Typically, on phased developments, this is not the case and instead each phase is added to the maintenance agreement at the time of final platting. Bottom line is-the document will suffice to cover the maintenance of the required improvements associated with this final phase of the development. Thus comment#6 is completed/complied with. Comment#7 is not satisfied by this document and is still required prior to final plat approval. Aside from this comment, the other outstanding comment has to do w/bonding of the road(see below). I have attached a copy of the original Declaration for Phase A as well as the supplemental Declaration that subjects all of Phase B to the same Declaration. I feel that it is adequate for maintenance purposes because this same Declaration has been reviewed three times by the County Attorney(once for Phase A,once for Phase B1, and once for Phase B2&B4). Given that B2&B4 were recorded less than 6 months ago, I cant imagine the rules and regs have changed that much since then. I am not frustrated...just trying to wrap my head around the request. If what I have provided isn't sufficient, I think we need to sit down and talk through things so I can get you what you need. When we recorded the B1 plat (attached)you will see that all remaining land in residue parcels A& B (B2, B3, and B4) became subject to the Declaration via this document. Given that the land was already subjected to the Declaration,we did not have to do anything else to record Phases B2 and B4. Understand that we cant subject the same land to a Declaration twice, I am not sure what you want me to do... Perhaps we can have a brief phone call or meeting to discuss. I'd like to find out from you whether there are any legal implications to calling out the dedicating to the County on the plat? The standard note: "All new public street right-of-ways shown hereon are hereby dedicated to public use" VDOT's required new note: "All new public street right-of-ways shown hereon are hereby dedicated to the county for public use" Section 14-428 of the County Subdivision Ordinance specifically states: "The agent shall require a subdivider to dedicate to the county for public use each public street"but then in subsection B it requires a note that requires "a note on the plat stating that the land is dedicated for public use. " I would like to just move on from this as it seems to be splitting hairs but be it's dealing w/the County being specifically called out as the entity who the land is dedicated to, I figured I should run it by you. Any guidance would be much appreciated. Sec.14-428 Dedication of streets,alleys,curbs,gutters,sidewalks,stormwater management facilities,bicycle trails,pedestrian trails.The agent shall require a subdivider to dedicate to the county for public use each public street,including each non-constructed street extension as provided in section 14-409,and including any required curb,curb and gutter,planting strip and sidewalk,each drainage improvement for the public street,and may require a subdivider to dedicate to the county for public use any stormwater management facility,bicycle trail or pedestrian trail within a subdivision or section thereof,as follows: A.The board of supervisors shall not be required to compensate the subdivider for any dedicated land or improvements thereon. B.The land and improvements to be dedicated shall be set apart on the final plat and be identified by a note on the plat stating that the land is dedicated for public use. C.When a subdivision abuts one side of an existing or platted street,the subdivider shall dedicate at least one-half of the right-of-way necessary to make the street comply with the minimum width fixed for the street by this chapter. If you want the language to say "dedicated to the county for public use" or whatever purpose, it must be to the "county". Even after the roads have been accepted for maintenance the property that is the right-of-way continues to be dedicated to the county. It is the county, not the developer, who requests that VDOT accept and maintain the roads. I think sometimes the particulars of that process are forgotten, but that is why part of the acceptance process is a resolution from the Board of Supervisors. Also, once this plat is recorded this language will be on the plat forever even after VDOT accepts these roads into the secondary state system and maintains them,thus causing the public and County staff much confusion as to who actually maintains these roads. Can you provide any guidance as to your reasoning for this modification in dedication language? Are you willing to revert back to the County preferred/required language?
