DEQ has terminated the VWP General Permit coverage referenced above in accordance with 9 VAC 25-690-90.A.4.a. The termination of coverage is effective immediately. As provided by Rule 2A:2 of the Supreme Court of Virginia, you have thirty days from the date you received this decision within which to appeal this decision by filing a notice of appeal in accordance with the Rules of the Supreme Court of Virginia with the Director, Virginia Department of Environmental Quality. GENERAL COMMENTS: DEQ staff met with Mr. Jess Achenbach for the site inspection to observe site conditions prior to processing a termination request for the permit. DEQ staff observed conditions at the main Carrol Creek crossing and a small impact in the residential section for the installation of a stormwater management BMP and outfall. Both impacts appear to be taken as described in the JPA. GENERAL NON-COMPLIANCE ITEMS NOTED: Erosion and sediment controls are still present at the Carrol Creek crossing. DEQ staff requested that all E&SC be removed and the entire site stabilized prior to processing termination of the permit. Mr. Achenbach indicated that he will check with the County and remove the E&SC if they agree site is adequately stabilized. Mr. Achenbach indicated that he would provide photos when complete.
