Please be advised of the following concerns that may accompany the future zoning approvals
necessary for this project.
• The site is currently zoned RA, Rural Areas. It is also subject to the AIA, Airport Impact Area;
EC, Entrance Corridor; and FH, Flood Hazard overlay districts.
• The proposed public use is permitted by -right in the RA, Rural Areas zoning district per
Section 10.2.1.9 of the Zoning Ordinance.
• The entirety of the site is shown as being subject to the FH, Flood Hazard overlay district on
the County's GIS-Web. The applicable regulations for uses and development are dependent on
whether the area is in the regulatory floodway or the floodway fringe, as delineated in Flood
Insurance Rate Map provided by the Federal Emergency Management Agency.
• The recreational use is permitted by -right in both the regulatory floodway and the floodway
fringe; provided that no primary or accessory structures are permitted under this classification.
• Grading is not permitted in the regulatory floodway.
• Parking areas are not permitted in the regulatory floodway.
• Depending on the extent of grading activities in the floodway fringe areas, a Special Use
Permit may be required. Further information can be found in Section 30.3.11 of the Zoning
Ordinance.
• The concept plan shows a parking area and trailhead on TMP 45-66131, which is currently
under separate ownership. This will need to be resolved with the site plan.

The site of the boat launch/park/trailhead is within an Important Site identified by the county's Natural
Heritage Committee. The site name, 'Salamander Crossings', refers to the importance of the site as
a breeding location for spotted salamanders and other amphibians. The site contains a number of
vernal pools and wetlands which the amphibians use for breeding. The spotted salamanders travel
to the vernal pools from land upslope of this site, north of Rio Mills Road. Late winter or early spring
is the typical time the spotted salamanders move to the wetlands to breed, but other species of
amphibians probably use the wetlands during other times of the year. The siting and construction of
any facilities, including trails, should not impede the ability of the salamanders to move through the
site and reach the vernal pools. Per federal regulations, impacts to the wetlands should be avoided.
Impacts to vernal pools and other wet areas, whether jurisdictional wetlands or not, should also be
avoided. Schroeder's Branch is the western boundary of the parcel, so the county's Water Protection
Ordinance and stream buffer regulations come into play.

- The project is proposed within a Regulatory Floodway and Floodway Fringe. Requirements of the
Flood Hazard Overlay District apply [18-30.3].
- Approximately half of the park that is closest the river is within a regulatory floodway. Grading
activities are not permitted within the limits of a regulatory floodway [18-30.3.11]. This includes
grading for trails, parking areas, boat launch, etc.
- A Floodplain Development Permit will be required for any development within the floodplain limits. A
hydrologic and hydraulic analysis/study may be required as part of the FDP to show impacts (or not)
to the floodplain.

The Historic Preservation Committee has been tasked by the BOS to create content for an
interpretive panel/kiosk. The HPC has been conducting research into the history of the Rio Mills area
and has created a digital exhibition which can be utilized for the purpose of an on -site interpretive
panel.
Two archaeological resources have been identified on the proposed site according to VCRIS, the
cultural resources database managed by the Virginia Department of Historic Resources (see
attachment in laserfiche, "Review comments -- historic preservation"):
Resource 44AB0594, which lies immediately east of the Berkmar bridge, is a contact -period, Native
American lithic scatter as well as a post -contact Euro-American artifact scatter that was thoroughly
surveyed and documented between 2014 and 2017 as part of the Berkmar Drive extension across
the Rivanna River. Staff does not recommend further documentation of this resource.
Resource 44AB0137, at the western end of the parcel, is the potential remnant of a 19th century
canal and lock system; it has never been surveyed, and the possible extents of the resource are
projected from documentary evidence, including W.E. Trout, III The Rivanna Scenic River Atlas,
Virginia Canals and Navigations Societies (1992) and Maps of the First Grand Division of the James
River and Kanawha Canal [Richmond to Lynchburg] Accompanied by a M[ap] of the Dock a[t]
Richmond. Surveyed & drawn by C. Radziminsky. n.d. Staff recommends that documentation and
survey of the western part of the site, in an effort to locate and demarcate the extent of the historic
canal and lock system (resource 44AB0137), be undertaken. Further analysis should begin with an
analysis of documentary sources and the creation of a site map which overlays the possible location
of the canal and lock system with topographic data. A foot survey or walking reconnaissance of the
area should be undertaken to potentially identify evidence of the resource on the surface. Further
undertakings to identify and demarcate the resource may be necessary, and if the location and extent
of the resource are identified, avoidance of the resource is recommended.

The majority of the development is proposed for the eastern end of the site, where land has been
disturbed previously, and a small portion on the northern edge of the site, east of Berkmar bridge.
The VCRIS database does not identify any resources in these areas, and previous land disturbance
limits the potential of finding intact resources. Nevertheless, a survey of the areas that will be
impacted the most by proposed development should be undertaken prior to the initial grading permit.

*This proposed park is located approximately 700' downstream of the RWSA South Fork Rivanna Dam, which is
considered a high -hazard dam based on downstream development. RWSA has concerns about the proposal related to
dam safety and wishes to be involved in the planning process as the project moves forward. Due to the proximity to the
dam, RWSA wishes to explore a number of options for improving public safety at this location, including but not limited
to: warning signage, warning sirens, educational and safety information at the proposed "educational kiosk", limitations
on vehicle parking hours, and fencing and/or signage to prevent trespassing on the dam property. It should also be
noted that the development of this park will impact RWSA's internal dam safety procedures, as this will be the first
"improved" property impacted by a failure of the South Fork Rivanna Dam. Currently the nearest "improved" property
impacted by the dam is approximately 2,400 ft downstream of the dam, and the nearest structure is approximately
7,000 ft downstream of the dam. The development of the park will lower the amount of time available to RWSA to
respond and notify the public in the event of a dam failure, therefore it will be imperative during the planning and
design process to take these factors into account.

Standards for Entrances. Recommend private and low volume commercial entrance.
