Ana Kilmer in our office prepares all bonds. You will need to coordinate with her when ready as we do not issue blank
bond forms.The bond form will depend on the security used.
It is preferred that each owner sign for the portion for which they are responsible.
Note that the SWM agreement that Rivanna signs will take responsibility for the entire facility, on both properties. If this
is NOT what you want to do, then the adjacent owner will also need to sign a SWM agreement.

I am delighted to receive such an enlightening and rapid answer from you. If"public use"just refers to the County,then
I think both owners will sign the Deeds of Dedication. And what a relief, if only Rivanna needs to sign a Stormwater
Management agreement with the County.
You mention that all improvements will need to be bonded and that each owner will need to sign the bond. Can you
direct us to the bond form(s) each owner will have to sign? If need be, can our neighbor sign a bond for the
improvements on his property and Rivanna sign a separate bond for improvements on ours? I am trying to anticipate
the next hurdle.

Hello Frank,
Elizabeth Elder,the head of our Rivanna building committee, suggested I contact you directly with questions about the
Stormwater Management BMP Facilities Maintenance Agreements and Deed of Dedication.
We hope to meet our attorney soon to get the new storm water easement, deed and maintenance agreements signed
by the owners. Having two owners makes the process a little more complicated.
I have attached the documents to which I refer in the questions below so you don't have to hunt for them.
1) The Deed of Dedication and Easement dedicates the easement to"public use"on the first and second
pages. May our attorney edit the county's form to allow the county and its agents access without granting
general public use? Perhaps I am taking the term "public use"too literally, but I did notice that our existing
maintenance agreement(attached) has a clause entitled No Public Dedication (last page). "Public Use" is a
general, standard phrase used to give access to the County. It appears your existing agreement may need to be
revised to allow this dedication.
2) Our Storm Water Management/BMP Facility is shared between two owners and straddles two properties. The
county Stormwater Management BMP Facilities Maintenance Agreement document is written for a single
owner. Can we put the names of both owners on one form or should we submit two forms(as recommended
for the Deed of Dedication and Easement)? Only one owner plans to build at this time so the other owner

would not want to be "obligated to construct the Facility"as dictated in the agreement; I trust we can edit the
forms a bit.All improvements shown on the plan will be required to be completed 'at this time', but the
improvements can be completed by either party.The proposed improvements will need to be bonded prior to
issuance of the land disturbance permit, and the bond will not be released until all improvements are
completed, regardless of whose property they are on. Each owner will need to sign the bond.The County was
under the impression that the adjacent land owner would not sign another SWM maintenance agreement (with
the County) but that they would sign a deed of easement dedicating a SWM easement to the County. Is this true
or will they sign both documents? If they will sign both documents, it will be cleaner to have two deeds and two
SWM agreements, one deed and SWM agreement with each owner.
3) We would still need our existing Declaration of Easements and Maintenance agreement between the two
owners to define use, maintenance,cost sharing and other parking easements, etc. I presume that is not a
problem with the county to have multiple maintenance agreements on file as long as they do not contain
conflicting information. We do want to amend the agreement between the two owners to shift more(but not
all)of the cost of maintenance to Rivanna. Can we amend this agreement independently of the others in so far
as they do not conflict? The County does not recognize the private agreement since it is not a party of that
agreement.The County will seek compliance through the County SWM agreement and deed.
If these questions are answered,then we might have a better sense of direction with our attorney.

I have reviewed the plat and attached my comments on the PDFs. I've added the word "facility"to the name of the
easement to match the standard language in our deed. This occurs on each page of the document. Other than this, the
County has no further comments on the plat.
I see that Bobby sent you the deed template.We (the County) need to fill it out to make sure it is correct, your attorney
can then review it of course. I will fill it out and forward it to you this afternoon—please hold off on asking your attorney
to do any work on it. Basil,will you please confirm what the last revision date for the plat will be?

We plan to meet with our neighbor's lawyer who will prepare the Deed and a SWM maintenance agreement
that satisfies the county requirements (based on the template we received from you) and that is agreeable to the
neighbor. Our plan was to submit the signed easement to the county along with all these other documents. We
were hoping that the county would give us an indication of whether this draft easement plat will be acceptable,
before we accrue additional lawyer's fees to prepare the final version of the accompanying documents. Is this
possible?

I looked over the revised plat, all previous platting comments are addressed.
As discussed by Bobby Jocz, there are two documents that are needed for approval of the current plat.
1. The SWM maintenance agreement: The SWM maintenance agreement is executed/recorded before the
plat/deed. SWM maintenance agreements are formatted a specific way and are handled through Ana
Kilmer (CC'd). She will be able to help you with this going forward. I have updated her on the situation.
2. Deed of easement: The deed of easement is recorded with the PLAT.
Please draft both of these documents up and submit them to the County for review.

There will be two documents that will be needed.
1. The SWM maintenance agreement. SWM maintenance agreements are formatted a specific way and are

Since this is an odd situation this is how I recommend going forward in the process if you choose to do it the way
described in your email.
1. Contact Ana to start work on the SWM maintenance agreement—This document is created independently for
both parcels the SWM easement falls on [NOTE: Only one is needed per parcel regardless of the number of
SWM easements on the parcel, so It will cover the extended SWM easement for the underground storage pipe
without the need for an additional SWM agreement]
a. Information for Ana to format the SWM agreements
i. TMPS: 03100-00-00-03200; 031A0-00-00-000A0
ii. MS-4: NO
2. Complete the remaining items for PLAT review with the County
3. Concurrently circulate the Deed of Easement for signature by parties of both parcels and submit to the County
a. Once received by the County the (signed) deed of easement will be sent to the County Attorney's office
for review and signature by the County Executive/County Attorney.
b. The Deed of easement will be returned to you for record at the County Clerk's Office.
c. Once recorded, provide the receipt of record to the County as proof of record.
4. Final PLAT approval (signature) is granted for the existing SWM facility easement
5. Once the PLAT Is prepared for the extended easement, submit the PLAT for county review.
6. Repeat step 3 above,with signatures only for Rivanna Community Church,for the new SWM easement. [NOTE:
No new SWM agreement will be needed for this easement]
The other option is to amend the plat currently being reviewed to include the extended SWM easement.This will save
the extra PLAT and Deed of easement review.

Spoke with Rob Jocz regarding his review comment #3. Stormwater management calculations
were provided in the attached Engineering Manual submitted with the site plan but were not
transmitted to him.
Can the Engineering Manual be used to demonstrate adequacy of proposed stormwater
management to clear Engineering Review for the Subdivision Plat so that it can be approved with
comments #1 and #2 addressed?
