RE: SUB2017-178 Bird house LLC – Final (Lots 1, 2, 3)
I am the planner currently assigned to the above ref plat, which was recently submitted. The plat was
not properly submitted. As such you will need to withdrawl the application, request a refund, resubmit
the correct fees, revise and resubmit the application, and provide the correct number of copies. See
below for explanation:
SUB2017-178 Bird House LLC – Final (Lots 1, 2, 3). The subdivision application was submitted for a
2 lot division under Sec 14-207; however, this is not a 2 lot division; rather, this is a 3 lot division.
14-207 only applies to a rural subdivision[1], a subdivision resulting in two lots, a subdivision
following final site plan approval, and a subdivision creating one special lot and one residue lot. The
above case is neither of those options. While it is true that all the lots front on an existing public
street, its more than 2 lots, thus 14-207 is not applicable. I also understand you are using the 2009
principles (which omits Sec 14-316, 14-400, and 14-403 plat requirements) but it is still above 2 lots.
Thus the application needs to be made as a final plat prior to and without a prelim under 14-206 for
1-9 lots, with a fee of $1,075. This item will be required to go through SRC, thus notifications fees are
also required, $215. Also, the tier 2 groundwater study is required, $355. Please submit a min of 16
copies for SRC distribution. Once you complete all the above and resubmit it will be seated on the
next applicable SRC schedule (Nov 6 submittal deadline for a Dec 21 SRC meeting date).

I believe this application was properly submitted under 14-207.

Subject: SUB2017- 178 Bird House (Step 1) - Final Subdivision Plat (Creating Lot A and Residue (Lot 3))
The County of Albemarle Planning Division will grant or recommend approval of the Subdivision Plat referenced above
once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the
Subdivision/Zoning Ordinances unless otherwise specified.]
1. [14-309 & 14-3101 Soil evaluations; Health Director Approval of Septic Systems. Each structure is required to
maintain both a primary and reserve drainfield on the lot it serves. If either of the structures only has a primary, a
reserve drainfield shall be located and approved onsite. Approval by the Health Department is required before the
plat can be approved.
The VDH approval letter provided with the application is from 2007 and was for a substantially different proposal
than what is being proposed today. Please work with VDH andlor a soil scientist.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and
may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this
letter, then the application shall be deemed voluntarily withdrawn. Please contact Christopher Perez at the Division of
