As discussed by Bobby Jocz, there are two documents that are needed for approval of the current plat. 1. The SWM maintenance agreement: The SWM maintenance agreement is executed/recorded before the plat/deed. SWM maintenance agreements are formatted a specific way and are handled through Ana Kilmer (CC’d). She will be able to help you with this going forward. I have updated her on the situation. 2. The deed of easement is recorded with the PLAT. Since this is an odd situation this is how I recommend going forward in the process if you choose to do it the way described in your email. 1. Contact Ana to start work on the SWM maintenance agreement – This document is created independently for both parcels the SWM easement falls on [NOTE: Only one is needed per parcel regardless of the number of SWM easements on the parcel, so It will cover the extended SWM easement for the underground storage pipe without the need for an additional SWM agreement] a. Information for Ana to format the SWM agreements i. TMPS: 03100-00-00-03200; 031A0-00-00-000A0 ii. MS-4: NO 2. Complete the remaining items for PLAT review with the County 3. Concurrently circulate the Deed of Easement for signature by parties of both parcels and submit to the County a. Once received by the County the (signed) deed of easement will be sent to the County Attorney’s office for review and signature by the County Executive/County Attorney. b. The Deed of easement will be returned to you for record at the County Clerk’s Office. c. Once recorded, provide the receipt of record to the County as proof of record. 4. Final PLAT approval (signature) is granted for the existing SWM facility easement 5. Once the PLAT Is prepared for the extended easement, submit the PLAT for county review. 6. Repeat step 3 above, with signatures only for Rivanna Community Church, for the new SWM easement. [NOTE: No new SWM agreement will be needed for this easement] The other option is to amend the plat currently being reviewed to include the extended SWM easement. I'm writing to note a couple of things related to the easement plat. First, our engineer modified page 2 of the site plan (after sending it to us for signatures). He mailed four copies of the revised page 2 directly to your office; this replaces page 2 in the collated and stapled sets. These revised pages should have also arrived yesterday. I'm sorry for the inconvenience this will cause. Second, the site plan sets (page 2) reflect the newly modified proposed easement plat, which is based on the "as built" survey we did last month. Blackwell has also submitted the new proposed easement plat along with our site plan documents. Our neighbor's lawyer has the proposed plat, and our neighbor has expressed his willingness to sign it, but we don't quite yet have signatures and the documents necessary to record the easement. No problem, yall are very close to the finish line. Our engineer just sent me your June 6th comments on the revised plat we submitted in April 2017. This revised plat depicts an easement on our property only; we revised and re-submitted because at that time we'd been unable to get our neighbor's signature on the December 2015 plat. The good news (for us) is that our neighbor has expressed his willingness to sign our prior easement plat, which you approved on December 16, 2015. That plat was never "approved"; rather, we had"no objections"at the time and were pending owner signatures before approval. This older plat depicts an easement over the entire detention basin, which spans the back of our two adjoining properties. This easement will allow us to use the basin for stormwater detention, which will mean significant savings on our site work costs. So,we would like to use the December 16, 2015 approved plat for our next site plan submittal. Will we need to re-initiate the SWM easement plat submittal process, or is this older plat still considered"approved"? (The proposed stormwater detention basin may have been modified on the last version of the site plan to try and accommodate the scenario of your neighbor not signing off on the plat. If this is the case it could monkey with what was depicted on the previous plat from 2015 and cause it not to be valid for"no objection" anymore once resubmitted. My advice to you is to have your Engineer and your Surveyor communicate with each other and have them make a decision on what to submit. This will avoid a lot of wasted time, assure they are both on the same page, and assure what is depicted on the site plan for SWM matches what is proposed on whatever Easement plat you submit for review.) If necessary, we can revise the 2015 plat to address the comments you made on June 6, 2017. The 2015 plat was withdrawn. What you need to do is have the surveyor modify the proposal on the current plat(SUB2017-64)to match what yall are proposing today. And finally, may we assume that we still have until December 6th to re-submit our site plan, even if we are using the earlier easement plat rather than the one we submitted in April of this year? The good news is my comments for the site plan went out 4-11-17, as part of that letter comment#5 directs you to work on the SWM easement. Then you submitted the easement, with my last comments on that plat being sent out on 6-6- 17. Thus the date of your 6 month scenario shall be calculated from then, which means you have till 12-6-2017 till I need a resubmittal of the easement plat, which also extends to the site plan. We have just received unexpected and very encouraging news that our neighbor will be willing to sign the stormwater easement plat the county requires. Because of this, our engineer will need to rework part of our storm water detention plan. He has told us that this will require a new survey of the detention basin,which will entail a wait of 3 to 4 weeks(until the surveyors can schedule us). We are quite hopeful that we are nearing the end of this years-long process. If we can get this portion right, perhaps this will be our final submittal! Thanks for considering.
