TINS DEED OF GIFT AND BOUNDARY LINE ADJUSTMENT, made and entered into this
1" day of August, 2017, by and between TOWNE DISTRICT, LLC, a Virginia limited liability
company, as the Grantor, and, JAMES P. WIENCEK and CLAREEN A. WIENCEK, as the Grantees,
whose address is 1808 Marietta Drive, Charlottesville, Virginia, 22911.
The COUNTY OF ALBEMARLE, a political subdivision of the Commonwealth of Virginia
joins herein as an additional Grantor, to confirm the conveyance set forth herein, which land is part of a
recorded plat and dedicated Right of Way in Cascadia Subdivision. CASCADIA DEVELOPMENT,
LLC, a Virginia limited liability company joins herein solely as a Declarant for Cascadia Subdivision to
confirm its approval of the Boundary Line Adjustment that is the subject of this Deed, to be indexed as
Additional Grantor.
WITNESSETH:
THAT for and in consideration of the sum of One Dollar ($1.00) and the premises contained
herein, the receipt and sufficiency of which are hereby acknowledged by the Grantor, the Grantor does
hereby GIVE, GRANT and CONVEY with GENERAL WARRANTY OF TITLE unto the Grantees,
husband and wife, as tenants by the entirety with the right of survivorship as at common law and not as
tenants in common, the following described property, to wit:
All that certain tract or parcel of land, with the improvements thereon and the appurtenances
thereunto, situated in Albemarle County, Virginia, being shown along the full length of the
westerly boundary line of Lot 185 and the Marietta Drive variable width right of way, as shown
and described on a Plat by Dominion Engineering dated April 10, 2018 titled: "Boundary Line
Adjustment Plat, Cascadia Subdivision, Blocks I — 3, Phase 11, Tax Map 78H-02 Parcels 185 -
188, Rivanna District, Albemarle County, Virginia" (`the Plat"), which Plat is attached hereto,
recorded herewith and incorporated herein, creating a new boundary line between Marietta
Drive and Cascadia Subdivision, Phase 11, Block 2, Lot 185; BEING, a portion of the property
conveyed to the Grantor by deed dated June 11, 2015, from Cascadia Development, LLC, a
Virginia limited liability company, recorded in the Clerk's Office of the Circuit Court of
Albermarle County, Virginia in Deed Book 4635, Page 659.

This conveyance is made expressly subject to any and all easements, restrictions, reservations and
conditions contained in duly recorded deeds, plats and other instruments constituting constructive notice
in the chain of title which have neither expired by time limitation contained therein nor otherwise become
ineffective.
As to the Boundary Line Adjustment shown on the aforesaid Plat for Lot 187, the Grantor, as the
Owner of Cascadia Subdivision, Phase IT, Block 2, Lot 187, hereby CONFMMS and submits the Plat to
record affirming the courses and distances set forth therein, including the Boundary Line Adjustment and
resulting acreages shown for Lot 187 shown on the Plat.
