plat came from,since it shows dam break inundation zones in two areas on the property. Please amend Note F on Sheet 1 if necessary.There is a state dam break zone in this area and it is correctly shown on the plat. 3. Section 14-302(A)(12)—Albemarle County GIS shows several areas with critical steep slopes on the property. Please consult Albemarle County GIS and update the plat as necessary to reflect Code requirements.We wouldn't require this information on a plat like this one. 4. Section 14-303(E)—Please state the right-of-way width for State Route 676 in the label on Sheet 2. Good catch! But I don't think we'd require this information in this case. 5.
