Tim,
We would like to request deferral to comply with option # 1, as stipulated above. This would put us on track for a August 20th SUP submittal
date, and the re-initiation of the preliminary Site Plan on the same day (with a 53 day review timeline from the County).
Thank you for all the help today at the Pre -App meeting. We are looking forward to working through the project.

o At best, this approach would still involve the risk you referenced in your recent message (below),
with the "best" possible outcome being that you could (potentially) receive conditional approval of the
Initial Site Plan, with one of the obvious conditions that the Final Site Plan would not be approved
without BOS approval of all required legislative approvals.
o This approach also includes the (potential) possible outcome that the Initial Site Plan receives
conditional approval as described above, but the review of the legislative applications give rise to the
need to revise the site plan to such a degree that it would need to be submitted as a new Initial Site
Plan and go back through SRC.
2. We would accept a request to process this site plan (submitted as an Initial Site Plan) as a "Pre -Application Plan"
pursuant to Z.O. Section 32.4.1, and provide a reimbursement for the difference in cost between Initial Site Plan and
Pre -Application Plan application fees.
o This gives you a chance to receive a review comment letter identifying the application requirements
and other major review comments within 10 days of the "submittal date" (which is considered 7/23 for
your application), and includes a work session with SRC members during one of the Monday
afternoon time slots that would otherwise be reserved for a pre -app meeting.
o This would also give you time to focus on preparing whatever permit applications,
waiver/modification requests, etc. are required for this proposed project in between now and the
mandatory pre -app for the steep slopes SP that Kelsey has scheduled for Monday 7/30.
3. We also recognize you have the right to request that we proceed with taking action; however, in that approach,
CDD staff would deny the initial site plan and not take it to SRC, on account of the zoning / legislative requirements.
Please follow up with whenever you've had a chance to make a decision. Feel free to call me if you think that's best.

Thanks for your patience as I conferred with other planners. This situation has actually stirred up a number of
questions about how to best process the application (and how to best handle similar situations, since this has been
happening in recent months). And as such, I'm just writing to let you know I'll need some more time to continue the

Hey again Justin,
Thanks for the quick feedback. Those are good thoughts for us to consider; and regarding your question, I think the
issue was that the potential denial of a steep slopes SP application and potential denial of a stand-alone parking SP
application could require the proposed new location of the entrance to change (presumably to remain in it's current
existing location), and/or the proposed location of the stand alone parking to change, which would then require
changes the location/layout of your internal circulation, which would also then affect your entire site layout, and also
require re -review by Fire & Rescue, VDOT, etc.
It's a bit speculative, but I think that is generally the concern — that the whole site plan could unravel if the steep
slopes and stand alone parking SPs were denied for any reason. And then the process would begin with a new initial
site plan again, albeit with a different site layout, entrance, circulation, parking, etc.
Even so, let me share your message with a few other planners and see how they'd like this situation to be handled,
with consideration to your response below.

Hi Tim,
I think our hope was to request deferral after we receive comments. I realize that puts you in a position of
having to review a plan that can't get approved right away, but we want to make sure there aren't any other
items that we aren't aware of that require exceptions/etc. We also need to work with VDOT on the plan and
could do that even while the siteplan was under a deferral. So unless there isn't any reason you can't proceed
further with the review we would like to continue on with the knowledge that before the end of the 60 days we
will need to defer action.
Although, related to that, why couldn't the initial siteplan be approved with a condition that an SP is required
for disturbance of the preserved slopes? It puts us at risk for working on a final plan that could be denied but
that is a risk that our client is willing to take.

I've volunteered to follow up with you regarding the application status and the review process for this
initial site plan application.
As the application materials indicate, the site plan (as proposed) requires approval of legislative
applications: a special use permit to develop/disturb within the Preserved Steep Slopes Overlay
district pursuant to Zoning Ordinance 30.7.4.b.2 and also a special use permit for stand alone parking
in the R4 Residential district pursuant to Zoning Ordinance 15.2.2.15.
After initial review of this situation, it is the consensus of myself and other planners that the best next
step is for you to request deferral of this initial site plan, and prepare and submit the required SP
applications. That is because whoever becomes the lead reviewer on this initial site plan will not be
able to do anything other than deny the initial site plan after the SRC meeting, since there is no way to
approve (even with conditions) this initial site plan which has a site configuration/layout that depends
so heavily on BOS-approved special use permit applications.
With that in mind, we recommend that you request deferral in writing of SDP201800056; and that
would also be a good time to prepare and submit the other application materials you identified in your
project narrative: the special exception request for double frontage lots; the special exception request
for screening for double frontage lots; and the private street standards waiver request.
With that approach, the County would be able to begin processing the SP applications; and at some
point (probably after the PC public hearings), we could begin reviewing the initial site plan again (after
you request County action, i.e. for the site plan review to begin again), inclusive of the necessary
exception requests and waiver request.
After you all have had a chance to review and discuss this, please feel free to let me know your
thoughts and/or decisions, or simply feel free to call me if that's easiest.
