It appears that only two easements were granted in Deed Book 4118,page 585,both of them to the County: 1. An access easement over a"New 30' Private Street,"and 2. A site drainage easement over a"New Private Drainage Easement" I've attached Lincoln ACSA As-built plat for TMP#78-31 (2/14/18)that shows both easements granted to the County. I've attached earlier(5/8/17)Lincoln plat, forerunner to February 14, 2018 plat,that shows a purple-dashed line (DB4118 /PG585)Access that must be maintained. Likewise, Albemarle County will retain the drainage easement. Albemarle County requires and will retain both access and drainage easements recorded at BK4118/PG585 to serve their original purposes. PLEASE do not eliminate/vacate Access or Drainage easements from 2/14/18 ACSA As-built plat. Summary of changes: • Eliminate Note. • Revise Date*to February 16,2018 * It's late in the day—if you receive this note next week, a revised plat date of February 16, 2018 is fine—Deeds reference 2/16/18 plats. This is atypical (will print /share Attorney's email: 8/2/2017 3:08 PM). Lincoln performed field survey to establish exact centerline/s of sanitary and water main. This effort came after Alex Morrison's Aug-1,2017 email indicating recommendation for approval—that's why I wrote the only changes are date/easement CL. Standard Note: "The intent of the New Easements shown hereon is that it is to be centered on the Asbuilt location of the sewer/waterline and all of its appurtenances." Plats sent earlier today explicitly comport with this note. This note will be removed from plats sent to you earlier today(a 3'change from plat approved by Alex Aug-1)per Attorneys' request. The plats sent earlier today could not be more accurate. Lincoln surveyed installed locations(CL)of water main serving Sta.16, and sanitary line leading from Sta. 16 to an ACSA pump station(TMP#78-31E). ACSA also requested a deed to convey interest in an ACSA parcel(pump station—TMP parcel#78-31E). The deed conveys easement interest from ACSA to ACSA. Regarding ACSA easements the county position has been if the easement is show on a subdivision plat or site plan the easement plat gets the full county review and approval including owner's notarized signature on the plat. However if the ACSA easement is needed for a capital project or repair/replace project (no site plan) then the deed of easement which accompanies the plat is the vehicle of dedication.
